भारतीय बीमा विनियामक और विकास प्राधिकरण (विनियामक सैंडबाक्स) (संशोधन) विनियम, 2022

फा. सं. भा.बी.वि.वि.प्रा./विनियम/3/182/2022.—बीमा अधिनियम, 1938 की धारा 114ए की उप-धारा 2 के खंड (जेडडी), बीमा विनियामक और विकास प्राधिकरण अधिनियम, 1999 (1999 का 41) की धारा 14(2)(ई) और 26 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, प्राधिकरण बीमा सलाहकार समिति के साथ परामर्श करने के बाद, भारतीय बीमा विनियामक और विकास प्राधिकरण (विनियामक सैंडबॉक्स) विनियम, 2019 में संशोधन करने के लिए निम्नलिखित विनियम बनाता हैः-

अध्याय I

1. संक्षिप्त नाम और प्रारंभः

• 1.1 ये विनियम भारतीय बीमा विनियामक और विकास प्राधिकरण (विनियामक सैंडबाक्स) (संशोधन) विनियम, 2022 कहलाएंगे।
• 1.2 ये विनियम सरकारी राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. उद्देश्य: इन विनियमों के उद्देश्य भारतीय बीमा विनियामक और विकास प्राधिकरण (विनियामक सैंडवाक्स) विनियम, 2019 में निम्नलिखित हेतु संशोधन करना हैः-

• (i) उक्त विनियम की सीमित विधिमान्यता अवधि को हटाना
• (ii) विनियामक सैंडबाक्स की प्रयोगात्मक अवधि वर्तमान छह (6) महीने से बढ़ाकर 36 महीने करना
• (iii) सैंडबाक्स प्रस्तावों के परिणाम के आधार पर यदि आवश्यक हो तो दिशानिर्देश जारी करने के लिए अध्यक्ष को प्राधिकृत करना।

3. विनियम 1 में, उप-विनियम (3) को "आईआरडीएआई (विनियामक सैंडबाक्स) (संशोधन) विनियम, 2022 के प्रकाशन की तारीख से प्रत्येक तीन वर्ष में एक बार इन विनियमों की समीक्षा की जाएगी, जब तक इसके पहले किसी समीक्षा, निरसन अथवा संशोधन की आवश्यकता न हो" से प्रतिस्थापित किया जाएगा।

4. विनियम 5 में, उप-विनियम (3) और स्पष्टीकरण छोड़ दिये जाएँगे।

5. विनियम 6 में, उप-विनियम (2) में, शब्द और अंक "6 महीने की अवधि" के लिए शब्द और अंक "36 महीने तक की प्रायोगिक अवधि" प्रतिस्थापित किये जाएँगे।

6. विनियम 6 में, उप-विनियम (3) को "यदि आवेदन पर विचार नहीं किया जाता, तो आवेदक पुनरीक्षण के लिए आवेदन प्राधिकरण द्वारा विनिर्दिष्ट समिति को प्रस्तुत कर सकता है" के रूप में निविष्ट किया जाएगा।

7. विनियम 8 में, उप-विनियम (1) में, शब्द और अंक "6 महीने" के लिए शब्द "प्रयोगात्मक अवधि" प्रतिस्थापित किये जाएँगे।

8. विनियम 8 में, उप-विनियम (3) में, अंक "6" के लिए, अंक "12" प्रतिस्थापित किया जाएगा।

9. विनियम 12 में, उप-विनियम (2) छोड़ दिया जाएगा।

10. विनियम 13 में, उप-विनियम (3) में शब्द "विनियामक सैंडबाक्स से संबंधित विषय" के बाद शब्द "सैंडबाक्स प्रस्तावों के परिणाम के आधार पर दिशानिर्देश" निविष्ट किये जाएँगे।

INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY OF INDIA

Insurance Regulatory and Development Authority of India (Regulatory Sandbox) (Amendment) Regulations, 2022

F. No. IRDAI/Reg/3/182/2022.—In exercise of the powers conferred by clause (zd) of sub-section 2 of section 114A of Insurance Act, 1938, section 14(2)(e) and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority, in consultation with the Insurance Advisory Committee, hereby makes the following regulations to amend Insurance Regulatory and Development Authority of India (Regulatory Sandbox) Regulations, 2019: -

CHAPTER I

1. Short Title and commencement:

• 1.1 These Regulations may be called the Insurance Regulatory and Development Authority of India (Regulatory Sandbox) (Amendment) Regulations, 2022.
• 1.2 These Regulations shall come into force on the date of their publication in the Official Gazette.

2. Objectives: The objectives of these Regulations are to amend the Insurance Regulatory and Development Authority of India (Regulatory Sandbox) Regulations, 2019 to:

• (i) remove limited validity period of the Regulation
• (ii) increase the experimental period of the Regulatory Sandbox from existing six (6) months to up to 36 months
• (iii) Authorise the Chairperson to issue guidelines, if necessary, based on the outcome of Sandbox proposals.

3. In Regulation 1, sub regulation (3) shall be substituted with "These Regulations shall be reviewed once every three years from the date of publication of the IRDAI (Regulatory Sandbox) (Amendment) Regulations, 2022, unless a review, repeal or amendment is warranted earlier".

4. In Regulation 5, sub regulation (3) and the explanation shall be omitted.

5. In Regulation 6, in sub regulation (2), for the words and figure "a period of 6 months", the words and figure "an experiment period of up to 36 months" shall be substituted.

6. In Regulation 6, sub regulation (3) shall be inserted as "If the application is not considered, the applicant may file the review application to the committee as specified by the Authority".

7. In Regulation 8, in sub regulation (1), for the word and figure "6 months", the words "experimental period" shall be substituted.

8. In Regulation 8, in sub regulation (3), for the figure "6", the figure "12" shall be substituted.

9. In Regulation 12, sub regulation (2) shall be omitted.

10. In Regulation 13, in sub regulation (3) the words "guidelines based on the outcome of Sandbox proposals" shall be inserted after the words "issues pertaining to the Regulatory Sandbox,".
