L.-33004/99 xxxGIDHxxx xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY भारतीय बीमा जिजनयामक और जिकास प्राजधकरण ऄजधसूचना हैदराबाद, 5 ददसम् बर, 2022 भारतीय बीमा जिजनयामक और जिकास प्राजधकरण (जिजनयामक सैंडबाक्स) (संिोधन) जिजनयम, 2022 फा. सं. भा.बी.जि.जि.प्रा./जिजनयम/3/182/2022.—बीमा ऄजधजनयम, 1938 की धारा 114ए की ईप-धारा 2 के खंड (जेडडी), बीमा जिजनयामक और जिकास प्राजधकरण ऄजधजनयम, 1999 (1999 का 41) की धारा 14(2)(इ) और 26 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, प्राजधकरण बीमा सलाहकार सजमजत के साथ परामिश करने के बाद, भारतीय बीमा जिजनयामक और जिकास प्राजधकरण (जिजनयामक सैंडबॉक्स) जिजनयम, 2019 में संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता हैः- ऄध्याय I 1. संजिप्त नाम और प्रारंभः 1.1 ये जिजनयम भारतीय बीमा जिजनयामक और जिकास प्राजधकरण (जिजनयामक सैंडबाक्स) (संिोधन) जिजनयम, 2022 कहलाएँगे। 1.2 ये जिजनयम सरकारी राजपत्र में आनके प्रकािन की तारीख को प्रिृत्त होंगे। 2. ईद्देश्य: आन जिजनयमों के ईद्देश्य भारतीय बीमा जिजनयामक और जिकास प्राजधकरण (जिजनयामक सैंडबाक्स) जिजनयम, 2019 में जनम्नजलजखत हेतु संिोधन करना हैः- (i) ईि जिजनयम की सीजमत जिजधमान्यता ऄिजध को हटाना (ii) जिजनयामक सैंडबाक्स की प्रयोगात्मक ऄिजध ितशमान छह (6) महीने से बढाकर 36 महीने करना सं. 626] नइ ददल्ली, मंगलिार, ददसम्बर 6, 2022/ऄग्रहायण 15, 1944 No. 626] NEW DELHI, TUESDAY, DECEMBER 6, 2022/AGRAHAYANA 15, 1944 सी.जी.-डी.एल.-अ.-07122022-240850 CG-DL-E-07122022-240850 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (iii) सैंडबाक्स प्रस्ट्तािों के पररणाम के अधार पर यदद अिश्यक हो तो ददिाजनदेि जारी करने के जलए ऄध्यि को प्राजधकृत करना। 3. जिजनयम 1 में, ईप-जिजनयम (3) को “अइअरडीएअइ (जिजनयामक सैंडबाक्स) (संिोधन) जिजनयम, 2022 के प्रकािन की तारीख से प्रत्येक तीन िर्श में एक बार आन जिजनयमों की समीिा की जाएगी, जब तक आसके पहले दकसी समीिा, जनरसन ऄथिा संिोधन की अिश्यकता न हो” से प्रजतस्ट्थाजपत दकया जाएगा। 4. जिजनयम 5 में, ईप-जिजनयम (3) और स्ट्पष्टीकरण छोड़ ददये जाएँगे। 5. जिजनयम 6 में, ईप-जिजनयम (2) में, िब्द और ऄंक “6 महीने की ऄिजध” के जलए िब्द और ऄंक “36 महीने तक की प्रायोजगक ऄिजध” प्रजतस्ट्थाजपत दकये जाएँगे। 6. जिजनयम 6 में, ईप-जिजनयम (3) को “यदद अिेदन पर जिचार नहीं दकया जाता, तो अिेदक पुनरीिण के जलए अिेदन प्राजधकरण द्वारा जिजनर्ददष्ट सजमजत को प्रस्ट्तुत कर सकता है” के रूप में जनजिष्ट दकया जाएगा। 7. जिजनयम 8 में, ईप-जिजनयम (1) में, िब्द और ऄंक “6 महीने” के जलए िब्द “प्रयोगात्मक ऄिजध” प्रजतस्ट्थाजपत दकये जाएँगे। 8. जिजनयम 8 में, ईप-जिजनयम (3) में, ऄंक “6” के जलए, ऄंक “12” प्रजतस्ट्थाजपत दकया जाएगा। 9. जिजनयम 12 में, ईप-जिजनयम (2) छोड़ ददया जाएगा। 10. जिजनयम 13 में, ईप-जिजनयम (3) में िब्द “जिजनयामक सैंडबाक्स से संबंजधत जिर्य” के बाद िब्द “सैंडबाक्स प्रस्ट्तािों के पररणाम के अधार पर ददिाजनदेि” जनजिष्ट दकये जाएँगे। देबािीर् पण्डा, ऄध्यि [जिज्ञापन-III/4/ऄसा./444/2022-23] INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY OF INDIA NOTIFICATION Hyderabad, the 5th December, 2022 Insurance Regulatory and Development Authority of India (Regulatory Sandbox) (Amendment) Regulations, 2022 F. No. IRDAI/Reg/3/182/2022.—In exercise of the powers conferred by clause (zd) of sub-section 2 of section 114A of Insurance Act,1938, section 14(2)(e) and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority, in consultation with the Insurance Advisory Committee, hereby makes the following regulations to amend Insurance Regulatory and Development Authority of India (Regulatory Sandbox) Regulations, 2019: - CHAPTER I 1. Short Title and commencement: 1.1 These Regulations may be called the Insurance Regulatory and Development Authority of India (Regulatory Sandbox) (Amendment) Regulations, 2022. 1.2 These Regulations shall come into force on the date of their publication in the Official Gazette. 2. Objectives: The objectives of these Regulations are to amend the Insurance Regulatory and Development Authority of India (Regulatory Sandbox) Regulations, 2019 to: (i) remove limited validity period of the Regulation (ii) increase the experimental period of the Regulatory Sandbox from existing six (6) months to up to 36 months [भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 (iii) Authorise the Chairperson to issue guidelines, if necessary, based on the outcome of Sandbox proposals. 3. In Regulation 1, sub regulation (3) shall be substituted with “These Regulations shall be reviewed once every three years from the date of publication of the IRDAI (Regulatory Sandbox) (Amendment) Regulations, 2022, unless a review, repeal or amendment is warranted earlier”. 4. In Regulation 5, sub regulation (3) and the explanation shall be omitted. 5. In Regulation 6, in sub regulation (2), for the words and figure “a period of 6 months”, the words and figure “an experiment period of up to 36 months” shall be substituted. 6. In Regulation 6, sub regulation (3) shall be inserted as “If the application is not considered, the applicant may file the review application to the committee as specified by the Authority”. 7. In Regulation 8, in sub regulation (1), for the word and figure “6 months”, the words “experimental period” shall be substituted. 8. In Regulation 8, in sub regulation (3), for the figure “6”, the figure “12” shall be substituted. 9. In Regulation 12, sub regulation (2) shall be omitted. 10. In Regulation 13, in sub regulation (3) the words “guidelines based on the outcome of Sandbox proposals” shall be inserted after the words “issues pertaining to the Regulatory Sandbox,”.
