सा.का.नि. 236(अ).— िायुयान (जनमाचणों और िृक्षों आदि द्वारा उत्पन्न अिरोधों का उन्मूलन) जनयम, 2025 का
प्रारूप, भारतीय िायुयान अजधजनयम, 2024 (2024 का 16) की धारा 34 की अपेक्षानुसार भारत के रािपत्र, असाधारण,
भाग 2, खंड 3, उपखंड (i) में सा.का.जन 396 (अ) तारीख 18 िून, 2025 द्वारा प्रकाजित दकए गए थे, जिसमें उन सभी
व्यजियों से, जिनके इससे प्रभाजित होने की संभािना थी, उि अजधसूचना िाले रािपत्र की प्रजतयां िनता को उपलब्ध कराए
िाने की तारीख से इक्कीस दिन की समाजि के पूिच आपजियां और सुझाि आमंजत्रत दकए गए थे;
और उि रािपत्र की प्रजतयां िनता के जलए 18 िून, 2025 को उपलब्ध करा िी गई थीं;
और उि प्रारूप जनयमों के संबंध में िनता से जिजनर्िचष्ट अिजध के भीतर प्राि आपजियों और सुझािों पर केन्रीय
सरकार द्वारा सम्यक रूप से जिचार दकया गया है;
अतः अब, केन्रीय सरकार भारतीय िायुयान अजधजनयम, 2024 (2024 का 16) की धारा 11 और 18 के साथ
पठित धारा 10 की उपधारा (1) और उपधारा (2) के खंड (यग) द्वारा प्रिि िजियों का प्रयोग करते हुए और िायुयान
(जनमाचण और िृक्षों आदि द्वारा उत्पन्न अिरोधों का उन्मूलन) जनयम, 1994 के अजधक्रमण में, उन बातों के जसिाय िो ऐसे
अजधक्रमण से पूिच की गई हैं या करने का लोप दकया गया है, जनम्नजलजखत जनयम बनाती है, अथाचत्:-
1. संजक्षि नाम और जिस्ट्तार.- (1) इन जनयमों का संजक्षि नाम िायुयान (जनमाचणों और िृक्षों आदि द्वारा उत्पन्न बाधाओं का
उन्मूलन) जनयम, 2026 है।

(2) ये जनयम रािपत्र में इनके प्रकािन की तारीख से प्रिृत होंगे।
2. पठरभाषाएँ.– (1) इन जनयमों में, िब तक दक संिभच से अन्यथा अपेजक्षत न हो, -
(क) “अजधजनयम” से भारतीय िायुयान अजधजनयम, 2024 (2024 का 16) अजभप्रेत है।
(ख) “जनमाचण” से दकसी जिमान क्षेत्र के आस-पास जिजनर्िचष्ट क्षेत्र के भीतर पठरजनर्मचत कोई संरचना अजभप्रेत है, चाहे
िह स्ट्थायी या अस्ट्थायी हो, और इसमें िृक्ष भी िाजमल हैं;
(ग) ''महाजनिेिक'' से अजधजनयम की धारा 3 की उपधारा (1) के अधीन जनयुि महाजनिेिक, नागर जिमानन अथिा
अजधजनयम की धारा 3 की उपधारा (4) के अधीन केंरीय सरकार द्वारा इन संबंध में जिजनर्िचष्ट रूप से सिि दकया
गया कोई अन्य अजधकारी अजभप्रेत है;
(घ) “जिला कलेक्टर” से उपायुि, जिला मजिस्ट्रेट या कोई अन्य पिनाम अजभप्रेत है, जिसका प्रयोग राज्य सरकार
द्वारा जिला प्रिासन के उिरिायी अजधकारी के जलए दकया िाता है;
(ड.) "प्ररूप" से इन जनयमों के साथ संलग्न प्ररूप अजभप्रेत है;
(च) “प्रभारी अजधकारी” से िह अजधकारी अजभप्रेत है िो दकसी भी पिनाम से जिमानक्षेत्र का प्रभारी है;
(छ) "स्ट्िामी" से िह व्यजि अजभप्रेत है जिसका, यथाजस्ट्थजत, जनमाणच या िृक्ष पर जनयंत्रण है;
(ि) "जिजनर्िचष्ट क्षेत्र" से ऐसा क्षेत्र अजभप्रेत है जिसे अजधसूचना में जिजनर्िचष्ट दकया िाए, िो जिमान क्षेत्र संिभच बबंिु
से बीस दकलोमीटर से अजधक न हो।
(2) उन िब्िों और पिों के, िो इन जनयमों में प्रयुि हैं ककंतु पठरभाजषत नहीं हैं और अजधजनयम में पठरभाजषत दकए गए हैं,
के िही अथच होंगे िो उन्हें अजधजनयम में दिए गए हैं।
3. स्ट्िामी को अजधसूचना की तामील और उल्लंघन के बारे में ठरपोटच प्रस्ट्तुत करना.- (1) िहां अजधजनयम की धारा 18 की
उपधारा (1) के अधीन केंरीय सरकार द्वारा कोई अजधसूचना िारी की गई है और प्रभारी अजधकारी के पास यह जिश्वास करने
का कारण है दक स्ट्िामी द्वारा ऐसी अजधसूचना का अनुपालन नहीं दकया िा रहा है, तो िह अजधजनयम की धारा 18 की उप-
धारा (3) में अजधकजथत प्रदक्रया के अनुसार प्ररूप ‘क’ में संलग्न पत्र के साथ अजधसूचना की एक प्रजत स्ट्िामी को तामील
कराएगा।
(2) प्रभारी अजधकारी ऐसे उल्लंघन की ठरपोटच तत्काल महाजनिेिक को भेिेगा।
4. ब्यौरे िमा कराने के जलए आिेि.- (1) िहां, महाजनिेिक को जनयम 3 के उप-जनयम (2) के अधीन कोई ठरपोटच प्राि होती
है, तो िह जलजखत आिेि द्वारा, ऐसे जनमाचण के स्ट्िामी को, आिेि प्राि होने की साि दिनों की अिजध के भीतर जनमाचण की
अिजस्ट्थजत ििाचते हुए मानजचत्र की एक प्रजत, तथा आिेि में जिजनर्िचष्ट आकार या कोई अन्य ब्यौरा प्रभारी अजधकारी को और
एक प्रजत महाजनिेिक को प्रस्ट्तुत करने का जनिेि िे सकेगा:
परंतु महाजनिेिक युजियुि आधार प्राि होने पर उि अिजध को अगले साि दिनों तक बढा सकेंगे।
(2) िहां, उप-जनयम (1) के अधीन कोई आिेि िारी दकया िाता है, तो स्ट्िामी आिेि में यथाजिजनर्िचष्ट सूचना और अन्य
जििरण प्रस्ट्तुत करने के जलए बाध्य होगा।
(3) उप-जनयम (1) के अधीन स्ट्िामी को आिेि की तामील, अजधजनयम की धारा 18 की उप-धारा (3) में अजधकजथत प्रदक्रया
के अनुसार की िाएगी।
(4) यदि स्ट्िामी महाजनिेिक द्वारा िारी आिेि का अनुपालन नहीं करता है तो प्रभारी अजधकारी द्वारा प्रस्ट्तुत ठरपोटच को
अंजतम माना िाएगा।
5. प्रभारी अजधकारी द्वारा भौजतक सत्यापन.- (1) प्रभारी अजधकारी, स्ट्िामी द्वारा दिये गए ब्यौरे प्राि होने पर जनमाचण के
पठरसर के सत्यापन की अनुमजत िेने िाला आिेि िारी करने के जलए महाजनिेिक को आिेिन करेगा, जिससे स्ट्िामी द्वारा
उपलब्ध कराए गए ब्यौरे की सत्यता के बारे में स्ट्ियं को संतुष्ट कर सके।
(2) महाजनिेिक द्वारा उप-जनयम (1) के अधीन िारी आिेि में सत्यापन के प्रयोिन और सत्याजपत दकए िाने िाले पठरसर
के ब्यौरे जिजनर्िचष्ट दकए िाएंगे, और िह उसके िारी दकए िाने की तारीख से पंरह दिन की अिजध तक िैध होगा।

(3) प्रभारी अजधकारी को सत्यापन के प्रयोिन के जलए दिन के समय और स्ट्िामी को पूिच सूचना िेने के साथ जिजनर्िचष्ट पठरसर
में प्रिेि करने के जलए सिि होगा और ऐसा स्ट्िामी सत्यापन के िौरान पूणच सहयोग प्रिान करने के जलए बाध्य होगा।

सत्यापन के पश्चात, प्रभारी अजधकारी ऐसे सत्यापन के आधार पर अपनी ठटप्पजणयों के साथ एक ठरपोटच महाजनिेिक
को भेिेगा:
परंतु दकसी ऐसे मामले में, िहां स्ट्िामी सहयोग करने में असफल रहता है, तो प्रभारी अजधकारी, िो भी सत्यापन
संभि हो, उसके आधार पर अपनी ठटप्पजणयों के साथ अपनी ठरपोटच अग्रेजषत करेगा।
6. उन्मूलन आिेि.- (1) यदि महाजनिेिक, प्रभारी अजधकारी द्वारा उसे अग्रेजषत ब्यौरे की िांच करने के बाि इस बात से
संतुष्ट है दक जनमाचण में अजधजनयम की धारा 18 की उप-धारा (1) के अधीन केंरीय सरकार द्वारा िारी अजधसूचना के उपबंधों
का अनुपालन नहीं दकया गया है, तो िह स्ट्िामी को इस जनमाचण को जगराने या उसकी ऊंचाई को ऐसी ऊंचाई तक कम करने
का जनिेि िेते हुए आिेि पाठरत कर सकेगा, िैसी दक उस अजधसूचना के अनुपालन के जलए अपेजक्षत हो :
परंतु िहां स्ट्िामी, जनयम 4 के अधीन आिेि के प्रत्युिर में ब्यौरा उपलब्ध कराने में असफल हो गया है, तो
महाजनिेिक, प्रभारी अजधकारी द्वारा प्रस्ट्तुत ठरपोटच के आधार पर आिेि पाठरत करने के जलए सिि होगा।
(2) उप-जनयम (1) के अधीन कोई आिेि तब तक पाठरत नहीं दकया िाएगा, िब तक दक स्ट्िामी को सुनिाई का युजियुि
अिसर न दिया गया हो।
(3) उप-जनयम (1) के अधीन पाठरत आिेि, अजधजनयम की धारा 18 की उप-धारा (3) में अजभकजथत प्रदक्रया के अनुसार
स्ट्िामी को तामील दकया िाएगा।
7. आिेि के जिरुद्ध अपील.- (1) यदि कोई व्यजि जनयम 6 के अधीन पाठरत अंजतम आिेि से व्यजथत है, तो िह आिेि की
प्रजत प्राि होने की तारीख से तीस दिन की अिजध के भीतर अपील प्राजधकारी को अपील कर सकेगा और अपील प्राजधकारी
संबंजधत पक्षों को सुनने के पश्चात जलजखत में अजभजलजखत दकए िाने िाले कारणों से अंजतम आिेि की पुजष्ट करेगा या उसे
अस्ट्िीकार करेगा।
(2) अपील प्राजधकारी, अपीलाथी से कोई भी सूचना, अजभलेख या कोई अन्य िस्ट्तािेि मांग सकेगा, यदि उसे सुसंगत समझता
है।
(3) अपीलाथी इन जनयमों के साथ संलग्न प्ररूप ख में यथाउपबंजधत प्रारूप में मामले के तथ्यों और पठरजस्ट्थजतयों के आधार
पर यथापेजक्षत उपांतरणों के साथ सहायक िस्ट्तािेिों तथा महाजनिेिक द्वारा जिजनर्िचष्ट रीजत से एक हज़ार रुपए की फीस के
साथ अपील फाइल कर सकेगा।
(4) अपील आिेि की प्रजत, आिेि के सुनाए िाने के तुरंत पश्चात या यथािीघ्र, ककंतु दकसी भी मामले में सात दिन की अिजध
के भीतर अपीलाथी को उपलब्ध करा िी िाएगी।
8. स्ट्िामी द्वारा आिेि का अनुपालन दकया िाना.- स्ट्िामी को, यथाजस्ट्थजत, जनयम 6 के अधीन पाठरत आिेि या जनयम 7 के
अधीन पुष्ट या उपांतठरत आिेि का अनुपालन ऐसे आिेि की प्राजि के तारीख से साि दिन की अिजध के भीतर करना होगा।
9. हाजन या नुकसान के जलए प्रजतकर.- स्ट्िामी, अजधजनयम की धारा 22 के उपबंधों के अनुसरण में प्रजतकर का िािा कर
सकेगा:
परंतु यह दक कोई भी स्ट्िामी, िो अजधजनयम की धारा 18 के अधीन अजधसूचना के िारी होने की तारीख के पश्चात
अजधसूचना के उल्लंघन में कोई भी जनमाचण करता है, तो िह इस जनयम के अधीन प्रजतकर का िािा करने के जलए पात्र नहीं
होगा।
10. जिला कलेक्टर को अनुपालन नहीं दकए िाने की ठरपोटच करना.- (1) यदि स्ट्िामी, जनयम 8 में यथाजिजनर्िचष्ट रीजत से
आिेि का अनुपालन नहीं करता है, तो प्रभारी अजधकारी, यथाजस्ट्थजत, जनयम 6 के अधीन पाठरत या जनयम 7 के अधीन पुष्ट
या उपांतठरत आिेि की प्रजत के साथ मामले के तथ्यों की ठरपोटच जिला कलेक्टर को संसूजचत करेगा।
(2) प्रभारी अजधकारी से ठरपोटच प्राि होने पर, जिला कलेक्टर, तत्काल जनमाचण को जगराने या उसकी ऊंचाई कम करने की
कारचिाई, िैसी भी जस्ट्थजत हो, उसी प्रकार करेगा, िैसा दक उसके जिले में दकसी अनजधकृत जनमाचण को जगराने के मामले में
दकया िाता है।

MINISTRY OF CIVIL AVIATION
NOTIFICATION
New Delhi, the 31st March, 2026.
G.S.R. 236(E).— WHEREAS the draft Aircraft (Demolition of obstructions caused by Buildings
and Trees etc.) Rules, 2025 were published, as required by section 34 of the Bharatiya Vayuyan Adhiniyam,
2024 (16 of 2024), vide number G.S.R. 396(E.), dated the 18th June, 2025, in the Gazette of India,
Extraordinary, Part II, Section 3, Sub-Section (i), inviting objections and suggestions from all persons likely
to be affected thereby, before the expiry of twenty one days from the date on which copies of the Gazette
containing the said notification were made available to the public;
AND WHEREAS the copies of the said Gazette were made available to the public on the 18th June,
2025;
AND WHEREAS the objections and suggestions received from the public in respect of the said draft
rules within the period specified have been duly considered by the Central Government;
NOW, THEREFORE, in exercise of the powers conferred by sub- section (1) and clause (zc) of sub-
section (2) of section 10 read with sections 11 and 18 of the Bharatiya Vayuyan Adhiniyam, 2024 (16 of
2024) and in supersession of the Aircraft (Demolition of obstructions caused by Buildings and Trees etc.)
Rules, 1994, except as respects things done or omitted to be done, before such supersession, the Central
Government hereby makes the following rules, namely: —
1. Short title and commencement. – (1) These rules may be called the Aircraft (Demolition of Obstructions
caused by Buildings and Trees etc.) Rules, 2026.
(2) These rules shall come into force on the date of their publication in the Official Gazette.
2. Definitions. – (1) In these rules, unless the context otherwise requires, —
(a) “Adhiniyam” means the Bharatiya Vayuyan Adhiniyam, 2024 (16 of 2024);
(b) “building” means any structure, whether permanent or temporary, erected within a specified area
around an aerodrome; and includes trees;
(c) "Director General" means Director General of Civil Aviation appointed under sub-section (1) of
section 3 of the Adhiniyam, or any other officer specifically empowered in this behalf by the Central
Government under sub-section (4) of section 3 of the Adhiniyam;
(d) “District Collector” means the Deputy Commissioner, District Magistrate or any other
designation used by any State Government for the officer who is responsible for the district
administration;
(e) “Form” means a form appended to these rules;
(f) “officer-in-charge” means the officer holding charge of the aerodrome by whatever designation
known;
(g) “owner” means the person having the control of the building or tree, as the case may be;
(h) “specified area” means an area as may be specified in the notification not exceeding twenty
kilometres from the aerodrome reference point.

(2) Words and expressions used but not defined in these rules, and defined in the Adhiniyam, shall have the
same meaning as assigned to them in the Adhiniyam.
3. Service of Notification on the owner and submission of report regarding violation. — (1) Where any
notification has been issued by the Central Government under sub-section (1) of section 18 of the Adhiniyam
and the officer-in-charge has reason to believe that the owner is not complying with such notification, he
shall serve a copy of the notification, along with a letter in Form A upon the owner, in accordance with the
procedure laid down in sub-section (3) of section 18 of the Adhiniyam.
(2) The officer-in-charge, shall forthwith send a report of such violation to the Director General.
4. Order to furnish details. — (1) Where a report under sub-rule (2) of rule 3 is received by the Director
General, he may, by an order in writing, direct the owner to furnish a copy of plan showing the location of
building, and also disclose the dimensions, or any other details specified in the order, to the officer-in-charge,
and a copy to the Director General, within a period not exceeding sixty days from receipt of the order:
Provided that the Director General may extend the said period by sixty days, on receipt of reasonable
grounds to do so.
(2) Where an order is issued under sub-rule (1), the owner shall be bound to furnish the information, and such
details, as specified in the order.
(3) An order under sub-rule (1) shall be served upon the owner in accordance with the procedure laid down
in sub-section (3) of section 18 of the Adhiniyam.
(4) If the owner does not comply with the order issued by the Director General, the report submitted by the
officer-in-charge shall be considered final.
5. Physical verification by officer-in-charge. — (1) The officer-in-charge shall, upon receipt of details
furnished by the owner, apply to the Director General to issue an order allowing verification of the premises
of the building, in order to satisfy himself about the correctness of the details provided by the owner.
(2) The order issued by the Director General under sub-rule (1) shall specify the purpose and details of the
premises to be verified, and shall be valid up to a period of fifteen days from the date of its issuance.
(3) The officer-in-charge shall be empowered, for the purposes of verification, to enter the specified premises
during day light hours, and with prior notice to the owner, and such owner shall be bound to extend full
cooperation during the verification.
(4) After the verification, the officer-in-charge shall send a report to the Director General containing his
comments based on such verification:
Provided that in a case where the owner fails to cooperate, the officer-in-charge shall forward his
report with his comments based on whatever verification is possible.
6. Order for demolition. — (1) If the Director General, on examination of the details forwarded to him by
the officer-in-charge, is satisfied that the building does not comply with the provisions of notification issued
by the Central Government under sub-section (1) of section 18 of the Adhiniyam, he may pass an order
directing the owner to demolish or reduce the height of the building to such height, as it may be required for
compliance with that notification:
Provided that where the owner has failed to furnish details in response to the order under rule 4, the
Director General shall be empowered to pass an order based on the report submitted by the officer-in-charge.
(2) No order shall be passed under sub-rule (1), unless the owner has been given a reasonable opportunity of
being heard.

(3) An order passed under sub-rule (1) shall be served upon the owner in accordance with the procedure laid
down in sub-section (3) of section 18 of the Adhiniyam.
7. Appeal against the order. — (1) If any person is aggrieved by the final order passed under rule 6, he may
prefer an appeal to the appellate authority within a period of thirty days from the date of receipt of copy of
the order and the appellate authority shall after hearing the concerned parties, either confirm or reject the
final order for the reasons to be recorded in writing.
(2) The appellate authority may call for any information, record or any other document from the appellant, if
the same is considered relevant.
(3) The appellant may file the appeal in the format as provided in Form B, as appended to these rules, with
such modifications as may be required depending upon the facts and circumstances of a case along with
supporting documents and fee of rupees one thousand in the manner specified by the Director General.
(4) The copy of the appellate order shall be provided to the appellant immediately after the pronouncement
of the order or at the earliest possible but not later than seven days in any case.
8. Owner to comply with order. — The owner shall comply with the order passed under rule 6 or confirmed
or modified under rule 7, as the case may be, within a period of sixty days from the date of receipt of such
order.
9. Compensation for loss or damage. — The owner may claim compensation in accordance with the
provisions of section 22 of the Adhiniyam:
Provided that any owner who, after the date of receipt of a notification under section 18 of the
Adhiniyam, erects any building in contravention of the notification, shall not be eligible to claim
compensation under this rule.
10. Non-compliance to be reported to the District Collector. — (1) If the owner does not comply with an
order in the manner as specified in rule 8, the officer-in-charge shall report the matter to the District Collector,
providing a report of the facts of the case along with a copy of the order passed under rule 6 or as confirmed
or modified under rule 7, as the case may be.
(2) On receipt of the report from the officer-in-charge, the District Collector shall forthwith carry out the
demolition or reduction in height of the building, as the case may be, in the same manner as followed in case
of demolition of any unauthorised construction in his district.

Sir/Madam,
The Central Government in exercise of the power conferred under section 18 of the Bharatiya
Vayuyan Adhiniyam, 2024, (16 of 2024) had notified the provisions vide G.S.R. … (E) dated …….. namely,
the ……………………………... (hereinafter referred to as the said rules), inter alia, set forth the rules for
governing and restricting the height of buildings / structures / trees situated on any land within a radius of
twenty (20) kilometers from the Aerodrome Reference Point of a civil / defence aerodrome. The copy of the
same is enclosed for reference.

Now, therefore, in accordance with rule 3 of the said rules, the undersigned hereby informs that
following building/ tree/ structure is identified an obstruction in obstacle survey report dated…. and
infringing the (type of surface) of (name of aerodrome): —
