सा.का.जन. 447(अ).— िबदक गैस जसलेंडर जनयम, 2016 के मसौिे को, जवस्ट्फोटक अजधजनयम, 1884 (1884 का 4) की धारा 18 की उप-धारा (1) के अधीन अपेजित रूप से, भारत सरकार, वाजणज्य और उद्योग मंत्रालय, (उद्योग संवधधन और आंतररक व्यापार जवभाग) की अजधसूचना संख्या सा.का.जन.146 (अ) तारीख 24 फरवरी, 2026 द्वारा भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उप-खंड (i), तारीख 25 फरवरी, 2026 में प्रकाजित दकया गया था, तथा उससे प्रभाजवत होने की संभावना रखने वाले सभी व्यजियों से, उि अजधसूचना वाले रािपत्र की प्रजतयां िनता को उपलब्ध कराए िाने की तारीख से, तीस दिन की अवजध की समाजि से पूवध आिेप अथवा सुझाव आमंजत्रत दकए गए थे;

और िबदक, उि रािपत्र अजधसूचना की प्रजतयां 25 फरवरी, 2026 को िनता के जलए उपलब्ध करा िी गई थी;

और िबदक, उि मसौिा जनयमों के संबंध में प्राि आिेपों और सुझावों पर केंद्रीय सरकार द्वारा सम्यक जवचार कर जलया गया है;

अत:, अब, जवस्ट्फोटक अजधजनयम, 1884 (1884 का 4) की धारा 5 और 7 द्वारा प्रित्त िजियों का प्रयोग करते हुए, केंद्रीय सरकार गैस जसलेंडर जनयम, 2016 में संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, अथाधत्: -

1. संजिि नाम और प्रारम्भ- (1) इन जनयमों का संजिि नाम गैस जसलेंडर (िूसरा संिोधन) जनयम, 2026 है। (2) ये रािपत्र में इनके प्रकािन की तारीख को प्रवृत्त होंगे।
2. गैस जसलेंडर जनयम, 2016 (जिसे इसके पश्चात उि जनयम कहा गया है) में जनयम 48 का जवलोप दकया िाएगा;
3. उि जनयमों के प्ररूप-ग में, “प्ररूप 'ङ', अथवा 'ङ' और 'घ' अथवा 'च' अथवा 'छ' अथवा 'ि' में अनुज्ञजि हेतु इस आवेिन के साथ िमा दकए िाने वाले िस्ट्तावेि” िीर्धक के अधीन मि (vi) का लोप दकया िाएगा;
4. उि जनयमों के, प्ररूप-च में, ितध 8 के बाि, जनम्नजलजखत ितध अंतःस्ट्थाजपत की िाएगी, अथाधत्:-

"8क. औद्योजगक गैस जसलेंडरों के जलए, अनुज्ञापन प्राजधकारी द्वारा उच्च िमावट (स्ट्टैककंग) और कम गजलयारा स्ट्थान (गैंगवे) की अनुमजत िी िा सकेगी, यदि जसलेंडरों को प्रमाजणत संरजचत पैकेजिंग (रैक, जपंिरे) में पयाधि परियों, जललपों अथवा इंटरलॉक के साथ पैक दकया गया हो, जिसमें जसलेंडर, उसके दफटटंगों और जसलेंडरों के समुजचत संचालन की अखंडता सुजनजश्चत हो तथा ऐसी प्रमाजणत संरजचत पैकेजिंग तथा लिान और उतार की प्रदक्रया राष्ट्रीय अथवा अंतराधष्ट्रीय संजहताओं के अनुरूप हो। [फा. सं. पी-13033/32/2021-जवस्ट्फोटक-भाग(1)] डॉ. कािल, संयुि सजचव रटप्पण: मूल जनयम अजधसूचना संख्या 1081 (अ) तारीख 22 नवंबर, 2016 द्वारा प्रकाजित दकए गए थे और तत्पश्चात उनमें जनम्नजलजखत संिोधन दकए गए: - (1) सा.का.जन. 189(अ), तारीख 27 फरवरी, 2018 (2) सा.का.जन. 231(अ), तारीख 15 माचध, 2018; (3) सा.का.जन. 44(अ), तारीख 23 िनवरी, 2019; (4) सा.का.जन. 44(अ), तारीख 20 िनवरी, 2022; (5) सा.का.जन. 225(अ), तारीख 11 अप्रैल, 2025; (6) सा.का.जन. 386(अ), तारीख 09 िून, 2025; (7) सा.का.जन. 501(अ), तारीख 28 िुलाई, 2025; (8) सा.का.जन. 839(अ), तारीख 12 नवंबर, 2025; और (9) सा.का.जन. 315(अ), तारीख 27 अप्रैल, 2026।

MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 5th June, 2026

G.S.R. 447(E).— Whereas the draft of the Gas Cylinders Rules, 2016 were published, as required under sub- section (1) of section 18 of the Explosives Act, 1884 (4 of 1884), vide notification of the Government of India in the Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade), number G.S.R. 146(E), dated 24th February, 2026 in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) dated the 25thFebruary, 2026, inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette containing the said notification was made available to the public; And whereas, the copies of the Gazette said notification were made available to the public on the 25thFebruary, 2026; And whereas, objections and suggestions received in respect of the said draft rules, have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 5 and 7 of the Explosives Act, 1884 (4 of 1884), the Central Government hereby makes the following rules further to amend the Gas Cylinders Rules, 2016, namely:-

1. Short title and commencement.—(1) These rules may be called the Gas Cylinders (Second Amendment) Rules,

2. (2) They shall come into force on the date of their publication in the Official Gazette.

3. In the Gas Cylinders Rules, 2016 (hereinafter referred to as the said rules), rule 48 shall be omitted.

4. In the said rules, in FORM C, under the heading “DOCUMENTS REQUIRED TO BE SUBMITTED WITH THIS APPLICATION FOR A LICENCE IN FORM E, or E and D or F or G or H”, item (vi) shall be omitted.

5. In the said rules, in FORM F, after condition 8, the following condition shall be inserted, namely:- “8A. For industrial gas cylinders, higher stacking and lesser gangway may be permitted by the licensing authority, if cylinders are packed in certified structured packaging (racks, cages) with adequate straps, clips or interlocks to ensure the integrity of the cylinder, its fittings and proper maneuvering of cylinders are ensured with these certified structured packaging and loading and unloading procedure shall comply with the national or international codes.”.
