सा.का.जन. 364(अ).— मोटर यान अजधजनयम, 1988 की धारा 212 की उपधारा (1) की अपेक्षानुसार केन्द्रीय मोटर यान जनयम, 1989 का संिोधन करने के जलए कजतपय जनयमों का प्रारूप, भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) तारीख 30 िनवरी, 2026 में भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना सं. सा.का.जन. 100(अ) तारीख 30 िनवरी, 2026 द्वारा प्रकाजित दकए गए थे, जिनमें उस तारीख से, जिसको उक्त अजधसूचना को अंतर्वगष्ट करने वाली रािपत्र की प्रजतयां िनसाधारण को उपलब्ध कराई गई थी, तीस दिन की अवजध की समाजि के पूवग प्रभाजवत होने वाले सभी व्यजक्तयों से आक्षेप और सुझाव आमंजत्रत दकए गए थे ;

और उक्त रािपत्र अजधसूचना की प्रजतयां िनसाधारण को 30 िनवरी, 2026 को उपलब्ध करा िी गई थी ;

और उक्त प्रारूप जनयमों के संबंध में िनसाधारण से प्राि आक्षेपों और सुझावों पर केंरीय सरकार द्वारा जवचार कर जलया गया है ;

अतः अब केन्द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, केन्द्रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, अथागत् :-- सं. 330] नई दिल्ली, बृहस्ट् पजतवार, मई 14, 2026/वैिाख 24, 1948

1. संजक्षि नाम और प्रारंभ -- (1) इन जनयमों का संजक्षि नाम केन्द्रीय मोटर यान (सातवााँ संिोधन) जनयम, 2026 है । (2) ये जनयम रािपत्र में उनके प्रकािन की तारीख से प्रवृत्त होंगे ।
2. केन्द्रीय मोटर यान जनयम, 1989 के जनयम 93 के उपजनयम (1) के खंड (क) में ; (क) उपखंड (VI), उपिीर्गक “मोटर यान प्रवगग एन” के अधीन, छठवें परंतुक के पश्चात् जनम्नजलजखत परंतुक अंत:स्ट्थाजपत दकया िाएगा, अथागत् :-- "पंरतु यह भी दक घरेलू वस्ट्तुओं या फोटोवोजल्टक सौर पैनलों या मॉड्यूलों के पररवहन में संलग्न श्रेणी एन 2 या एन 3 के मोटर यान के मामले में, जिन्द्हें कई परतों में लोड बॉडी पर पैक और स्ट्टैक दकया िाता है, मोटर यान की कुल ऊंचाई 4.50 मीटर से अजधक नहीं होगी।"; (ख) उपखंड (VII), उपिीर्गक “रेलर प्रवगग टी” के अधीन, चौथे परंतुक के पश्चात् जनम्नजलजखत परंतुक अंत:स्ट्थाजपत दकया िाएगा, अथागत् :-- "परंतु यह भी दक घरेलू वस्ट्तुओं या फोटोवोजल्टक सौर पैनलों या मॉड्यूलों के पररवहन में संलग्न रक रेलर या रैक्टर रेलर या सेमी-रेलर के मामले में, जिन्द्हें लोड बॉडी पर कई परतों में पैक और स्ट्टैक दकया िाता है, मोटर यान की कुल ऊंचाई 4.50 मीटर से अजधक नहीं होगी।"।

MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 13th May, 2026

G.S.R. 364(E).— Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways, number G.S.R 100 (E), dated the 30th January, 2026 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated the 30th January, 2026, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas copies of the said Gazette notification were made available to the public on 30th January, 2026; And whereas the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:-

1. Short title and commencement. — (1) These rules may be called the Central Motor Vehicles (Seventh Amendment) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989, in rule 93, in sub-rule (1), in clause (A); (a) in sub-clause (VI), under the sub-heading "Motor vehicle Category N", after the sixth proviso, the following proviso shall be inserted, namely:- “Provided also that in case of a motor vehicle of category N2 or N3 engaged in transportation of white goods or photovoltaic solar panels or modules packaged and stacked on the load body in multiple layers, the overall height of the motor vehicle shall not exceed 4.50 meters.”; (b) in sub-clause (VII), under the sub-heading "Trailers Category T" after the fourth proviso, the following proviso shall be inserted, namely: - “Provided also that in case of a truck trailer or tractor trailer or Semi-trailer engaged in transportation of white goods or photovoltaic solar panels or modules packaged and stacked on the load body in multiple layers, the overall height of the motor vehicle shall not exceed 4.50 meters.”.
