वाजणज् य और उद्योग मंत्रालय (उद्योग संवधधन और आंतररक व् यापार जवभाग) अजधसूचना नई दिल्ली, 8 िून, 2026 सा.का.जन. 454 (अ).-जवस्ट् फोटक अजधजनयम,1884 (1884 का 4) की धारा 5 तथा 7 द्वारा प्रित्त िजियों का प्रयोग करते हुए अमोजनयम नाइरेट जनयम, 2012 में संिोधन करने हेतु केन्द्र सरकार द्वारा प्रस्ट्ताजवत जनम् नजलजखत जनयमों का प्रारूप, उक् त अजधजनयम की धारा 18 की उप-धारा (1) के प्रावधानों के अनुसार, एतिद्वारा उन सभी व्यजियों की सूचना के जलए प्रकाजित दकया िाता है जिनके इन जनयमों से प्रभाजवत होने की संभावना है और यह नोरटस दिया िाता है दक जनयमों के उक् त प्रारूप पर, उस तारीख से जिसको इस अजधसूचना वाले रािपत्र की प्रजतयां िनता को उपलब् ध करा िी िाती हैं, तीस (30) दिनों के पश् चात जवचार दकया िाएगा; इन प्रारूप जनयमों के बारे में, यदि कोई आपजत्तयां या सुझाव हों तो, उप सजचव (जवस्ट् फोटक), उद्योग संवधधन और आंतररक व् यापार जवभाग, वाजणज् य और उद्योग मंत्रालय, कमरा न. 145, वाजणज्य भवन, नई दिल् ली– 110001 को या ईमेल: expl-dipp@nic.in द्वारा ऊपर उजल्लजखत अवजध के भीतर भेिे िा सकते हैं; उक् त प्रारूप जनयमों के बारे में, उपयुधक् त जवजनर्िधष् ट अवजध के भीतर दकसी व् यजि से प्राप् त आपजत्तयों या सुझावों पर केन्द्र सरकार द्वारा जवचार दकया िाएगा।

1. संजिप्त नाम और प्रारंभ- (1) इन जनयमों को अमोजनयम नाइरेट (संिोधन) जनयम, 2026 कहा िाएगा। (2) ये रािपत्र में इनके अंजतम रूप से प्रकािन की तारीख से प्रवृत् त होंगे।
2. मूल जनयमों में, जनयम 12 में, उप-जनयम (1-क) के बाि, जनम्नजलजखत उप-जनयम अंतधजवष्ट दकए िाएंगे, अथाधत्: - “(1-ख) लाइसेंसधारी अमोजनयम नाइरेट स्ट्टोर हाउस की जनगरानी के जलए सीसीटीवी स्ट्थाजपत करेगा और सीसीटीवी जनगरानी सुरिा उद्देश्य के जलए जिला पुजलस अजधकाररयों को सुरजित जडजिटल पहुंच प्रिान करेगा। सीसीटीवी ररकॉडध को कम से कम तीन महीने की अवजध के जलए रखा िाएगा। स्ट्टोर हाउस के प्रवेि द्वार की जनगरानी के जलए प्रमुख स्ट्थानों पर स्ट्टोर हाउस के बाहर सीसीटीवी कैमरा और उसके केबल लगाए िाएंगे।”
3. मूल जनयमों में, जनयम 37 के बाि, जनम्नजलजखत जनयम अंतधजवष्ट दकए िाएंगे, अथाधत्:- “37-क. लाइसेंसधारक (फमध या कंपनी या एसोजसएिन या सोसाइटी) के नाम में पररवतधन के कारण लाइसेंस में संिोधन- (1) िहां कहीं भी, लाइसेंसधारक का नाम िैसे फमध या कंपनी या एसोजसएिन या सोसायटी में पररवतधन करने का प्रस्ट्ताव है, लाइसेंसधारक नए नाम के पि में लाइसेंस के संिोधन के जलए लाइसेंससंग प्राजधकारी के समि जनम्नजलजखत िस्ट्तावेिों के साथ आवेिन प्रस्ट्तुत करेगा- (क) लाइसेंस प्रिान करने के जलए उपयुि प्रपत्र में आवेिन; (ख) नाम के पररवतधन के संबंध में सहायक िस्ट्तावेिों के साथ िस्ट्तावेिी साक्ष्य; (ग) लाइसेंसधारी के नए नाम पर सभी अनुमोदित आहरणों की प्रजतयां; (घ) लाइसेंसधारी के नाम में पररवतधन के जलए जिला मजिस्ट्रेट से अनापजत्त प्रमाण पत्र; (ङ) अपेजित िांच िुल्क और संिोधन िुल्क।”
4. मूल जनयमों में, जनयम 38 के बाि, जनम्नजलजखत जनयम अंतधजवष्ट दकए िाएंगे, अथाधत्: - "38-क. लाइसेंस का हस्ट्तांतरण-(1) इन जनयमों के अधीन प्रिान दकए गए लाइसेंस को, लाइसेंस प्रिान करने के जलए अजधकार प्राप्त प्राजधकारी द्वारा हस्ट्तांतररत दकया िा सकेगा। (2) एक आवेिक िो लाइसेंस को अपने पि में हस्ट्तांतररत करना चाहता है, वह लाइसेंससंग प्राजधकारी के समि जनम्नजलजखत िस्ट्तावेि प्रस्ट्तुत करेगा- (क) लाइसेंस प्रिान करने के जलए उपयुि प्रपत्र में आवेिन; (ख) आवेिक या उसके अजधकृत व्यजि के नमूना हस्ट्तािर; (ग) आवेिक के पि में लाइसेंस के हस्ट्तांतरण का अनुरोध करते हुए प्राजकृत व्यजि द्वारा हस्ट्तािररत मौिूिा लाइसेंसधारी से एक पत्र या लाइसेंसधारी के अकेला व्यजि होने की ििा में उसकी मृत्यु के मामले में सिम न्द्यायालय से उत्तराजधकार प्रमाण पत्र; (घ) मौिूिा लाइसेंसधारक को िारी दकया गया मूल लाइसेंस; (ङ) आवेिक के पि में पररसर के अजधकारों के हस्ट्तांतरण के संबंध में सहायक िस्ट्तावेिों की प्रजतयां; (च) लाइसेंस में संिोधन के जलए यथा लागू अपेजित िांच िुल्क; (छ) आवेिक के नाम पर सभी अनुमोदित आहरणों की प्रजतयां; (ि) आवेिक की जस्ट्थजत चाहे व्यजिगत, माजलकाना फमध, साझेिारी फमध, कंपनी, एसोजसएिन या सोसायटी या अन्द्यथा हो- नाम, माजलक या भागीिारों या जनिेिकों या सिस्ट्यों, िैसा भी मामला हो के पते के साथ िस्ट्तावेिी साक्ष्य और अजधभोगी की तस्ट्वीरें, प्रस्ट्तुत की िानी अपेजित हैं; (i) आवेिक के पि में लाइसेंस के हस्ट्तांतरण के जलए जिला मजिस्ट्रेट से अनापजत्त प्रमाण पत्र: बिते दक अनापजत्त प्रमाण पत्र आवश्यक नहीं होगा यदि आवेिक के पास ऐसा लाइसेंस है जिसके जलए अनापजत्त प्रमाण पत्र पहले ही प्रिान दकया िा चुका है।”
5. मूल जनयमों के, जनयम 50 की, ताजलका में, पंजि क्रम संख्या 5 के बाि, जनम्नजलजखत पंजि अंतधजवष्ट की िाएगी, अथाधत्:-

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 6 आयुि/उपायुि/सहायक आयुि वस्ट्तु एवं सेवा कर उनके संबंजधत अजधकार िेत्र 6. मूल जनयमों की, अनुसूची I में, ताजलका के क्रम संख्या 3 में, पंजि (ग) में अंजतम पंजि से "या" और पंजि (घ) को हटा दिया िाएगा। 7. मूल जनयमों की, अनुसूची II में, (क) भाग-1 में, प्रपत्र संख्या क-3 के समि ताजलका में, मि “(घ) स्ट्टोर हाउस से कृजष प्रयोिन के जलए 3 मीररक टन से अनजधक अमोजनयम नाइरेट के उपयोग हेतु उसे रखने का लाइसेंस” को हटा दिया िाएगा। (ख) प्रपत्र क-3 के, पैरा-1 में, मि “(घ) स्ट्टोर हाउस से कृजष प्रयोिन के जलए 3 मीररक टन से अनजधक अमोजनयम नाइरेट के उपयोग हेतु उसे रखने का लाइसेंस” को हटा दिया िाएगा। (ग) भाग-2 के, लाइसेंस प्रपत्र त-3 में, प्रस्ट्तावना में, मि: “(घ) स्ट्टोर हाउस से कृजष प्रयोिन के जलए 3 मीररक टन से अनजधक अमोजनयम नाइरेट के उपयोग हेतु उसे रखने का लाइसेंस” को हटा दिया िाएगा। (घ) भाग-3 में, प्रपत्र ि-5 में, “स्ट्टीवडोर द्वारा अनुरजित” िब्िों के बाि, िब्ि "या आयातक/जनयाधतक" अंतधजवष्ट दकए िाएंगे। [फा. सं. पी-13033/63/2026-जवस्ट्फोटक] डॉ. कािल, संयुि सजचव नोट- मूल जनयमों को भारत के रािपत्र, असाधारण अजधसूचना संख्या सा.का.जन 553 (अ), दिनांक 11 िुलाई, 2012 के माध्यम से प्रकाजित दकया गया था और बाि में अजधसूचना संख्या सा.का.जन 469 (अ), दिनांक 9 िुलाई 2013, सा.का.जन 938 (अ), दिनांक 27 जसतंबर, 2018, सा.का.जन 608 (अ), दिनांक 31 अगस्ट्त, 2021, सा.का.जन 239 (अ) दिनांक 17 अप्रैल और सा.का.जन 377(अ) दिनांक 9 िून, 2025 के माध्यम से संिोजधत दकया गया था।

MINISTRY OF COMMERCE AND INDUSTRY (Department For Promotion Of Industry And Internal Trade) NOTIFICATION New Delhi, the 8th June, 2026 G.S.R. 454(E).—The draft of the following rules to amend the Ammonium Nitrate Rules, 2012, which the Central Government proposes to make in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884) is hereby published as required by sub-section (1) of section 18 of the said Act for information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty (30) days from the date on which the copies of the Gazette of India containing this notification are made available to the public; Objections or suggestions if any, to these draft rules may be sent to the Deputy Secretary (Explosives), Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Room No. 145, Vanijya Bhawan, New Delhi –110001 or Email: expl-dipp@nic.in; within the period specified above; The objections or suggestions which may be received from any person with respect to the said draft rules within the period above so specified will be taken into consideration by the Central Government. Draft Rules

1. Short title and commencement,- (1) These rules may be called the Ammonium Nitrate (Amendment) Rules, 2026. (2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the principal rules, in rule 12, after the sub-rule (1-a), the following sub-rule shall be inserted, namely:- “(1-b) The licensee shall install CCTV for monitoring of the Ammonium Nitrate store house and shall provide secured digital access to the District Police Authorities for CCTV monitoring security purpose. The CCTV records shall be

The CCTV camera and its cables shall be placed outside the store house at prominent locations for surveillance of store house access door.” 3. In the principal rules, after the rule 37, the following rule shall be inserted, namely:- 37-a. Amendment of licence due to change of name of the licensee (firm or company or association or society).—(1) Wherever, name of the licensee such as firm or company or association or society is proposed to be changed, the licensee shall submit application to the licensing authority for amendment of licence in favour of the new name along with— (a) application in the form as appropriate for grant of licence; (b) documentary evidence with supporting documents in respect of the change of the name; (c) copies of all approved drawings in the new name of the licensee; (d) no objection certificate from the District Magistrate for change in the name of the licensee; (e) requisite scrutiny fee and amendment fee.” 4. In the principal rules, after the rule 38, the following rule shall be inserted, namely:- “38-a. Transfer of licence.—(1) A licence granted under these rules may be transferred by the authority empowered to grant the licence. (2) An applicant who desires to get the licence transferred in his favour shall submit to the licensing authority— (a) an application in form appropriate for grant of the licence; (b) specimen signature of the applicant or his authorised person; (c) a letter from the existing licensee signed by the authorised person requesting the transfer of licence in favour of the applicant or a succession certificate from a competent court in case of death of a licensee being an individual; (d) original licence issued to the existing licensee; (e) copies of supporting documents regarding transfer of rights of the premises in favour of the applicant; (f) requisite scrutiny fee as applicable for amendment of licence; (g) copies of all approved drawings in the name of the applicant; (h) status of the applicant whether individual, proprietary firm, partnership firm, company, association or society or otherwise— documentary evidence along with names, addresses of the proprietor or partners or directors or members as the case may be, and photographs of the occupier, to be submitted; (i) a no objection certificate from the District Magistrate for transfer of the licence in favour of the applicant: Provided that no objection certificate shall not be necessary if the applicant holds a licence for which a no objection certificate has already been granted.” 5. In the principal rules, in rule 50, in the table, after row sl no.5, the following row shall be inserted, namely:- 6 Commissioner/ Deputy Commissioner/ Assistant Commissioner of Goods and Service Taxes Their respective jurisdiction

6. In the principal rules, in SCHEDULE I, in the serial number 3 of the table, in the row (c) "or" in the last line and row (d) shall be deleted.

In the principal rules, in SCHEDULE II, (a) in PART –1, in the table against Form No A-3, the item “(d) Licence to possess for use of Ammonium Nitrate for agriculture purpose from a store house not exceeding 3 MT.” shall be deleted. (b) in FORM A-3, in para-1, the item “(d) Licence to possess for use of Ammonium Nitrate for agriculture purpose from a store house not exceeding 3 MT.” shall be deleted. (c)in PART-2, in LICENCE FORM P-3, in the preamble, the item: (d)LICENCE TO POSSESS FOR USE OF AMMONIUM NITRATE FOR AGRICULTURE PURPOSE FROM A STORE HOUSE NOT EXCEEDING 3MT “shall be deleted. (d) in PART-3, in FORM R-5, after the words, “maintained by a Stevedore”, the words, “or importer/exporter“ shall be inserted. [F. No. P-13033/63/2026-EXPLOSIVE] DR. KAJAL, Jt. Secy.
