सा.का.नि. 954(अ).— औषध नियम, 1945 में और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप, जिसे केंद्र सरकार, औषध और प्रसाधन सामग्री अधिनियम, 1940 (1940 का 23) की धारा 12 की उप-धारा (1) और धारा 33 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती है, औषध तकनीकी सलाहकार बोर्ड के परामर्श के पश्चात इससे प्रभावित होने की संभावना वाले सभी व्यक्तियों की जानकारी के लिए एतद्द्वारा प्रकाशित किया जाता है, और एतद्द्वारा नोटिस दिया जाता है कि उक्त प्रारूप नियमों पर उस तारीख से, जिसको इन प्रारूप नियमों वाले भारत के राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं, तीस दिन की अवधि की समाप्ति पर या उसके पश्चात विचार किया जाएगा।

उपर्युक्त निर्दिष्ट अवधि के भीतर किसी भी व्यक्ति से प्राप्त होने वाली आपत्तियों और सुझावों पर केंद्र सरकार द्वारा विचार किया जाएगा।

आपत्तियां और सुझाव, यदि कोई हों, तो उन्हें अवर सचिव (औषध विनियमन), स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार, सी विंग, प्रथम तल, कर्तव्य भवन 1, नई दिल्ली - 110001 को संबोधित किया जा सकता है या drugsdiv-mohfw@gov.in पर ईमेल किया जा सकता है।

प्रारूप नियम

1. • (i) इन नियमों को औषध (...... संशोधन) नियम, 2026 कहा जा सकता है।

• (ii) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख से प्रवृत्त होंगे।

2. औषध नियम, 1945 में, नियम 43क में –

• (i) "इनलैंड कंटेनर डिपो धन्नद और तिही, इंदौर, मध्य प्रदेश" शब्दों के स्थान पर, "इनलैंड कंटेनर डिपो धन्नद और तिही, इंदौर, मध्य प्रदेश और इनलैंड कंटेनर डिपो सोनीपत, पियाला और हरसारू, हरियाणा और इनलैंड कंटेनर डिपो दादरी, उत्तर प्रदेश और इनलैंड कंटेनर डिपो गांधीधाम / मुंद्रा, गुजरात और इनलैंड कंटेनर डिपो सनथ नगर और थिम्मापुर, हैदराबाद और इनलैंड कंटेनर डिपो व्हाइटफील्ड, बेंगलुरु और विशेष आर्थिक क्षेत्र बोम्मासन्द्रा, कर्नाटक" शब्द प्रतिस्थापित किए जाएंगे।
• (ii) "कोचीन, तिरुवनंतपुरम और नवी मुंबई" शब्दों के स्थान पर, "कोचीन, तिरुवनंतपुरम, नवी मुंबई और नोएडा इंटरनेशनल एयरपोर्ट, उत्तर प्रदेश" शब्द प्रतिस्थापित किए जाएंगे।

NOTIFICATION

New Delhi, the 28th October, 2026

G.S.R. 954(E).— The following draft of certain rules further to amend the Drugs Rules, 1945, which the Central Government proposes to make, in exercise of the powers conferred by sub-section (1) of section 12 and sub-section (1) of section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940), is hereby published after consultation with the Drugs Technical Advisory Board for information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration on or after the expiry of a period of thirty days from the date on which the copies of the Gazette of India containing these draft rules are made available to the public.

Objections and suggestions which may be received from any person within the period specified above will be considered by the Central Government.

Objections and suggestions, if any, may be addressed to the Under Secretary (Drugs Regulation), Ministry of Health and Family Welfare, Government of India, C Wing, First Floor, Kartavya Bhavan 1, New Delhi - 110001 or emailed at drugsdiv-mohfw@gov.in.

DRAFT RULES

1. • (i) These rules may be called the Drugs (...... Amendment) Rules, 2026.

• (ii) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Drugs Rules, 1945, in Rule 43A ─

• i. for the words “Inland Container Depot Dhannad and Tihi, Indore in Madhya Pradesh”, the words “Inland Container Depot Dhannad and Tihi, Indore in Madhya Pradesh and Inland Container Depot Sonipat, Piyala and Harsaru in Haryana and Inland Container Depot Dadri in Uttar Pradesh and Inland Container Depot Gandhidham / Mundra in Gujarat and Inland Container Depot Sanath Nagar and Thimmapur in Hyderabad and Inland Container Depot Whitefield in Bengaluru and Special Economic Zone Bommasandra in Karnataka” shall be substituted.
• ii. for the words “Cochin, Thiruvananthapuram and Navi Mumbai”, the words “Cochin, Thiruvananthapuram, Navi Mumbai and Noida International Airport in Uttar Pradesh” shall be substituted.
