The Ministry of Housing and Urban Affairs has amended the Daman and Diu Real Estate (Regulation and Development) (General) Rules, 2016. This amendment follows the changes made to section 68 of the Real Estate (Regulation and Development) Act, 2016, by the Jan Vishwas (Amendment of Provisions) Act, 2026. Specifically, the amendment removes the entry in the table under rule 33(1) that prescribed a penalty of ten percent of the estimated cost of the plot, apartment, or building for offenses punishable with imprisonment under section 68 of the Act. These rules are effective from the date of their publication in the Official Gazette.

सा.का.नि. 557(अ).— केन्द्रीय सरकार, भू-संपदा (विनियमन और विकास) अधिनियम, 2016 (2016 का 16) की धारा 2 के खंड (छ) के उप-खंड (i) के साथ पठित धारा 84 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा जन विश्वास (उपबंधों का संशोधन) अधिनियम, 2026 (2026 का 8) की अनुसूची क्रम संख्या 70 के साथ पठित धारा 2 के तहत उक्त अधिनियम की धारा 68 में किए गए संशोधनों के अनुसरण में, दमन एवं दीव भू-संपदा (विनियमन और विकास) (सामान्य) नियम, 2016 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:—

MINISTRY OF HOUSING AND URBAN AFFAIRS NOTIFICATION New Delhi, the 1st July, 2026
G.S.R. 557(E).— In exercise of the powers conferred by section 84 read with sub-clause (i) of clause (g) of section 2 of the Real Estate (Regulation and Development) Act, 2016 (16 of 2016) and in pursuance of the amendment made to section 68 of the said Act under section 2 read with serial number 70 of the Schedule to the Jan Vishwas (Amendment of Provisions) Act, 2026 (8 of 2026), the Central Government hereby makes the following rules to amend the Daman and Diu Real Estate (Regulation and Development) (General) Rules, 2016, namely:—
(1) These rules may be called the Daman and Diu Real Estate (Regulation and Development) (General) Amendment Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette.
In the Daman and Diu Real Estate (Regulation and Development) (General) Rules, 2016, in rule 33, in sub-rule (1), in the Table, the following row shall be omitted, namely: -
“Punishable with imprisonment under section 68. ten per cent. of the estimated cost of the plot, apartment or building, as the case may be.”
