और (ii) केंद्र सरकार, राज्य सरकारों के परामिग से, भारतीय पत्तन अजधजनयम, 2025 (2025 का 27) की धारा 24(5)(क) और 24(5)(ख) के साथ परित धारा 78(2)(ग) और (घ) के अंतगगत प्रित्त िजियों का प्रयोग करते हुए, उि अजधजनयम को लागू दकए िाने की तारीख को अथवा उसके बाि बनाने का प्रस्ट्ताव करती है, को एतद्द्वारा सभी संभाजवत प्रभाजवत व्यजियों की िानकारी के जलए प्रकाजित करती है; और एतद्द्वारा यह सूचना िी िाती है दक उि प्रारूप जनयमों पर 21 मई, 2026 के बाि जवचार दकया िाएगा। इन मसौिा जनयमों के संबंध में आपजत्तयां या सुझाव, यदि कोई हों, तो उन्हें श्री नवीन कुमार, अवर सजचव, भारत सरकार, पत्तन, पोत पररवहन और िलमागग मंत्रालय, कमरा संख्या 547, 5वीं मंजिल, पररवहन भवन, संसि मागग, नई दिल्ली - 110001 को संबोजधत दकया िा सकता है या ईमेल (uspd-psw@gov.in और sopd1-psw@gov.in) पर 21 मई, 2026 तक या उससे पहले भेिा िा सकता है। सं. 280] नई दिल्ली, बुधवार, अप्रैल 22, 2026/वैिाख 2, 1948 No. 280] NEW DELHI, WEDNESDAY, APRIL 22, 2026/VAISAKHA 2, 1948 सी.जी.-डी.एल.-अ.-22042026-271985 CG-DL-E-22042026-271985 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] उि मसौिा जनयमों के संबंध में दकसी भी व्यजि से उपयुगि जनर्िगष्ट अवजध की समाजि से पहले प्राि होने वाली आपजत्तयों और सुझावों को, इन्हें प्रस्ट्तुत करने वाले व्यजियों के जलए सावगिजनक नहीं माना िाएगा और इन्हें वैश् वाजसक हैजसयत में रखा िाएगा, तादक जहत धारक अपने जवचार स्ट्वतंत्र रूप से प्रिान कर सकें और केंद्र सरकार द्वारा जनयमों को अंजतम रूप िेने से पहले इन पर समुजचत जवचार दकया िाएगा। मसौिा जनयम अध्याय I- प्रारंजभक 1. लघु िीर्गक, प्रारंभ और प्रयोज्यता। (1) इन जनयमों को पत्तन पर संक्रजमत िोन प्रबंधन, ररपोर्टिंग और संक्रामक रोगों का जनयंत्रण, जनयम, 2026 कहा िा सकता है। (2) ये सरकारी रािपत्र में उनके प्रकािन की तारीख से लागू होंगे। (3) अध्याय 1 महापत्तनों और महापत्तन की सीमा के ऐसे भाग पर लागू होगा जिसे धारा 24(4)(क) के अंतगगत संक्रजमत क्षेत्र घोजर्त दकया गया है। (4) अध्याय II और III उन सभी पत्तनों, जिन पर अजधजनयम लागू होता है और ऐसे दकसी भी पत्तन पर आने वाले, वहां से िाने वाले या वहां मौिूि प्रत्येक िलयान पर लागू होंगे। 2. पररभार्ाएं (1) इन जनयमों में, िब तक दक संिभग से अन्यथा अपेजक्षत न हो; (क) “संचरणीय रोग” से दकसी जवजिष्ट संक्रामक कारक या उसके जवर्ैले उत्पािों के कारण होने वाली बीमारी अजभप्रेत है, िो प्रत्यक्ष या अप्रत्यक्ष रूप से एक मनुष्य से िूसरे मनुष्य में फैल सकती है; (ख) “सांसर्गगक रोग” वे रोग हैं िो दकसी वाहक या माध्यम के जबना मनुष्यों के बीच फैल सकते हैं; (ग) संक्रामक रोग रोगिनक सूक्ष्मिीवों, िैसे बैक्टीररया, वायरस, परिीवी या कवक के कारण होते हैं; ये रोग प्रत्यक्ष या अप्रत्यक्ष रूप से एक व्यजि से िूसरे व्यजि में फैल सकते हैं और सावगिजनक स्ट्वास्ट््य के जलए संभाजवत खतरा पैिा कर सकते हैं; (घ) “संक्रजमत क्षेत्र” से दकसी भी ऐसे क्षेत्र, स्ट्थान या भौगोजलक क्षेत्र अजभप्रेत है िहााँ अंतरागष्ट्रीय चचंता का सावगिजनक स्ट्वास्ट््य आपातकाल, महामारी आपातकाल या सावगिजनक स्ट्वास्ट््य िोजखम िारी है, और िो दकसी पत्तन की सीमा के भीतर या उसके आस-पास के क्षेत्रों में जस्ट्थत है और जिसे अजधजनयम की धारा 24(4)(ख) के तहत संक्रामक, सांसर्गगक, संचारी रोग, कीट, रोग वाहक, खतरनाक (सीबीआरएनई) संिूर्क या दकसी अन्य अजधसूजचत सावगिजनक स्ट्वास्ट््य खतरे की उपजस्ट्थजत, संदिग्ध उपजस्ट्थजत या संचरण के िोजखम के कारण संक्रजमत घोजर्त दकया गया है तथा जिसके जलए जनगरानी और जनयंत्रण उपायों की आवश्यकता है; (ङ) “अंतरागष्ट्रीय स्ट्वास्ट््य जवजनयम” या “आईएचआर” से जवश्व स्ट्वास्ट््य संगिन के अंतरागष्ट्रीय स्ट्वास्ट््य जवजनयम (2005) अजभप्रेत है; (च) “अंतिेिीय िलयान” से अंतिेिीय िलयान अजधजनयम, 2021 (2021 का संख्या 24) की धारा 3 की उपधारा (थ) के अंतगगत पररभाजर्त िलयान अजभप्रेत है; (छ) “भारतीय अंतिेिीय िलमागग प्राजधकरण” या “आईडब्लल्यूएआई” से भारतीय अंतिेिीय िलमागग प्राजधकरण अजधजनयम, 1985 (1985 का संख्या 82) की धारा 3 के तहत गरित भारतीय अंतिेिीय िलमागग प्राजधकरण अजभप्रेत है; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ि) महापत्तन में "पत्तन स्ट्वास्ट््य अजधकारी" में स्ट्वास्ट््य अजधकारी और केंद्रीय स्ट्वास्ट््य सेवा जनयमों के अनुसार स्ट्वास्ट््य एवं पररवार कल्याण मंत्रालय (एमओएचएफडब्लल्यू) द्वारा जनयुि कोई अजधकारी या उनकी ओर से पत्तन स्ट्वास्ट््य संगिन के कायों का जनष्पािन करने वाला कोई भी अजधकारी िाजमल है। (झ) “पजब्ललक हेल्थ एमरिेंसी ऑफ इंटरनेिनल कंसनग (पीएचईआईसी)” से एक असाधारण घटना अजभप्रेत है जिसे जनम्नानुसार जनधागररत दकया िाता है:- (i) अंतरागष्ट्रीय स्ट्तर पर रोग के प्रसार से िेि और अन्य िेिों के जलए सावगिजनक स्ट्वास्ट््य िोजखम प्रस्ट्तुत करना; और (ii) इसके जलए संभवतः समजन्वत अंतरराष्ट्रीय प्रजतदक्रया अपेजक्षत होना; (ञ) “सावगिजनक स्ट्वास्ट््य आपातकालीन आकजस्ट्मक योिना” वास्ट्तजवक और संभाजवत सावगिजनक पीएचईआईसी के जलए एक आकजस्ट्मक योिना है, जविेर् रूप से उन जस्ट्थजतयों के जलए िो उभरती संक्रामक बीमाररयों या दकसी भी संक्रामक या सासर्गगक रोगों के कारण होती हैं िो पत्तन सीमाओं, राज्य और राष्ट्रीय सीमाओं से परे होती हैं और अंतरराष्ट्रीय स्ट्तर पर फैल सकती हैं; (ट) “संदिग्ध मामला” से वे व्यजि, सामान, माल, कंटेनर, पोत या वाहन, वस्ट्तु, डाक पासगल अजभप्रेत है जिन्हें पत्तन स्ट्वास्ट््य अजधकारी द्वारा सावगिजनक स्ट्वास्ट््य िोजखम के संपकग में आने वाला या संभाजवत रूप से संपकग में आने वाला माना िाता है और िो रोग के प्रसार का संभाजवत स्रोत हो सकते हैं; (2) इन जनयमों में प्रयुि और अपररभाजर्त, दकन्तु अजधजनयम और भारतीय पत्तन जनयम, 2026 में पररभाजर्त िब्लि एवं अजभव्यजियों का वही अथग होगा िो क्रमिः उनमें दिया गया है। अध्याय II – संक्रजमत क्षेत्र प्रबंधन 3. उद्देश्य और मागगििगक जसद्ांत धारा 24 की उपधारा (4) के खंड (ख) के प्रयोिनों के जलए, इन जनयमों में जनधागररत उपायों को जनम्नजलजखत उद्देश्यों और जसद्ांतों के साथ लागू दकया िाएगा, अथागत्:— (क) दकसी संक्रजमत क्षेत्र से, उसके भीतर या उसके माध्यम से संक्रामक या सांसर्गगक के प्रसार को रोकना, जनयंजत्रत करना या सीजमत करना; (ख) नाजवकों, कामगारों, याजत्रयों और स्ट्थानीय समुिाय के जलए एक सुरजक्षत पररवेि बनाए रखना, साथ ही पत्तन संचालन, व्यापार और यात्रा में अनावश्यक बाधाओं को कम करना; (ग) यह सुजनजित करना दक उपाय हैं — (i) िोजखम-आधाररत और सावगिजनक स्ट्वास्ट््य िोजखम के आकलन के समानुपाजतक; (ii) समयबद् और आवजधक समीक्षा के अध्यधीन; (iii) सावगिजनक स्ट्वास्ट््य और समुद्री पररवहन से संबंजधत लागू अंतरराष्ट्रीय समझौतों के तहत भारत के िाजयत्वों के अनुरूप; और (iv) व्यजियों की गररमा, मानवाजधकारों और मौजलक स्ट्वतंत्रता का उजचत ध्यान रखते हुए कायागजन्वत दकया गया है। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. संक्रजमत क्षेत्र प्रबंधन योिना (1) प्रत्येक महापत्तन धारा 24 की उपधारा (4) के तहत संक्रजमत क्षेत्र की घोर्णा की जस्ट्थजत में कायागन्वयन हेतु एक पत्तन संक्रजमत क्षेत्र प्रबंधन योिना तैयार करेगा और उसे बनाए रखेगा। (2) इस योिना में अन्य बातों के साथ-साथ जनम्नजलजखत प्रावधान होंगे:— (क) इन जनयमों के कायागन्वयन हेतु संगिनात्मक संरचना एवं उत्तरिायी अजधकाररयों के पिनाम; (ख) संक्रजमत क्षेत्रों के त्वररत सीमांकन एवं अंकन की प्रदक्रयाएाँ; (ग) व्यजियों की स्ट्वास्ट््य िााँच, पृथक्करण, क्वारंटीन एवं जचदकत्सा सहायता हेतु प्रोटोकॉल; (घ) पयागवरण स्ट्वच्छता, कीटाणुिोधन एवं रोग वाहक-जनयंत्रण व्यवस्ट्थाएाँ; (ङ) माल और महत्वपूणग आपूर्तगयों की सुरजक्षत ढुलाई सजहत आवश्यक पत्तन संचालन की जनरंतरता; (च) पत्तन स्ट्वास्ट््य संगिन, जिला या राज्य स्ट्वास्ट््य अजधकाररयों एवं अन्य एिेंजसयों के साथ संचार, सूचना साझाकरण एवं समस्ट्या जनवारण तंत्र; और (छ) प्रजिक्षण, अभ्यास एवं आवजधक समीक्षा। (3) यह योिना पत्तन स्ट्वास्ट््य संगिन के परामिग से तैयार की िाएगी और इसकी समीक्षा केंद्र सरकार द्वारा यथाजनिेजित कम से कम िो साल में एक बार या उससे पहले की िाएगी। 5. संक्रजमत क्षेत्र की घोर्णा एवं अजधसूचना (1) प्राजधकरण, स्ट्वास्ट््य अजधकारी और संरक्षक की सलाह पर, पत्तन के दकसी भी बथग, टर्मगनल, लंगरगाह, गोिाम या अन्य क्षेत्र को संक्रजमत क्षेत्र घोजर्त कर सकता है। (2) संक्रजमत क्षेत्र की सभी घोर्णा जनम्नानुसार होंगी; (क) क्षेत्र की भौगोजलक सीमाओं को जनर्िगष्ट करना; (ख) संक्रमण या खतरे की प्रकृजत की पहचान करना; (ग) प्रयोिनीयता की अवजध बताना, समीक्षा के अध्यधीन; और (घ) इसे पत्तन की वेबसाइट पर प्रकाजित दकया िाना, नाजवकों के जलए सूचना िारी दकया िाना और नौवहन लाइनों, टर्मगनल संचालकों, सीमा िुल्क, आव्रिन और अन्य एिेंजसयों को सूजचत दकया िाना। (3) यदि संक्रजमत क्षेत्र में राष्ट्रीय िलमागग का कोई भी जहस्ट्सा पत्तन की सीमाओं को ओवरलैप करता है, तो नौवहन प्रबंधन और परामिग िारी करने के जलए आईडब्लल्यूएआई को सूजचत दकया िाएगा। (4) प्राजधकरण प्रत्येक सात दिनों में या स्ट्वास्ट््य अजधकारी द्वारा जनधागररत अंतराल पर घोर्णा की समीक्षा करेगा। 6. प्रवेि, आवागमन और संचालन पर प्रजतबंध (1) दकसी भी िलयान, चालक िल, यात्री, पत्तन कामगार या आगंतुक को स्ट्वास्ट््य अजधकारी या अजधकृत अजधकारी की जलजखत अनुमजत के जबना संक्रजमत क्षेत्र में प्रवेि करने या बाहर जनकलने की अनुमजत नहीं होगी। (2) संक्रजमत क्षेत्र में कागो प्रचालन, पत्तन पर माल उतारना, पायलट सेवाएं, ईंधन भरना, रसि आपूर्तग या कोई भी अन्य पत्तन गजतजवजध स्ट्वास्ट््य अजधकारी द्वारा जनर्िगष्ट अनुसार जवजनयजमत, प्रजतबंजधत या जनलंजबत की िाएगी। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (3) प्राजधकरण जनिेजित जनम्नजलजखत के जलए कर सकता है: (क) िलयानों को जनधागररत क्वारंटाइन बथों पर ले िाना; (ख) संक्रजमत माल या िूजर्त सामग्री को अलग करना; (ग) प्रभाजवत कामगारों या चालक िल को अलग रखना; और (घ) पत्तन यातायात को वैकजल्पक टर्मगनलों की ओर मोड़ना। (4) अंतिेिीय िलयानों पर इन जनयमों की प्रयोज्यता केवल ऐसे िलयानों तक सीजमत रहेगी िो अजधसूजचत पत्तन सीमाओं के भीतर जस्ट्थत हों या पररचालन कर रहे हों। 7. स्ट्वास्ट््य जनगरानी और स्ट्क्रीचनंग (1) संक्रामक या सांसर्गगक रोग के प्रसार की जनगरानी के जलए, स्ट्वास्ट््य अजधकारी द्वारा संरक्षक और प्राजधकरण के समन्वय से संक्रजमत क्षेत्र में जनरंतर जनगरानी रखी िाएगी। (2) संक्रजमत क्षेत्र में आने वाले या वहां पररचालन करने वाले प्रत्येक पोत को जनम्नजलजखत सूचना प्रिान करनी होगी: (क) समुद्री स्ट्वास्ट््य घोर्णापत्र; (ख) चालक िल/यात्री स्ट्वास्ट््य ररकॉडग; और (ग) अंतरागष्ट्रीय मानवाजधकार अजधजनयम के तहत आवश्यक कोई भी अजतररि स्ट्वास्ट््य संबंधी सूचना। (3) स्ट्वास्ट््य अजधकारी चालक िल, याजत्रयों और पत्तन कमगचाररयों के तापमान िांच, जचदकत्सा परीक्षण, िांच और िोजखम मूल्यांकन कर सकता है। (4) संक्रमण के संिेह वाले दकसी भी व्यजि को राष्ट्रीय सावगिजनक स्ट्वास्ट््य प्रोटोकॉल के अनुसार अलगाव, क्वारंटाइन या जचदकत्सा जनगरानी में रखा िाएगा। 8. स्ट्वच्छता और कीटाणुिोधन (1) प्राजधकारी मास्ट्टर या टर्मगनल ऑपरेटर से जनम्नजलजखत कायग करने की अपेक्षा कर सकता है: (क) िलयान, माल, कंटेनर, उपकरण या पररसर का कीटाणुिोधन, धूमन या रोगवाहक जनयंत्रण; (ख) िूजर्त अपजिष्ट का सुरजक्षत जनपटान; और (ग) िल स्ट्वच्छता, बल्लास्ट्ट वाटर की िााँच और वायु गुणवत्ता जनयंत्रण। (2) कीटाणुिोधन उपाय स्ट्वास्ट््य मंत्रालय, जवश्व स्ट्वास्ट््य संगिन, अंतरागष्ट्रीय स्ट्वास्ट््य मंत्रालय या दकसी भी सक्षम प्राजधकरण द्वारा िारी दििाजनिेिों के अनुरूप होने चाजहए। 9. कागो और कंटेनरों पर प्रचालन जनयंत्रण (1) संक्रजमत क्षेत्र से आने वाले, वहााँ से होकर गुिरने वाले, अथवा वहााँ उतारे गए कागो की ऐसी अजतररि िााँच, प्रिोधन या प्रमाणीकरण दकया िाएगा, िैसा दक स्ट्वास्ट््य अजधकारी द्वारा जनिेजित दकया िाए। (2) जबना जलजखत स्ट्पष्टीकरण/जनकासी के पत्तन से कोई भी िूजर्त कागो या सामग्री छोडी नहीं की िाएगी। (3) संक्रजमत क्षेत्र के भीतर उपयोग दकए िाने वाले कंटेनर-हैंडचलंग उपकरणों का पुन: जनयोिन करने से पहले अजनवायग सैजनटाइिेिन दकया िाएगा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 10. श्रजमक सुरक्षा और सुरक्षात्मक उपाय (1) प्राजधकरण, स्ट्वास्ट््य अजधकारी और संक्रजमत क्षेत्र के भीतर कायगरत जनयोिाओं के साथ परामिग करके, यह सुजनजित करेगा दक— (क) ऐसे श्रजमक जिन्हें संक्रजमत क्षेत्र में प्रवेि करने या रहने की आवश्यकता है, उन्हें उजचत व्यजिगत सुरक्षा उपकरण और उनके सही उपयोग का प्रजिक्षण प्रिान दकया िाए; (ख) कायग समय- सीमा और तैनाती इस प्रकार व्यवजस्ट्थत की िाए जिससे िोजखम कम हो सके, जिसमें िहााँ व्यावहाररक हो, ड्यूटी का रोटेिन और उच्च िोजखम वाले क्षेत्रों में ओवरटाइम को न्यूनतम करना िाजमल है; और (ग) कोई भी श्रजमक, िो अस्ट्वस्ट्थ है, या जिसे संदिग्ध या पुष्ट मामले अथवा जनकट संपकग के रूप में पहचाना गया है, उसे तुरंत ड्यूटी से मुि दकया िाए और जचदकत्सा िांच के जलए भेिा िाए। (2) जनयोिा, स्ट्वास्ट््य अजधकारी या प्राजधकरण द्वारा िारी दकसी भी जनिेि के उल्लंघन में दकसी भी श्रजमक को संक्रजमत क्षेत्र में प्रवेि करना या रहना अपेजक्षत नहीं करेंगे। टर्मगनल प्रचालक श्रजमक तैनाती, पीपीई जवतरण और िोजखम ररकॉडग की ताजलका बनाए रखेंगे। (3) दकसी भी श्रजमक को संक्रमण-जनयंत्रण प्रदक्रयाओं में पयागि प्रजिक्षण के जबना संक्रजमत क्षेत्र में तैनात नहीं दकया िाएगा। 11. संचार, समन्वय और ररपोर्टिंग (1) प्राजधकरण एक एकीकृत इंजसडेंट कमांड संरचना स्ट्थाजपत करेगा, जिसमें सीमा िुल्क, इजमग्रेिन, तटरक्षक, पुजलस, जिचपंग एिेंट और स्ट्वास्ट््य जवभाग के प्रजतजनजध िाजमल होंगे। (2) िलयानों के मास्ट्टर िलयान पर बीमारी के लक्षण, संिूर्ण, या असामान्य मृत्यु की सूचना तत्काल िेंगे। (3) प्राजधकरण िैजनक तौर पर जिचपंग लाइनों और पत्तन उपयोगकतागओं सजहत सभी जहतधारकों को संक्रजमत क्षेत्र की जस्ट्थजत पर अद्यतन िानकारी प्रिान करेगा। (4) पत्तन स्ट्वास्ट््य अजधकारी, स्ट्वास्ट््य सेवा महाजनिेिालय को ररपोटग करेंगे और सवेक्षण डेटा को पत्तन अजधकाररयों तथा एकीकृत रोग जनगरानी कायगक्रम (आईडीएसपी) के साथ साझा दकया िाएगा। 12. अनुपालन प्रजतबद्ताएं (1) प्रत्येक मास्ट्टर, िलयान एिेंट, टर्मगनल प्रचालक और पत्तन उपयोगकताग इन जनयमों के तहत िारी दकए गए जनिेिों का अनुपालन करेंगे। (2) अनुपालन करने में जवफलता, अजधजनयम के तहत उल्लंघन मानी िाएगी और इसके पररणामस्ट्वरूप िुमागना, प्रचालन का जनलंबन, बर्थिंग प्राथजमकता से इनकार, या कोई अन्य कारगवाई की िा सकती है जिसे आवश्यक समझा िाए। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 13. संक्रजमत क्षेत्र की अजधसूचना रद्द करना (1) प्राजधकरण, स्ट्वास्ट््य अजधकारी की सलाह पर, यह पुजष्ट करने के पिात दकसी संक्रजमत क्षेत्र को अजधसूचना से रद्द कर सकता है दक:- (क) अब कोई सदक्रय खतरा नहीं है; (ख) सभी िलयानों, उपकरणों और पररसरों को सैजनटाइि कर दिया गया है; (ग) जनगरानी संकेतक राष्ट्रीय और अंतरागष्ट्रीय मानिंडों के अनुरूप हैं; (2) अजधसूचना रद्द करने की सूचना उन्हीं माध्यमों से संप्रेजर्त की िाएगी जिनके माध्यम से मूल घोर्णा की गई थी। 14. दििा-जनिेि िारी करने की िजि प्राजधकरण संक्रजमत क्षेत्रों के प्रभावी प्रबंधन को सुजनजित करने के जलए इन जनयमों के अनुरूप जवस्ट्तृत दििा-जनिेि, मानक संचालन प्रदक्रयाएं और आकजस्ट्मक प्रोटोकॉल िारी कर सकता है। 15. अवजिष्ट िजियााँ िहााँ इन जनयमों के जनवचगन या कायागन्वयन में कोई संिेह उत्पन्न होता है, वहााँ स्ट्वास्ट््य अजधकारी की सलाह के आधार पर प्राजधकरण का जनणगय अंजतम होगा। अध्याय III – संरक्षक द्वारा की िाने वाली कारगवाई और इस संबंध में िारी दकए िाने वाले जनिेि 16. संरक्षक की िजियााँ और कतगव्य (1) धारा 24 की उप-धारा (5) के खंड (क) के प्रयोिन हेतु, संरक्षक तब कारगवाई करेगा िब— (क) दकसी पत्तन पर आने वाले या वहां जस्ट्थत दकसी िलयान पर कोई संक्रामक या सांसर्गगक रोग का प्रकोप हो, या प्रकोप का समुजचत संिेह हो; और (ख) ऐसा त्य जनम्नजलजखत के माध्यम से संरक्षक के संज्ञान में लाया गया हो— (i) धारा 24 की उप-धारा (5) के खंड (ख) या उसके तहत बनाए गए जनयमों के अंतगगत मास्ट्टर द्वारा िी गई ररपोटग; अथवा (ii) स्ट्वास्ट््य अजधकारी या पत्तन स्ट्वास्ट््य अजधकारी से प्राि ररपोटग या सलाह; अथवा (iii) अन्य सक्षम प्राजधकाररयों सजहत दकसी अन्य जवश्वसनीय स्रोत से प्राि िानकारी। (2) उप-जनयम (1) के प्रयोिनों के जलए, "प्रकोप का समुजचत संिेह" में वे जस्ट्थजतयााँ िाजमल हैं िहााँ— (क) पोत पर एक या अजधक संदिग्ध मामले मौिूि हों; अथवा (ख) जपछले पत्तन पर या यात्रा के िौरान दकसी पुष्ट मामले या बीमारी के प्रकोप के संपकग में आने की िानकारी हो। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 17. प्रजतदक्रया के स्ट्तर (1) स्ट्वास्ट््य अजधकारी या पत्तन स्ट्वास्ट््य अजधकारी की सलाह को ध्यान में रखते हुए, संरक्षक प्रचालन संबंधी उद्देश्यों के जलए जस्ट्थजत को जनम्नजलजखत स्ट्तरों में से दकसी एक में वगीकृत कर सकता है: (क) स्ट्तर 1 – बेहतर सतकगता: आगे संक्रमण फैलने के कम िोजखम के साथ पृथक संदिग्ध मामला (मामलें); (ख) स्ट्तर 2 – जनयंत्रण: दकसी एक िलयान पर प्रसार की संभावना के साथ एक या अजधक पुष्ट मामले, अथवा संदिग्ध मामलों का समूह; (ग) स्ट्तर 3 – तीव्र प्रजतदक्रया: अन्य िलयानों, पत्तन श्रजमकों या समुिाय में प्रसार की आिंका वाले कई मामले या उच्च संक्रामक वाली बीमारी, जिसमें अंतरराष्ट्रीय चचंता के घोजर्त सावगिजनक स्ट्वास्ट््य आपातकाल के संिभग में रोग भी िाजमल है। 2. प्रजतदक्रया का स्ट्तर, अजधजनयम के तहत संरक्षक की िजियों को सीजमत दकए जबना, इसके अधीन की िाने वाली कारगवाई और जनिेिों की गंभीरता द्वारा जनिेजित होगा। 18. संरक्षक द्वारा िारी दकए िाने वाले जनिेि संरक्षक, पत्तन की सीमाओं के भीतर दकसी भी मास्ट्टर, माजलक, एिेंट, या िलयान, संरचना या पररसर के प्रभारी व्यजि को जलजखत या मौजखक (बाि में जलजखत पुजष्ट के साथ) जनिेि िारी कर सकता है, जिनमें जनम्नजलजखत जनिेि िाजमल हैं: (क) िलयानों के जलए: (i) एंकरेि या बथग बिलने के जलए; (ii) एंकर उिाने, आगे बढ़ने, टो करने, या जनर्िगष्ट स्ट्थानों पर मूर के जलए; (iii) प्रचालन बंि करने के जलए, जिसमें कागो हैंडचलंग, बंकररंग या याजत्रयों की आवािाही िाजमल है; (iv) गजत सीमा, नौवहन मागग, ज्वारीय चवंडोि, या पायलटेि की आवश्यकताओं का अनुपालन करने के जलए; (v) िलयान के फंसने, टकराने, प्रिूर्ण या बाधा को रोकने के उपाय करने के जलए। (ख) टर्मगनलों और ऑपरेटरों के जलए: (i) प्रभाजवत क्षेत्रों में प्रचालन को जनलंजबत या आिोजधत करने के जलए; (ii) बाधा उत्पन्न करने वाले उपकरणों या वस्ट्तुओं को हटाने के जलए; (iii) आपातकालीन प्रिूर्ण-जनयंत्रण, अजि-सुरक्षा, या ररसाव-रोकथाम उपायों को लागू करने के जलए। (ग) व्यजियों या संगिनों के जलए: (i) असुरजक्षत क्षेत्रों को खाली करने के जलए; (ii) सुरक्षा प्रोटोकॉल का अनुपालन करने के जलए; (iii) जनरीक्षण के जलए पहुाँच, िस्ट्तावेज़ या सहयोग प्रिान करने के जलए। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 19. स्ट्वास्ट््य प्राजधकरणों और अन्य एिेंजसयों के साथ समन्वय (1) जनयम 5 के तहत जस्ट्थजत की िानकारी जमलने के बाि, संरक्षक यथािीघ्र जनम्नजलजखत को सूजचत करेगा और जनम् न के साथ समन्वय करेगा— (क) स्ट्वास्ट््य अजधकारी या पत्तन स्ट्वास्ट््य अजधकारी; (ख) इस प्रयोिन के जलए नाजमत कोई भी स्ट्थानीय या राज्य सावगिजनक स्ट्वास्ट््य प्राजधकारी; और (ग) ऐसी अन्य एिेंजसयां जिनकी आवश्यकता हो सकती है, जिनमें इजमग्रेिन, सीमा िुल्क, तटरक्षक या पुजलस िाजमल हैं। (2) व्यजियों के जनिान, उपचार, एकाकी करने या क् वारंटीन करने संबंधी जनणगय के जलए, स्ट्वास्ट््य अजधकारी या अन्य सक्षम स्ट्वास्ट््य प्राजधकरण उत्तरिायी होगा और संरक्षक, पत्तन की सीमाओं के भीतर ऐसे जनणगयों में मिि करने और कायागजन्वत करने के जलए प्रचालनगत उपाय करेगा। (3) संरक्षक, सामान्य जस्ट्थजत आधुजनकीकरण और संयुि जनयोिन सजहत महत्वपूणग घटनाओं (स्ट्तर 2 या स्ट्तर 3) के जलए, पत्तन स्ट्वास्ट््य अजधकारी और अन्य मुख्य एिेंजसयों के साथ एक संयुि घटना समन्वय तंत्र स्ट्थाजपत कर सकता हैं। 20. ज़ारी दकए गए जनिेिों का ररकॉडग (1) संरक्षक, ज़ारी दकए गए सभी जनिेिों का एक रेजिस्ट्टर बनाएगा, जिसमें दिनांक, समय, जनिेि की प्रकृजत और अनुपालन जस्ट्थजत िाजमल होगी। (2) पत्तन प्राजधकरण को एक समेदकत माजसक ररपोटग प्रस्ट्तुत की िाएगी। 21. संचार और प्रकािन (1) संरक्षक, जनम्नजलजखत माध्यम से तत् काल जनिेिों को प्रसाररत करेगा: (क) वीएचएफ रेजडयो; (ख) नाजवक को स्ट्थानीय नोरटस (ग) ईमेल/एसएमएस अलटग (घ) वीटीएस एडवाइिरी (2) पत्तन प्रचालन को प्रभाजवत करने वाले मुख्य जनिेिों की प्रजतयां, पत्तन की वैबसाइट पर उपलब्लध कारवाई िाएगी। 22. अन्य एिेंजसयों से सहायता संरक्षक, इन जनयमों के तहत कारगवाई को कायागजन्वत करने के जलए पायलटेि सेवाएाँ, हाबगर मास्ट्टर, तट रक्षक, पुजलस, अजििमन सेवाएाँ, पयागवरणीय एिेंजसयों और कोई अन्य आवश्यक प्राजधकरण की सहायता का अनुरोध कर सकता हैं। 23. उपायों की अनुपाजतकता, समीक्षा और वापस लेना (1) संरक्षक सुजनजित करेगा दक इन जनयमों के तहत दकए गए उपाय-- (क) जनयम 6 के तहत जनधागररत िोजखम स्ट्तर के अनुरूप हैं; 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) स्ट्वास्ट््य अजधकारी के परामिग से समय-समय पर समीक्षा की िाती है; और (ग) िैसे ही िोजखम का आकलन दकया िाता है दक वह एक ऐसे स्ट्तर तक कम हो गया है िहां ऐसे उपायों की अब आवश्यकता नहीं है, उन्हें वापस ले जलया िाता है या इनमें ढ़ील िी िाती है। (2) प्रमुख घटनाओं (स्ट्तर 2 या स्ट्तर 3) के जलए संरक्षक और स्ट्वास्ट््य अजधकारी, सात दिनों से अजधक अंतराल में जस्ट्थजत की संयुक् त समीक्षा करेंगे और जवजिष्ट उपायों को ज़ारी, आिोजधत और बंि करने के, दकसी भी जनणगय को ििग करेंगे। 24. बचत इस अध्याय में सजम्मजलत कुछ भी, नौचालन, पयागवरणीय संरक्षण, समुद्री सुरक्षा अथवा आपातकालीन प्रबंधन से संबंजधत दकसी भी लागू जनयम के तहत, संरक्षक अथवा प्राजधकरण, दकसी अन्य िजि को सीजमत नहीं करेगा। अध्याय IV - िलयान के माजलक द्वारा संचारी रोग की ररपोर्टिंग 25. माजलक द्वारा दकसी ऐसे रोग के जववरण की ररपोर्टिंग (1) अजधजनयम की धारा 24 की उप-धारा (5) के खंड (ख) के अनुसरण में, दकसी भी पत्तन पर पहुंचने वाले या वहां मौिूि प्रत्येक िलयान का माजलक, िलयान पर दकसी संक्रामक या सांसर्गगक रोग, या संदिग्ध प्रकोप का जववरण जनम् न को ररपोटग करेगा- (क) सरकार, उस पत्तन के जलए नाजमत पत्तन स्ट्वास्ट््य अजधकारी या स्ट्वास्ट््य अजधकारी के माध्यम से; और (ख) संरक्षक या ऐसा अन्य पत्तन अजधकारी, िैसा पत्तन, प्रचालन समन्वय के जलए जनर्िगष्ट कर सकता हैं। (2) ररपोटग करने का कायग तब उत्पन्न होगा िब— (क) दकसी संक्रामक या सांसर्गगक रोग का कोई मामला या संदिग्ध मामला िहाज़ पर पाया िाता है; (ख) यात्रा के िौरान या पत्तन पर रहने के िौरान दकसी अज्ञात कारण या संदिग्ध संक्रामक रोग से िहाज़ पर कोई मृत्यु हुई हैं; या (ग) िहाि पर बीमारी के मामलों का एक असामान्य एकत्रीकरण है िो प्रकोप का संकेत िे सकता है। (3) उप-जनयम (1) के तहत ररपोटग करना अजनवायग हो, भले ही िलयान हो: (क) एकोरेि पर हो, (ख) रास्ट् ते में हो, (ग) बथग पर हो, या (घ) कागो, बाँकररंग या यात्री प्रचालन में हो (4) िब तक इन ररपोर्टिंग आवश्यकताओं का अनुपालन नहीं हो िाता, तब तक कोई भी िलयान िावक या आवक जनकासी प्राि नहीं करेगा। 26. ररपोटग का समय (1) यदि आगमन के पहले संक्रामक या सांसर्गगक रोग के संदिग्ध मामला ज्ञात है, तो मास्ट्टर कम से कम ररपोटग करेगा: (क) आगमन से 24 घंटे पहले, या [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 (ख) यदि, यात्रा की अवजध 24 घंटों से कम हो तो िीघ्रतम संभव समय पर। (2) यदि, कोई संक्रामक या सांसर्गगक रोग यात्रा के िौरान प्रकट होता हैं तो मास्ट्टर, पता लगने पर तुरंत ररपोटग करेगा। (3) यदि, संक्रामक या सांसर्गगक रोग बर्थिंग के बाि प्रकट होता हैं तो मास्ट्टर, संरक्षक और स्ट्वास्ट््य अजधकारी को अजवलंब सूजचत करेगा। 27. ररपोर्टिंग का स्ट्वरूप मास्ट्टर, जनम्नजलजखत चरणों का उपयोग करके रोग को ररपोटग करेगा: (क) प्राथजमक ररपोर्टिंग (िुरुआती अजधसूचना) ररपोटग इनके माध्यम से भेिी िाएगी- (i) वीएचएफ रेजडयो (पत्तन द्वारा नाजमक चैनल), (ii) पत्तन स्ट्वास्ट््य कायागलय को ईमेल, (iii) पत्तन प्राजधकरण द्वारा नाजमत इलेक्रोजनक पोटगल, (iv) अजभकताग के माध्यम से जलजखत संचार। (ख) मैरीटाइम जडक् लेरेिन ऑफ हेल् थ (एमडीएच) की प्रस्ट्तुजत मास्ट्टर, मैरीटाइम जडक् लेरेिन ऑफ हेल् थ प्रस्ट्तुत करेगा, जिसमें िाजमल हो - (i) संक्रामक या सांसर्गगक रोग के लक्षण और प्रकृजत; (ii) प्रभाजवत व्यजियों की संख्या; (iii) िहाज़ पर दकए गए एकाकी करने के उपायों का जववरण; (iv) आगमन और प्रस्ट्थान की जतजथ के साथ 30 दिनों के जलए पोटग ऑफ कॉल की सूची; (v) िहाज़ पर कोई मृत्यु; (vi) पहले से ही दकए गए स्ट्वच्छता उपाय (ग) पूरक ररपोर्टिंग मास्ट्टर उपलब्लध करेगा: (i) अद्यतन जचदकत्सा लॉग (ii) कमीिल और यात्री सूजचयााँ; (iii) जपछली जचदकत्सा िांच का जववरण; (iv) टीकाकरण प्रमाणपत्र या स्ट्वास्ट््य िस्ट्तावेि, यदि आवश्यक हो; (v) आईएमओ मानक प्रारूप के अनुसार िहाज़ पर दकसी अवैध यात्री का जववरण; आगमन से पूवग, जपछले 30 दिनों में येल्लो फीवर एंडेजमक िेिों के दकसी पत्तन के संपकग में आने (यदि हााँ, पत्तन.......... िेि .............. प्रस्ट्थान की जतजथ............ का जववरण प्रिान करें।) का जववरण। 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 28. प्रिान की िाने वाली िानकारी मास्ट्टर द्वारा प्रस्ट्तुत की गयी ररपोटग में जनम्नजलजखत जववरण िाजमल होंगे: (क) िलयान का नाम, आईएमओ संख्या, ध्वज़ और प्रकार; (ख) जपछला पोटग ऑफ कॉल और अगला पोटग ऑफ कॉल; (ग) संक्रामक या सांसर्गगक रोग या पता लगाए गए लक्षणों का जववरण; (घ) प्रभाजवत व्यजियों की संख्या (कमीिल/याजत्रयों का अलग- अलग); (ङ) प्रत्येक प्रभाजवत व्यजि की जस्ट्थजत; (च) िहाज़ पर दकए गए उपाय (एकाकीकरन, जवसंक्रमण, उपचार); (छ) जचदकत्सीय जनवागतन या सहायता के जलए कोई अनुरोध; (ि) यदि, िलयान को क् वारंटीन या जविेर् बेर्थिंग जनिेिों की आवश्यकता हैं। 29. ररपोर्टिंग के बाि मास्ट्टर का कायग ररपोर्टिंग के बाि, मास्ट्टर जनम्नजलजखत कायग करेगा— (क) डब्ललूएचओ प्रोटोकाल के अनुसार प्रभाजवत व्यजि को अलग करना; (ख) कमीिल/याजत्रयों की प्रजतबंजधत आवािाही (स्ट्वास्ट््य अजधकारी द्वारा दिये गए परामिग के अनुसार); (ग) िब तक अनुमजत न िी िाए, तट छोड़ने पर रोक लगाना; (घ) संरक्षक और स्ट्वास्ट््य अजधकारी के जनिेिों का अनुपालन करना; (ङ) िहाज़ पर स्ट्वच्छता और साफ- सफाई के उपाय बनाए रखना; (च) िलयान को पत्तन स्ट्वास्ट््य अजधकाररयों द्वारा जनरीक्षण के जलए उपलब्लध करवाना। 30. सवेक्षक और स्ट्वास्ट््य अजधकारी द्वारा जनिेि मास्ट्टर की ररपोटग प्राप् त होने पर, संरक्षक, स्ट्वास्ट््य अजधकारी के जनिेिों पर जवचार करने के बाि, िलयान को जनिेजित कर सकता हैं: (क) क् वारंटीन लंगरगाह पर लंगर डालने के जलए; (ख) एकाकी/क् वारंटीन बथग पर पर बथग करना; (ग) कागो/ यात्री प्रचालन को रोकने के जलए; (घ) सफाई, कीटाणुिोधन, धूमन करने के जलए; (ङ) उपचार के जलए प्रभाजवत व्यजि को िहाज़ से उतारने के जलए; (च) जचदकत्सा जनरीक्षण या िांच कराने के जलए; (छ) दकसी भी िन- स्ट्वास्ट््य परामिग का अनुपालन करने के जलए [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 31. ररपोटग करने में जवफलता (1) संक्रामक या सांसर्गगक रोग को ररपोटग करने में जवफलता, ररपोटग करने में जवलंब, या सूचना का लोप, अजधजनयम के उल्लंघन के रूप में माना िाएगा। (2) पत्तन प्राजधकरण जनम् न अजधरोजपत कर सकता है— (क) अजधजनयम के तहत िंड; (ख) पत्तन जनकासी की अस्ट्वीकृजत; (ग) िलयान का जडटेंिन; (घ) जनरोधन, क् वारंटीन या आपातकालीन उपायों के जलए लागत की वसूली। 32. गोपनीयता और ररकॉडग रखना (1) संरक्षक और स्ट्वास्ट््य अजधकारी, संक्रामक या संक्रामक रोग ररपोटग का एक गोपनीय रजिस्ट्टर बनाएगा। (2) ररकॉडग कम से कम सात वर्ों के जलए बनाए रखे िाएगे। (3) जवजध के अनुसार डब्ललूएचओ, राज्य स्ट्वास्ट््य जवभाग, और प्रवासन अजधकाररयों सजहत प्राजधकृत एिेंजसयों के साथ िानकारी साझा की िा सकती है। 33. बचत इस अध्याय में कुछ भी समय-समय पर लागू दकसी भी कानून के तहत संरक्षणकताग, प्राजधकरण या स्ट्वास्ट््य अजधकारी की सावगिजनक स्ट्वास्ट््य और सुरक्षा के जलए आपातकालीन उपाय करने की िजियों को सीजमत नहीं करेगा। 34. भारतीय पत्तन िन स्ट्वास्ट््य जनयम, 2026 का आवेिन इन जनयमों के प्रावधान, भारतीय पत्तन िन स्ट्वास्ट््य जनयम, 2026 के अजतररि होगें और इनके अल्पीकरण में नहीं होगें। [फा. सं. पीडी-24015/1/2025-पीडी-I-भाग(1)/ई-378339] मुकेि मंगल, अपर सजचव MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 22nd April, 2026 G.S.R. 304(E).— Draft rules proposed to be made by (i) the Central Government in exercise of the powers conferred under section 76(2)(g) read with section 24(4)(b); DRAFT RULES CHAPTER I- PRELIMINARY 1. Short Title, Commencement and Applicability. – (1) These rules may be called the Infected Zone Management, Reporting and Control of Communicable Disease at Ports Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. (3) Chapter I shall be applicable to major ports and to such part of the port limits of a major port as is declared as an infected zone under section 24(4)(a). (4) Chapter II and III shall be applicable to all ports to which the Act extends and to every vessel arriving at, departing from, or being within any such port. 2. Definitions. – (1) In these rules, unless the context otherwise requires; (a) “communicable disease” means an illness due to a specific infectious agent or its toxic products capable of being directly or indirectly transmitted from human to human; (b) “contagious disease” are those that can be spread between humans without an intervening vector or vehicle; (c) “infectious diseases” are caused by pathogenic microorganisms, such as bacteria, viruses, parasites or fungi; the diseases can be spread, directly or indirectly, from one person to another and may cause potential public health risk; (d) “infected zone” means any territory or space or geographical location which is experiencing ongoing Public Health Emergency of International Concern or Pandemic emergency or public health risk within the limits of any port or its adjoining areas that is declared infected under Section 24(4)(b) of the Act on account of the presence, suspected presence, or risk of transmission of an infectious, contagious, communicable disease, pest, vector, hazardous (CBRNE) contaminant, or any other notified public health threat and that requires surveillance and control measures; (e) “International Health Regulations” or “IHR” means the International Health Regulations (2005) of the World Health Organization; (f) “Inland Vessel” means as defined under sub-section (q) of section 3 of Inland Vessels Acts, 2021 (No. 24 of 2021); (g) “Inland Waterways Authority of India” or “IWAI” means the Inland Waterways Authority of India constituted under section 3 of the Inland Waterways Authority of India Act, 1985 (No.82 of 1985); (h) “port health officer” in major port includes health officer and an officer appointed by the Ministry of Health and Family Welfare (MoHFW) as per Central Health Service rules or any officer working on his behalf to perform the functions of Port Health Organization; (i) “public health emergency of international concern (PHEIC)” means an extraordinary event which is determined: - (i) to constitute a public health risk to the country and other countries through international spread of disease; and (ii) to potentially require a coordinated international response; (j) “public health emergency contingency plan” is a contingency plan for real and potential PHEIC, especially those caused by emerging infectious diseases or any infectious or contagious diseases that do not respect port boundaries, state and national borders and can spread internationally; (k) “suspected case” means persons, baggage, cargo, containers, ship or conveyances, goods, postal parcels considered by Port health officer as having been exposed, or possibly exposed, to a public health risk and that could be a possible source of spread of disease; (2) Words and expressions used and not defined in these rules but defined in the Act, and Indian Ports Rules, 2026, shall have the meanings respectively assigned to them therein. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 CHAPTER II – INFECTED ZONE MANAGEMENT 3. Objectives and guiding principles. – For the purposes of clause (b) of sub-section (4) of section 24, the measures prescribed in these rules shall be implemented with the following objectives and principles, namely:— (a) to prevent, control or contain the spread of infectious or contagious diseases from, within, or through an infected zone; (b) to maintain a safe environment for seafarers, workers, passengers and the local community, while minimising unnecessary interference with port operations, trade and travel; (c) to ensure that measures are— (i) risk-based and proportionate to the assessed public health risk; (ii) time-bound and subject to periodic review; (iii) consistent with India’s obligations under applicable international instruments relating to public health and maritime transport; and (iv) implemented with due regard to dignity, human rights and fundamental freedoms of individuals. 4. Infected Zone Management Plan. – (1) Every major port shall prepare and maintain a Port Infected Zone Management Plan for implementation in the event of a declaration of an infected zone under sub-section (4) of section 24. (2) The Plan shall, inter-alia, provide for— (a) organisational structure and designation of responsible officers for implementing these rules; (b) procedures for rapid delineation and marking of infected zones; (c) protocols for health screening, isolation, quarantine and medical referral of persons; (d) environmental sanitation, disinfection and vector-control arrangements; (e) continuity of essential port operations, including safe handling of cargo and critical supplies; (f) communication, information-sharing and escalation mechanisms with the Port Health Organisation, district or State health authorities and other agencies; and (g) training, drills and periodic review. (3) The Plan shall be prepared in consultation with the Port Health Organisation and shall be reviewed at least once in two years or earlier, as may be directed by the Central Government. 5. Declaration and Notification of an Infected Zone. – (1) The Authority may, on the advice of the health officer and conservator, declare any berth, terminal, anchorage, warehouse, or other area of the port as an infected zone. (2) Every declaration of an infected zone shall; (a) specify the geographical boundaries of the zone; (b) identify the nature of infection or hazard; (c) state the duration of applicability, subject to review; and (d) be published on the port website, notice to Mariners, and communicated to shipping lines, terminal operators, customs, immigration, and other agencies. (3) If the infected zone includes any portion of a national waterway overlapping with port limits, IWAI shall be informed for navigation management and issuing advisories. (4) The Authority shall review the declaration every seven days or at such intervals as the health officer may determine. 6. Restriction on Entry, Movement, and Operations. – (1) No vessel, crew, passenger, port worker, or visitor shall enter or exit an infected zone except with the written permission of the health officer or an authorised officer. 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) Cargo operations, berthing, pilotage, bunkering, provisioning, or any other port activity in the infected zone shall be regulated, restricted, or suspended as specified by the health officer. (3) The Authority may direct: (a) movement of vessels to designated quarantine berths; (b) segregation of infected cargo or contaminated material; (c) isolation of affected workers or crew; and (d) diversion of port traffic to alternate terminals. (4) The applicability of these rules to inland vessels shall be limited to such vessels which are port-bound or operating within the notified port limits. 7. Health Surveillance and Screening. – (1) Continuous surveillance shall be maintained within the infected zone by the health officer, in coordination with the conservator and the Authority, to monitor the spread of infectious or contagious disease. (2) Every vessel arriving at or operating within the infected zone shall furnish: (a) a Maritime Declaration of Health; (b) crew/passenger health records; and (c) any additional health information required under the IHR. (3) The health officer may conduct temperature screening, medical examination, testing, and risk assessment of crew, passengers, and port workers. (4) Any person suspected of infection shall be placed under isolation, quarantine, or medical observation in accordance with national public-health protocols. 8. Sanitation and Disinfection. – (1) The Authority may require the master or terminal operator to undertake; (a) disinfection, fumigation, or vector control of the vessel, cargo, containers, equipment, or premises; (b) safe disposal of contaminated waste; and (c) water sanitation, ballast water checks, and air-quality control. (2) Disinfection measures shall conform to guidelines issued by the Ministry of Health, WHO, IMO, or any competent authority. 9. Operational Controls on Cargo and Containers. – (1) Cargo originating from, transiting through, or unloaded in the infected zone shall be subjected to such additional checks, treatment, or certification as the health officer may direct. (2) No contaminated cargo or material shall be released from the port without written clearance. (3) Container-handling equipment used within the infected zone shall undergo mandatory sanitization before redeployment. 10. Worker Safety and Protective Measures. – (1) The Authority shall, in consultation with the health officer and employers operating within the infected zone, ensure that— (a) workers who are required to enter or remain in the infected zone are provided with appropriate personal protective equipment and training in its correct use; (b) work schedules and deployment are so arranged as to reduce exposure, including, where feasible, by rotation of duties and minimisation of overtime in high-risk areas; and (c) any worker who is unwell, or who is identified as a suspected or confirmed case or close contact, is promptly relieved from duty and referred for medical assessment. (2) Employers shall not require any worker to enter or remain in the infected zone in contravention of any direction issued by the health officer or the Authority. Terminal operators shall maintain logs of worker deployment, PPE issuance, and exposure records. (3) No worker shall be deployed in an infected zone without adequate training in infection-control procedures. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 17 11. Communication, Coordination, and Reporting. – (1) The Authority shall establish a unified incident command structure, including representatives from Customs, Immigration, Coast Guard, Police, Shipping agents, and the Health Department. (2) Masters of vessels shall immediately report any signs of illness, contamination, or unusual mortality on board. (3) The Authority shall provide daily updates on the status of the infected zone to stakeholders, including shipping lines and port users. (4) Port health officer shall report to the Directorate General of Health Services and surveillance data to be shared with the port authorities and the Integrated Disease Surveillance Programme (IDSP). 12. Compliance Obligations. – (1) Every master, vessel agent, terminal operator, and port user shall comply with directions issued under these rules. (2) Failure to comply shall constitute a contravention under the Act and may attract penalties, suspension of operations, denial of berthing priority, or any other action deemed necessary. 13. De-notification of an Infected Zone. – (1) The Authority may, on the advice of the health officer, de-notify an infected zone after confirming that:- (a) no active threat remains; (b) all vessels, equipment, and premises have been sanitised; (c) surveillance indicators conform to national and international norms. (2) The de-notification shall be communicated through the same channels as the original declaration. 14. Power to Issue Guidelines. – The Authority may issue detailed guidelines, standard operating procedures, and contingency protocols consistent with these rules to ensure effective management of infected zones. 15. Residual Powers. – Where any doubt arises in the interpretation or implementation of these rules, the decision of the Authority, based on the advice of the health officer, shall be final. CHAPTER III – ACTION TO BE TAKEN BY THE CONSERVATOR AND THE DIRECTIONS TO BE ISSUED IN THIS REGARD 16. Powers and Duties of the Conservator. – (1) For the purpose of clause (a) of sub-section (5) of section 24, the conservator shall act whenever— (a) any infectious or contagious disease has broken out, or is reasonably suspected to break out, on a vessel arriving at or being in any port; and (b) such fact is brought to the knowledge of the conservator through— (i) a report by the master under clause (b) of sub-section (5) of section 24 or rules made thereunder; or (ii) a report or advice from the health officer or port health officer; or (iii) information from any other reliable source, including other competent authorities. (2) For the purposes of sub-rule (1), “reasonably suspected to break out” includes situations where— (a) one or more suspected cases are present on board; or (b) there has been known exposure to a confirmed case or outbreak at a previous port or during the voyage. 17. Levels of response. – (1) Having regard to the advice of the health officer or port health officer, the conservator may categorise the situation, for operational purposes, into one of the following levels: (a) Level 1 – Enhanced vigilance: isolated suspected case(s) with low risk of onward transmission; (b) Level 2 – Containment: one or more confirmed cases, or cluster of suspected cases, on a single vessel with potential for spread; 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (c) Level 3 – Escalated response: multiple cases or high transmissibility disease with potential spread to other vessels, port workers or the community, including in the context of a declared public health emergency of international concern. (2) The level of response shall guide the intensity of action and directions under hereunder, without limiting the conservator’s powers under the Act. 18. Directions that may be Issued by the Conservator. – The conservator may issue directions, written or oral (with subsequent written confirmation), to any master, owner, agent, or person in charge of a vessel, structure, or premises within port limits, including directions: (a) To Vessels: (i) to shift anchorage or berth; (ii) to heave up anchor, move, tow, or moor at designated locations; (iii) to cease operations, including cargo handling, bunkering, or passenger movement; (iv) to comply with speed limits, navigational routes, tidal windows, or pilotage requirements; (v) to take measures to prevent grounding, collision, pollution, or obstruction. (b) To Terminals and Operators: (i) to suspend or modify operations in affected areas; (ii) to remove equipment or objects creating obstructions; (iii) to implement emergency pollution-control, fire-safety, or spill-containment measures. (c) To Individuals or Organisations: (i) to vacate unsafe zones; (ii) to comply with safety protocols; (iii) to provide access, documents, or cooperation for inspections. 19. Coordination with health authorities and other agencies. – (1) The conservator shall, as soon as practicable after becoming aware of a situation under rule 5, inform and coordinate with— (a) the health officer or port health officer; (b) any local or State public health authority designated for the purpose; and (c) such other agencies as may be required, including immigration, customs, coast guard or police. (2) Decisions on diagnosis, treatment, isolation or quarantine of persons shall rest with the health officer or other competent health authority; and the conservator shall take operational measures to support and give effect to such decisions within port limits. (3) The conservator may establish a joint incident coordination mechanism with the port health officer and other key agencies for significant events (Level 2 or Level 3), including regular situation updates and joint planning. 20. Record of Directions Issued. – (1) The conservator shall maintain a register of all directions issued, including date, time, nature of direction, and compliance status. (2) A consolidated monthly report shall be submitted to the Port Authority. 21. Communication and Publication. – (1) The conservator may disseminate urgent directions through: (a) VHF radio; (b) Local Notices to Mariners; (c) email/SMS alerts; (d) VTS advisories. (2) Copies of major directions affecting port operations shall be made available on the port website. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 19 22. Assistance from Other Agencies. – The conservator may request the assistance of pilotage services, Harbour Master, Coast Guard, Police, Fire Services, environmental agencies, and any other authority necessary for implementing actions under these rules. 23. Proportionality, review and withdrawal of measures. – (1) The conservator shall ensure that measures taken under these rules— (a) are commensurate with the risk level determined under rule 6; (b) are periodically reviewed in consultation with the health officer; and (c) are withdrawn or relaxed as soon as the risk is assessed to have reduced to a level where such measures are no longer necessary. (2) For significant events (Level 2 or Level 3), the conservator and health officer shall jointly review the situation at intervals not exceeding seven days and record any decision to continue, modify or discontinue specific measures. 24. Savings. – Nothing contained in this Chapter shall limit any other powers of the conservator or the Authority under any law for the time being in force relating to navigation, environmental protection, maritime safety, or emergency management. CHAPTER IV - REPORTING OF COMMUNICABLE DISEASE BY MASTER OF VESSEL 25. Reporting of the particulars of any such disease by the Master. – (1) In pursuance of clause (b) of sub-section (5) of section 24 of the Act, the master of every vessel arriving at, or being in, any port shall report the particulars of any infectious or contagious disease, or suspected outbreak thereof, on board the vessel to— (a) the Government, through the port health officer or health officer designated for that port; and (b) the conservator or such other port officer as the port may specify for operational coordination. (2) The duty to report shall arise whenever— (a) a case or suspected case of any infectious or contagious disease is identified on board; (b) there has been a death on board from unknown causes or suspected infectious disease during the voyage or while in port; or (c) there is an unusual aggregation of cases of illness on board which may indicate an outbreak. (3) Reporting under sub-rule (1) shall be mandatory regardless of whether the vessel is: (a) at anchorage, (b) underway, (c) berthed, or (d) engaging in cargo, bunkering, or passenger operations. (4) No vessel shall obtain outward or inward clearance until compliance with these reporting requirements is confirmed. 26. Timing of Report. – (1) Where a suspected case of infectious or contagious disease is known before arrival, the master shall report at least: (a) 24 hours before arrival, or (b) at the earliest possible time if voyage duration is less than 24 hours. (2) If an infectious or contagious disease arises during voyage, the master shall report immediately upon detection. (3) If infectious or contagious disease occurs after berthing, the master shall notify the conservator and health officer without delay. 27. Manner of Reporting. – The master shall report disease using the following steps: 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (a) Primary Reporting (Initial Notification) Report may be made through— (i) VHF radio (Channel designated by the port), (ii) Email to the Port Health Office, (iii) Electronic portal designated by the Port Authority, (iv) Written communication via the agent. (b) Submission of Maritime Declaration of Health (MDH) The master shall submit a Maritime Declaration of Health, containing— (i) symptoms and nature of infectious or contagious disease; (ii) number of affected persons; (iii) details of isolation measures taken on board; (iv) port of call list for 30 days with arrival and departure dates; (v) any deaths on board; (vi) sanitary measures already conducted. (c) Supplementary Reporting The master shall provide: (i) updated medical logs; (ii) crew and passenger lists; (iii) details of last medical inspection; (iv) vaccination certificates or health documents if required; (v) details of any stowaways on board as per IMO standard format; touched any ports in the Yellow Fever Endemic Countries in the last 30 days, before arrival (If yes, provide details of Port ……….. Country………. Departure date…………………..). 28. Information to be Provided. – A report submitted by the master shall include the following details: (a) Vessel name, IMO number, flag, and type; (b) Last port of call and next port of call; (c) Description of the infectious or contagious disease or symptoms detected; (d) Number of affected persons (crew/passengers separately); (e) Condition of each affected person; (f) Measures undertaken on board (isolation, disinfection, treatment); (g) Any request for medical evacuation or assistance; (h) Whether the vessel requires quarantine or special berthing instructions. 29. Duties of the Master After Reporting. – After reporting, the master shall— (a) isolate the affected person(s) as per WHO protocol; (b) restrict movement of crew/passengers (as advised by health officer); (c) prohibit shore leave unless permitted; (d) comply with directions of the conservator and health officer; (e) maintain sanitation and hygiene measures on board; (f) make the vessel available for inspection by port health officials. Directions by conservator and health officer. – Upon receipt of the master’s report, the conservator may direct the vessel after taking into consideration the health officer’s directions: - (a) to anchor at quarantine anchorage; (b) to berth at an isolated/quarantine berth; (c) to cease cargo/passenger operations; (d) to undertake cleaning, disinfection, fumigation; (e) to disembark affected individuals for treatment; (f) to undergo medical inspection or testing; (g) to comply with any public-health advisory. 31. Failure to Report. – (1) Failure to report infectious or contagious disease, delay in reporting, or concealment of information shall be treated as a violation of the Act. (2) The Port Authority may impose— (a) penalties under the Act; (b) refusal of port clearance; (c) detention of the vessel; (d) recovery of costs for containment, quarantine, or emergency measures. 32. Confidentiality and Record Keeping. – (1) The conservator and health officer shall maintain a confidential register of infectious or contagious disease reports. (2) Records shall be retained for at least seven years. (3) Information may be shared with authorised agencies including WHO, State Health Department, and Immigration authorities in accordance with law. 33. Savings. – Nothing in this Chapter shall limit the powers of the conservator, the Authority, or health officer under any law for the time being in force to take emergency measures for the protection of public health and safety. 34. Application of Indian Port Public Health Rules, 2026. – The provisions of these rules shall be in addition to, and not in derogation of, the provisions of the Indian Port Public Health Rules, 2026.
