सा.का.जन. 190(अ).— कीटनािी जनयम, 1971 का और संिोधन करने के जलए जनजललजखत प्रारूप जनयम, जिन्हें
केंद्रीय सरकार कीटनािी अधजनयम, 1968 (1968 का 46) की धारा 36 के द्वारा प्रित्त िजियों का प्रयोग करते हुए बनाने
का प्रस्ट्ताि करती है, उि धारा की अपेक्षानुसार उन सभी व्यजियों की, जिनकी उससे प्रभाजित होने की सलभािना है,
िानकारी के जलए प्रकाजित ककए िाते हैं और सूचना िी िाती है कक उि प्रारूप जनयमों पर उस तारीख से, जिसको भारत
के रािपत्र में, यथाप्रकाजित, इस अजधसूचना की प्रजतयााँ िनता को उपलब्ध करा िी िाती हैं, तीस किन की समाजि के पश्चात
जिचार ककया िाएगा;
ऐसे आक्षेपों और सुझािों पर, िो तीस किन की पूिोि अिजध के समाि होने से पहले उि प्रारूप जनयम के संबंध में
ककसी व्यजि से प्राि हो सकेंगे, केंद्रीय सरकार द्वारा जिचार ककया िाएगा;
उि मसौिा जनयमों के संिभच में, आपजत्तयां तथा सुझाि संयुि सजचि (पािप संरक्षण), कृजि एिं ककसान कल्याण

(2) ये रािपत्र में इनके अंजतम प्रकािन की तारीख को प्रिृत्त होंगे।
2. कीटनािी जनयम, 1971 (इसमें इसके पश्चात उि जनयम कहा िाएगा) में,
(i) जनयम 10 के उप-जनयम 3 में जनम्नजलजखत परंतुक िोडा गया है:-
“बिते कक यकि जबक्री का स्ट्थान या जबक्री के जलए स्ट्टॉक एक से अजधक स्ट्थानों पर हो, तो लाइसेंस अजधकारी के
क्षेत्राजधकार में आने िाले सभी क्षेत्रों के जलए एक ही आिेिन ककया िाएगा और ऐसे सभी क्षेत्रों और प्रत्येक कीटनािक
के जलए एक ही लाइसेंस िारी ककया िाएगा।”
(ii) जनयम 10 के उप-जनयम (4) के खंड (iii) को इस प्रकार संिोजधत ककया िा सकता है:-
िहां लाइसेंस धारक लाइसेंस की अिजध के िौरान ककसी अजतररि कीटनािक को बेचना, स्ट्टॉक करना या जबक्री
के जलए प्रिर्िचत करना या जितररत करना चाहता है, तो िह उप-जनयम (2) में जनर्िचष्ट िुल्क के भुगतान पर लाइसेंस
पर अपेजक्षत अनुमोिन हेतु लाइसेंस अजधकारी को आिेिन कर सकता है।
इसके अजतररि, लाइसेंस धारक उप-जनयम (2) में जनर्िचष्ट िुल्क के भुगतान पर लाइसेंस अजधकारी के क्षेत्राजधकार
में आने िाले ककसी भी अजतररि जबक्री स्ट्थान या जबक्री के जलए स्ट्टॉक के अनुमोिन के जलए लाइसेंस अजधकारी को
आिेिन कर सकता है।
(iii) जनयम 10 के उप-जनयम (4क) के खंड (i) को इस प्रकार संिोजधत ककया िा सकता है:-
कीटनािकों के संचालन या जबक्री, भंडारण या जबक्री के जलए प्रििचन या जितरण हेतु लाइसेंस प्राि करने हेतु आिेिन
करने िाले प्रत्येक व्यजि को, उस प्रमुख व्यजि से फॉमच VI-डी का प्रमाण-पत्र प्रस्ट्तुत करना होगा जिसका िह
प्रजतजनजधत्ि करता है या करने की इच्छा रखता है।
इसके अजतररि, कीटनािकों के संचालन या जबक्री, भंडारण, या जबक्री के जलए प्रििचन या जितरण हेतु लाइसेंस प्राि
करने हेतु आिेिन के साथ नामांकन प्रमाण-पत्र भी िाजखल ककया िा सकता है, बिते नामांककत व्यजि उप-जनयम
(1क) [फॉमच II का पररजिष्ट I] के अंतगचत जिजहत िैक्षजणक अहचता रखता हो।
इसके अजतररि, उप-जनयम (4)(iii) के अंतगचत लाइसेंस से संबंजधत अनुमोिन हेतु आिेिन के साथ व्यजि नामांकन
प्रमाण-पत्र िाजखल कर सकता है, बिते नामांककत व्यजि के पास उप-जनयम (1क) [फॉमच II का पररजिष्ट I] के अंतगचत
जिजहत िैक्षजणक अहचता हो।
(iv) जनयम 10 के उप-जनयम (2) को इस प्रकार संिोजधत ककया िा सकता है –
उप-जनयम (1) के अंतगचत लाइसेंस प्रिान करने के जलए िेय िुल्क प्रत्येक कीटनािक के जलए पांच सौ रुपये होगा जिसके
जलए लाइसेंस अजधकतम सात हिार पांच सौ रुपये के अधीन है, आिेिन ककया गया है। यकि कोई कीटनािक एक से अजधक
स्ट्थानों पर बेचा, भंडार ककया िाता है या जबक्री के जलए प्रिर्िचत ककया िाता है, तो प्रत्येक स्ट्थान के जलए पृथक िुल्क होगा।
बिते कक घरेलू उपयोग के जलए सामान्य रूप से उपयोग ककए िाने िाले और इस प्रकार
पंिीकृत कीटनािकों के संबंध में िेय अजधकतम िुल्क प्रत्येक स्ट्थान के जलए सात हिार
पांच सौ रुपये होगा:
इसके अजतररि, यकि जबक्री का स्ट्थान ग्रामीण क्षेत्रों में स्ट्थाजपत ककया िाता है, तो िुल्क इस जनयम में जनर्िचष्ट िुल्क का
पांचिां जहस्ट्सा होगा।
परंतु, यकि लाइसेंस धारक लाइसेंस की अिजध के िौरान ककसी अजतररि कीटनािक को बेचना, भंडाररत करना, या जबक्री के
जलए प्रिर्िचत करना या जितररत करना चाहता है, या जबक्री के जलए कोई अजतररि स्ट्थान या जबक्री के जलए स्ट्टॉक स्ट्थाजपत
करना चाहता है, तो िह प्रत्येक कीटनािक के जलए एक सौ रुपये और सभी कीटनािकों के जलए अजधकतम िो हिार रुपये
के िुल्क के साथ लाइसेंससंग अजधकारी को लाइसेंस पर आिश्यक अनुमोिन के जलए आिेिन कर सकता है। साथ ही, यकि
अनुमोकित ककया िाने िाला जबक्री स्ट्थान ग्रामीण क्षेत्रों में स्ट्थाजपत है, तो िुल्क जनधाचररत िुल्क का पांचिां जहस्ट्सा होगा।
(v) अनुसूची I के पररजिष्ट के पश्चात पररजिष्ट I को िोडा िाएगा -

नोट 1: पररिार का अथच है:-
(i) पुरुि लाइसेंस धारक के मामले में, पत्नी, माता-जपता, बच्चे, नाबाजलग भाई, अजििाजहत बहनें, मृत पुत्र की जिधिा और
बच्चे, और यकि लाइसेंस धारक का कोई भी माता-जपता िीजित नहीं है, तो िािा-िािी।
(ii) मजहला लाइसेंस धारक के मामले में, पजत, माता-जपता, बच्चे, नाबाजलग भाई, अजििाजहत बहनें, मृत पुत्र की जिधिा
और बच्चे, और यकि लाइसेंस धारक का कोई भी माता-जपता िीजित नहीं है, तो िािा-िािी।
नोट 2: बच्चे का अथच िैध संतान है और इसमें गोि जलया हुआ बच्चा भी िाजमल है, यकि लाइसेंस धारक पर लागू व्यजिगत
कानून द्वारा गोि लेने को मान्यता प्राि है, िो लाइसेंस धारक के साथ रहता है और पररिार के सिस्ट्य के रूप में माना िाता
है, और जिसे लाइसेंस धारक ने एक जििेि िसीयत के माध्यम से स्ट्िाभाजिक रूप से िन्मे बच्चे के समान ििाच किया है।

NOTIFICATION
New Delhi, the 17th March, 2026
G.S.R. 190(E).—The following draft rules further to amend the Insecticides Rules, 1971, which the Central
Government proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of
1968), is hereby published, as required by the said section, for information of all persons likely to be affected thereby,
and notice is hereby given that the said draft rule shall be taken into consideration after the expiry of thirty days from
the date on which copies of this notification as published in the Gazette of India are made available to the public;
Objections or suggestions which may be received from any person in respect of the said draft rule before the
expiry of the aforesaid period of thirty days will be considered by the Central Government;
Objections or suggestions in respect to the said draft rule may be forwarded to the Joint Secretary (Plant
Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare, Krishi
Bhawan, New Delhi-110 001 or through email at muktanand.ias08@nic.in.
Draft Rules
1. Short Titles and commencement.- (1) These rules may be called the Insecticides (Amendment) Rules, 2026.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Insecticides Rules, 1971 (hereinafter referred to as the said rules),
(i) in sub-rule 3 of Rule 10 following proviso is inserted :-
“Provided that if the place of sale or stock for sale is at more than one place, a single application shall be
made for all such areas falling within the jurisdiction of the licensing officer and a single licence shall be
issued in respect of all such areas and for every insecticide.”
(ii) clause (iii) of sub-rule (4) of Rule 10 may be amended as -
Where the licensee wants to sell, stock or exhibit for sale or distribute any additional insecticides during the
currency of the licence, he may apply to the licensing officer for necessary endorsement on the licence on
payment of fees specified in sub-rule (2).
Further, the licensee may apply to the licensing officer for endorsement of any additional place of sale or
stock for sale falling within the jurisdiction of the licensing officer on payment of fees specified in sub-rule
(2).
(iii) clause (i) of sub-rule (4A) of Rule 10 may be amended as -
Every person shall along with his application for grant of a licence to undertake operation or sell, stock or
exhibit for sale or distribute Insecticides, file a certificate from the principal whom he represents or desires
to represent the Form VI-D.
Further, the person may along with his application for grant of a licence to undertake operation or sell, stock
or exhibit for sale or distribute Insecticides, file a nomination certificate provided the nominee holds the
education qualification as prescribed under sub-rule (1A) [Appendix I to Form II]
Further also, the person may along with his application for endorsement on a licence under sub-rule
(4)(iii) file a nomination certificate provided the nominee holds the education qualification as prescribed
under sub-rule (1A) [Appendix I to Form II]
(iv) sub-rule (2) of Rule 10 may be amended as -
The fee payable under sub-rule (1) for grant of a licence shall be rupees five hundred for every insecticide for
which the licence is applied subject to maximum rupees seven thousand five hundred. There shall be a separate
fee for each place, if any insecticide is sold, stocked or exhibited for sale at more than one place:
PROVIDED that the maximum fee payable in respect of insecticides commonly used for household purposes
and registered as such shall be rupees seven thousand five hundred for every place:
PROVIDED further that, if the place of sale is established in the rural areas, the fee shall be one fifth of the
fee specified in this rule.
PROVIDED further also where the licensee wants to sell, stock or exhibit for sale or distribute any additional
insecticides or wants any additional place of sale or stock for sale during the currency of the licence, he may

apply to the licensing officer for necessary endorsement on the licence on payment of fees of Rupees one
Hundred for every insecticide and a maximum of rupees two thousand for all insecticides for which
endorsement is applied. Also that if the place of sale to be endorsed is established in the rural areas the fee
shall be one-fifth of the specified fee.”
(v) Appendix I to be inserted after Appendix of Schedule I as -

Note 1: Family means:-
(i) in the case of a male licencee, the wife, parents, children, minor brothers, unmarried sisters, deceased son’s widow
and children and where no parent of the Licencee is alive a paternal grandparent.
(ii) In the case of a female Licencee, the husband, parents, children, minor brothers, unmarried sisters, deceased son’s
widow and children and where no parent of the Licencee is alive a paternal grandparent.
Note 2 : Child means legitimate child and includes an adopted child where adoption is recognized by the personal
law governing the Licencee who lives with the Licencee and is treated as a member of the family and to whom the
Licencee has, through a special will, given the same status as that of a natural born child.
