कृजि और ककसान कल्याण मंत्रालय (कृजि और ककसान कल्याण जिभाग) अजधसूचना नई किल्ली, 8 िुलाई, 2026 सा.का.जन. 597(अ) .—कीटनािी अजधजनयम, 1968 (1968 का 46) की धारा 36 द्वारा यथा अपेजित, कीटनािी जनयम, 1971 के प्ररूप जनयमों का और संिोधन करने के जलए, जिसे भारत के कृजि और ककसान कल्याण मंत्रालय (कृजि और ककसान कल्याण जिभाग) की अजधसूचना संख्या सा.का.जन. 855(अ), तारीख 18 निंबर, 2025 द्वारा भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i), तारीख 19 निंबर, 2025 में प्रकाजित ककया गया था, जिसमें ऐसे सभी व्यजियों से, जिनके इससे प्रभाजित होने की संभािना है, उस तारीख से, जिसको उि रािपत्र की प्रजतयां िनता को उपलब्ध करा िी गई थीं, से तीस किन के भीतर आिेप और सुझाि मांगे गए थे ; और, उि अजधसूचना की प्रजतयां तारीख 19 निंबर, 2025 को िनता को उपलब्ध करा िी गई थीं; और, उि प्ररूप जनयमों के संबंध में िनता से प्राप्त आपजियों या सुझािों पर केंद्रीय सरकार द्वारा जिचार कर जलया गया है; अतः अब, उि अजधजनयम की धारा 36 द्वारा प्रिि िजियों का प्रयोग करते हुए, केंद्रीय सरकार कीटनािी जनयम, 1971 को आगे संिोजधत करने के जलए जनम्नजलजखत जनयम बनाती है, अथाात्:-

1. संजिप्त नाम और प्रारंभ.— (1) इन जनयमों का संजिप्त नाम कीटनािी तृतीय (संिोधन) जनयम, 2026 है। (2) ये रािपत्र में उनके प्रकािन की तारीख को प्रिृि होंगे। सं. 539] नई किल्ली, बुधिार, िुलाई 8, 2026/आिाढ 17, 1948

2. कीटनािी जनयम, 1971 (जिसे इसमें इसके पश्चात् "उि जनयम" कहा गया है) के जनयम 4 में, खंड (ख) के पश्चात्, जनम्नजलजखत खंड अंतःस्ट्थाजपत ककया िाएगा, अथाात्:- "(ग) ककसी ऐसे व्यजि को आयात परजमट प्रिान करना िो ककसी कीटनािी को गैर-कीटनािी उपयोग के जलए आयात करने का इच्छुक हो।"
3. उि जनयमों में, अध्याय 3 के पश्चात्, जनम्नजलजखत अध्याय अंतःस्ट्थाजपत ककया िाएगा, अथाात्:- "अध्याय 3 क गैर-कीटनािी प्रयोिन के जलए कीटनािी के आयात की रीजत 8क. आयात की रीजत.— (1) ककसी कीटनािी के गैर-कीटनािी प्रयोिन के जलए आयात हेतु पंिीकरण सजमजत को प्ररूप I क में आिेिन ककया िाएगा। (2) उप-जनयम (1) के अधीन आिेिन के साथ मात्र पांच हिार रुपये की फीस संलग्न होगी। (3) पंिीकरण सजमजत के पास आिेिक द्वारा िी गई िानकारी का सत्यापन करने के जलए िांच करने की िजि होगी। (4) सभी प्रकार से पूणा आिेिन पर पंिीकरण सजमजत द्वारा अजधमानतः पैंतालीस किन की अिजध के भीतर जिचार ककया िाएगा और उसका जनपटान ककया िाएगा, जिसे आगे अजधकतम पंद्रह किन की अिजध तक बढाया िा सकता है। (5) उप-जनयम (4) के अधीन प्रिि आयात परजमट एक ििा के जलए िैध होगा। (6) यकि आिेिक के पास उस कीटनािी के जलए पंिीकरण प्रमाण-पत्र है जिसके जलए आयाजतत माल को कच्चे माल के रूप में उपयोग ककया िाना आिजयत है, तो आयात परजमट तीन ििा के जलए िैध होगा।"
4. उि जनयमों में, "पहली अनुसूची" में, "प्ररूप I" के पश्चात्, जनम्नजलजखत प्ररूप अंतःस्ट्थाजपत ककया िाएगा, अथाात्:- "प्ररूप I क गैर-कीटनािी उपयोग के जलए कीटनाजियों के आयात हेतु अनुज्ञा प्रिान करने के जलए आिेिन [जनयम 4(ग) िेजखए]

(क) क्या आयाजतत सामग्री घरेलू उपभोग, जनयाात या िोनों के जलए है: .......... (ख) यकि घरेलू उपभोग के जलए है तो संबंजधत औद्योजगक स्ट्िास्ट््य और सुरिा कायाालय द्वारा प्रमाजणत घोिणा कक जििािता से बचने के जलए आयाजतत कीटनािी को अन्य सभी सामग्री से अलग िेत्र में भंडाररत ककया िाएगा। (ग) यकि जनयाात के जलए है तो उस जििेिी िेता का नाम और पता जिसे तैयार उत्पाि जनयाात ककया िाना है, अजग्रम लाइसेंस की प्रजत संलग्न करते हुए, यकि लागू है । 12. यकि आयाजतत मात्रा (िम संख्या 9) और जिगत तीन ििों के औसत उपभोग (उपाबंध-3) के बीच अंतर 30 प्रजतित से अजधक है तो नई मात्रा के आयात के जलए नोडल मंत्रालय/जिभाग/राज्य उद्योग जिभाग का जिस्ट्तृत याथोजचत्य अपेजित है। 13. िय और उपभोग का जििरण:

रटप्पजणयां: (1) इस आिेिन में िहां कहीं भी संकेत किया गया हो, िहां प्रत्येक िस्ट्तािेज़ की प्रजत संलग्न करें। (2) सूचना 'िून्य' या 'लागू नहीं' होने पर भी प्रत्येक स्ट्तंभ भरें। (3) सूचना 'िून्य' होने पर भी सभी संगत उपाबंध संलग्न करें। (4) ऑनलाइन पोटाल पर सभी प्रकार से पूणा आिेिन प्ररूप प्राप्त होने से अजधमानतः 30 किन (पंिीकरण सजमजत की बैठक के अनुसार 4-6 सप्ताह) में समयबद्ध रीजत से कारािाई की िाएगी और जनणाय जलया िाएगा। (5) अपूणा आिेिन जबना पूिा सूचना के अस्ट्िीकृत ककए िाने के जलए िायी होगा। (6) कीटनाजियों/िीि-मारक के प्रमाजणत संिभा पिाथा या संिभा मानकों के 5 ग्राम या उससे कम मात्रा के यूजनट पैकों के आयात के जलए आयात परजमट अपेजित नहीं है।" [फा. सं. 13035/11/2019-पीपी-I] मुिानंि अग्रिाल, संयुि सजचि

MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 8th July, 2026 G.S.R. 597(E).—Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as required by section 36 of the Insecticides Act, 1968 (46 of 1968), vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture and Farmers Welfare) number G.S.R. 855 (E), dated the 18th November, 2025, and published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated the 19th November, 2025, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Official Gazette in which the said notification was published, were made available to the public; And whereas, copies of the said notification were made available to the public on 19th day of November, 2025; And whereas, objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 36 of the said Act, the Central Government hereby makes the following rules further to amend the Insecticides Rules, 1971, namely:-

1. Short title and Commencement.- (1) These rules may be called the Insecticides Third (Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Insecticides Rules, 1971 (hereinafter referred to as the said rules), in rule 4, after clause (b), the following clause shall be inserted, namely:- “(c) grant import permit to any person desirous to import an insecticide for non-insecticidal use.”.

3. In the said rules, after Chapter III, the following Chapter shall be inserted, namely:- “Chapter III A MANNER OF IMPORT OF AN INSECTICIDE FOR NON-INSECTICIDAL PURPOSE 8A. Manner of import.- (1) An application for import of an insecticide for non-insecticidal purpose shall be made to the Registration Committee in Form IA. (2) The application under sub-rule (1) shall be accompanied by a fee of rupees five thousand only. (3) The Registration Committee shall have the power to conduct an enquiry to verify the information furnished by the applicant. (4) An application which is complete in all respect shall be considered and disposed by the Registration Committee preferably within a period of forty-five days which may further extend to a period not later than fifteen days. (5) The import permit granted under sub-rule (4) shall be valid for one year. (6) If an applicant holds a certificate of registration for the pesticide for which the imported goods are intended to be used as raw material, the import permit shall be valid for three years.”.

Self-Certified Year-wise quantity of the insecticide imported and consumed during the last three years along with corresponding production of end- product. [ Please attach self-certified duly filled Proforma provided at S. No. 13 as Annexure III] 10. Self-Certified affidavit for the quantity requested with justification for first time application thereafter, verification of the claim as per Registration Committee decision. 11. (a) Whether the imported material is for Domestic consumption or export or both: .................... (b) If for domestic consumption then declaration certified by jurisdictional Industrial Health and Safety Office that the imported insecticide shall be stored in a separate area away from all other material to avoid poisoning. (c) If for export, name and address of foreign buyer to whom the finished product is to be exported, enclosing a copy of the advance license, if applicable. 12. In case, the difference between quantity imported (S.No.9) and average consumption during last three years (Annexure-III) is more than 30 percent, detailed justification of the Nodal Ministry/ Department/State Department of Industry is required to import fresh quantity. 13.
