सा.का.जन. 424(अ).— केन्द्रीय सरकार, आप्रवास और जविेजियों जवषयक अजधजनयम, 2025 (2025 का 13) की धारा 30 द्वारा प्रित्त िजियों का प्रयोग करते हुए, आप्रवास और जविेजियों जवषयक जनयम, 2025 का संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, अर्ाात्:-

1. संजिप्त नाम और प्रारंभ.- (1) इन जनयमों का संजिप्त नाम आप्रवास और जविेजियों जवषयक (संिोधन) जनयम, 2026 है । (2) ये रािपत्र में इनके प्रकािन की तारीख को प्रवृत्त होंगे ।

2. आप्रवास और जविेजियों जवषयक जनयम, 2025 (जिसे इसमें इसके पश्चात् उि जनयम कहा गया है), के जनयम 12 में,- (क) उपजनयम (1) में,- (i) तीसरे परंतुक में, “भारत में अपने आगमन के एक सौ अस्ट्सी दिन की समाजप्त के बाि चौिह दिनों के भीतर रजिस्ट्रीकरण कराना होगा” िब्िों के स्ट्र्ान पर “भारत में अपने आगमन के एक सौ अस्ट्सी दिन की उि अवजध के अवसान से पूवा दकसी भी समय रजिस्ट्रीकरण कराना होगा” िब्ि रखे िाएंगे; (ii) चौर्े परंतुक में, अंत में जनम्नजलजखत िब्ि अंत:स्ट्र्ाजपत दकए िाएंगे, अर्ाात्:- “,ककंतु ऐसा रजिस्ट्रीकरण केवल आपातकाल पररजस्ट्र्जतयों में ही अनुित्त दकया िाएगा” ; (ख) उपजनयम (2) में, जनम्नजलजखत परंतुक अंत:स्ट्र्ाजपत दकया िाएगा, अर्ाात्:- “परंतु की यह उपजनयम उन ििाओं में लागू नहीं होगा जिनमें माता-जपता में से कोई एक भारतीय नागररक है तर्ा ऐसा माता या जपता नागररकता अजधजनयम, 1955 (1955 का 57) की धारा 3 के अधीन बच्चे की भारतीय नागररकता रखने की इच्छा रखता है: परंतु यह और दक यदि बच्चा बाि में भारत में रहते हुए जविेि की नागररकता अर्िात कर लेता है, तो माता-जपता में से कोई भी बच्चे द्वारा जविेिी नागररकता अर्िात करने के तीस दिन के भीतर इस जस्ट्र्जत के बारे में रजिस्ट्रीकरण अजधकारी को सूजचत करेगा ।”।
3. उि जनयमों में, जनयम 18 के, उपजनयम (6) में “ककंतु चौबीस घंटे के अपश्चात्” िब्िों के स्ट्र्ान पर “ककंतु चौबीस घंटे के अपश्चात् नहीं” िब्ि रखे िाएंगे ।
4. उि जनयमों के जनयम 21 में, उपजनयम (5) के स्ट्र्ान पर जनम्नजलजखत उपजनयम रखे िाएंगे, अर्ाात्:- “(5) जसजवल प्राजधकारी द्वारा दिए गए जनिेि द्वारा व्यजर्त दकसी स्ट्वामी या रखवाला द्वारा अजधजनयम की धारा 14 की उपधारा (3) के अधीन ऐसे जनिेि की तारीख से तीस दिन की अवजध के भीतर आयुि, आप्रवास ब्यूरो को, जनयम 12 के उपजनयम (1) के खंड (ख) में यर्ा जनर्िाष्ट अजभजहत ऑनलाइन पोटाल के माध्यम से इलैक्ट्राजनक पद्धजत में अपील की िाएगी । (6) उपजनयम (5) के अधीन अपील की प्राजप्त पर, आयुि, आप्रवास ब्यूरो पिकार को सुनवाई का युजियुि अवसर प्रिान करने के पश्चात् तकाबद्ध आिेि पाररत करेगा तर्ा अपील की प्राजप्त की तारीख से सामान्द्यत: साठ दिन के भीतर कायावाजहयां पूणा करने का प्रयास करेगा । ”। [फा. सं. 25022/03/2025-एफ.I] जनतेि कुमार व्यास, अपर सजचव

MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 1st June, 2026 G.S.R. 424(E).— In exercise of the powers conferred by section 30 of the Immigration and Foreigners Act, 2025 (13 of 2025), the Central Government hereby makes the following rules to amend the Immigration and Foreigners Rules, 2025, namely:-

1. Short title and commencement. — (1) These rules may be called the Immigration and Foreigners (Amendment) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Immigration and Foreigners Rules, 2025 (hereinafter referred to as the said rules), in rule 12, — (a) in sub-rule (1), — (i) in the third proviso, for the words “within fourteen days after the expiry of one hundred and eighty days of his arrival in India”, the words “any time before the expiry of the said period of one hundred and eighty days” shall be substituted; (ii) in the fourth proviso, the following words shall be inserted at the end, namely:— “,but such registration shall be granted only in emergent circumstances”; (b) in sub-rule (2), the following provisos shall be inserted, namely :—

“Provided that this sub-rule shall not apply in cases wherein either of the parent is an Indian citizen and such parent wishes to retain the Indian citizenship of the child under section 3 of the Citizenship Act, 1955 (57 of 1955): Provided further that if the child acquires citizenship of a foreign country while in India at a later stage, either of the parents shall intimate the position to the Registration Officer within thirty days of acquiring the citizenship of the foreign country by the child.”. 3. In the said rules, in rule 18, in sub-rule (6), for the words “but beyond twenty-four hours”, the words “but not beyond twenty-four hours” shall be substituted. 4. In the said rules, in rule 21, for sub-rule (5), the following sub-rules shall be substituted, namely:- “(5) An appeal under sub-section (3) of section 14 of the Act by any owner or keeper aggrieved by the direction given by the civil authority shall be made to the Commissioner, Bureau of Immigration within thirty days from the date of such direction, in electronic mode through the designated online portal as referred to in clause (b) of sub-rule (1) of rule 12. (6) On receipt of the appeal under sub-rule (5), the Commissioner, Bureau of Immigration, after giving the party a reasonable opportunity of being heard, shall pass a reasoned order and endeavor to complete the proceedings ordinarily within sixty days from the date of receipt of the appeal.”.
