xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY नागर जिमानन मंत्रालय अजधसूचना नई दिल्ली, 17 फरिरी, 2026 सा.का.जन. 136(अ).— भारतीय िाययान अजधजनयम, 2024 (2024 का 16) की धारा 11, 12, 19, धारा 25 की उप-धारा (4) तथा धारा 30 और 33 द्वारा प्रित्त अजधकारों का प्रयोग करते हुए, केंद्रीय सरकार एतद्द्वारा िायुयान (िुर्घटनाओं और र्टनाओं का अन्िेषण) जनयम, 2025 में आगे संिोधन के जलए, कजतपय जनयमों का मसौिा, िैसा दक उक्त अजधजनयम की धारा 34 में अपेजित है, इससे प्रभाजित होने िाले सभी व्यजक्तयों की सूचना हेतु एतद्द्वारा प्रकाजित करती है तथा एतद्द्वारा सूचना िी िाती है दक उक्त मसौिा जनयमों को उस तारीख से पंद्रह दिनों की अिजध के बाि ध्यान में रखा िाएगा, जिस दिन भारत के रािपत्र, जिसमें यह अजधसूचना प्रकाजित की िाती है, की प्रजतयां िनसाधारण को उपलब्ध कराई िाती हैं; आपजत्तयां या सुझाि, यदि कोई हों, महाजनिेिक, िायुयान िुर्घटना अन्िेषण ब्यूरो, उडान भिन, अरबबंिो मागघ, नई दिल्ली -110003 को भेिे िा सक्ते हैं या dg.aaib-moca@gov.in या aaib.moca@nic.in को ई-मेल दकया िा सकता है; उपयुघक्त जनर्िघष्ट अिजध की समाजि से पहले उक्त मसौिा जनयमों के संबंध में दकसी भी व्यजक्त से प्राि दकसी भी आपजत्त या सुझाि पर केंद्र सरकार द्वारा जिचार दकया िाएगा।

1. (1) इन जनयमों को िायुयान (िुर्घटनाओं और र्टनाओं का अन्िेषण) (पहला संिोधन) जनयम, 2026 कहा िाएगा । (2) ये जनयम रािपत्र में उनके प्रकािन की तारीख से लागू होंगे ।
2. प्रस्ट्तािना के सिम खंड में, इन िब्िों अथाघत “अत:, अब, केंद्रीय सरकार भारतीय िायुयान अजधजनयम, 2024 (2024 का 16) की धारा 11, 12, 19, 30, 32 और 33 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए जनम्नजलजखत जनयम बनाती है, अथाघत्:

— ” िब्िों के स्ट्थान पर जनम्नजलजखत िब्ि प्रजतस्ट्थाजपत दकए िाएंगे, अथाघत् — “अत:, अब, केंद्रीय सरकार भारतीय िायुयान अजधजनयम, 2024 (2024 का 16) की धारा 11, 12, 19, 30, 32 और 33 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए तथा जिमान (िुर्घटनाओं और र्टनाओं की िांच) जनयम, 2017 को, ऐसे अजधक्रमण से पूिघ दकए गए या दकए िाने से रह गए कायों के संबंध में अपिाि रखते हुए, अजधक्रजमत करते हुए, केंद्रीय सरकार एति् द्वारा जनम्नजलजखत जनयम बनाती है, अथाघत्—” [फा. सं. 1245/201/2025-डीिी अनुभाग-एम.ओ.सी.ए] िोजभत गुिा, संयुक्त सजचि

टटप्पणी :— मूल जनयम भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में अजधसूचना संख्या िी.एस.आर. 829 (ई), दिनांक 7 निम्बर, 2025 के माध्यम से 10 निम्बर, 2025 को प्रकाजित दकए गए थे ।

MINISTRY OF CIVIL AVIATION NOTIFICATION New Delhi, the 17th February, 2026 G.S.R. 136(E).–– The following draft of certain rules further to amend the Aircraft (Investigation of Accidents and Incidents) Rules, 2025, which the Central Government proposes to make in exercise of the powers conferred by Sections 11, 12, 19, Sub-section (4) of Section 25, Sections 30 and 33 of the Bharatiya Vayuyan Adhiniyam, 2024 (16 of 2024), is hereby published as required by section 34 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after a period of fifteen days from the date on which copies of the Gazette of India, in which this notification is published, are made available to the public; Objections or suggestions, if any, may be addressed to the Director-General of Aircraft Accident Investigation Bureau, Udaan Bhawan, Aurobindo Marg, New Delhi-110003 or e-mailed to dg.aaib- moca@gov.in or aaib.moca@nic.in ; Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period specified above will be considered by the Central Government.

1. (1) These Rules may be called the Aircraft (Investigation of Accidents and Incidents) (First Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the enabling clause of the preamble, for the words "Now, therefore, in exercise of the powers conferred by sections 11, 12, 19, 30, 32 and 33 of the Bharatiya Vayuyan Adhiniyam, 2024 (16 of

2024. the Central Government hereby makes the following rules, namely: —", the following words shall be substituted,- "Now, therefore in exercise of the powers conferred by sections 11, 12, 19, 30, 32 and 33 of the Bharatiya Vayuyan Adhiniyam, 2024 (16 of 2024) and in supersession of the Aircraft (Investigation of Accidents and Incidents) Rules, 2017, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely:—".
