xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और रािमागग मंत्रालय अजधसूचना नई दिल् ली, 13 फरवरी, 2026 सा.का.जन. 131(अ).— अजखल भारतीय पयगटक यान (परजमट) जनयम, 2023 का संिोधन करने के जलए प्रारुप जनयम, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन यथापेजित, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना संखयांक सा.का.जन. 630 (अ) तारीख 12 जसतंबर, 2025 द्वारा प्रकाजित दकए गए थे, जिनमें ऐसे सभी व्यजियों से जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अंतर्वगष्ट करने वाली रािपत्र की प्रजतयां िनता को उपलब्ध करा िी गई थी, तीस दिन की अवजध की समाजि से पहले आिेप और सुझाव आमंजत्रत दकए गए थे; और उि रािपत्र की अजधसूचना की प्रजतयां 15 जसतंबर, 2025 को िनता को उपलब्ध करा िी गई थी; और उि प्रारुप जनयमों की बाबत िनता से प्राि आिेपों और सुझावों पर केंद्रीय सरकार द्वारा सम्यक् रुप से जवचार कर जलया गया है; अत: अब, केंद्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 88 की उपधारा (9) के साथ परित उपधारा (14) द्वारा प्रित्त िजियों का प्रयोग करते हुए, अजखल भारतीय पयगटक यान (परजमट) जनयम, 2023 का संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, अथागत् :- सं. 125] नई दिल्ली, िुक्रवार, फरवरी 13, 2026/माघ 24, 1947 No. 125] NEW DELHI, FRIDAY, FEBRUARY 13, 2026/MAGHA 24, 1947 सी.जी.-डी.एल.-अ.-16022026-270169 CG-DL-E-16022026-270169

1. संजिि नाम और प्रारंभ – इन जनयमों का संजिि नाम अजखल भारतीय पयगटक यान (परजमट) संिोधन जनयम, 2026 है । (2) ये 1 अप्रैल, 2026 से प्रवृत्त होंगे ।
2. अजखल भारतीय पयगटक यान (परजमट) जनयम, 2023 (जिसे इसमें इसके पश् चात् उि जनयम कहा गया है) के जनयम 2 के उपजनयम (1) में, - (क) खंड (ख) में, “जनयम 5” िब्ि और अंक के स्ट्थान पर, “जनयम 3” िब्ि और अंक रखा िाएगा; (ख) हहंिी पाि में संिोधन की आवश्यकता नहीं है; (ग) खंड (च) के पश् चात्, जनम् नजलजखत खंड अंत:स्ट्थाजपत दकया िाएगा, अथागत् :- ‘(छ) “असंित्त उपयोिा फीस” से राष्ट्रीय रािमागग के खंड के उपयोग के जलए मोटर यान द्वारा िेय उपयोिा फीस अजभप्रेत है, िहां इलैक्ट्राजनक टोल संग्रहण अवसंरचना ने ऐसे यान का गुिरना अजभजलजखत दकया है, ककंतु राष्ट्रीय रािमागग अजधजनयम, 1956 (1956 का 48) की धारा 7 और तद्धीन बनाए गए जनयमों के उपबंधों के अधीन उद्ग्रहीत लागू उपयोिा फीस प्राि नहीं की गई है ।’।
3. उि जनयमों के जनयम 3 के उपजनयम (2) में, “पररवहन प्राजधकारी” िब्िों के पहले “उस राज्य का’’ और “अजभप्रेत है,” िब्िों के पश्चात् ‘’िहां वह पयगटक यान, जिससे आवेिन संबंजधत है, रजिस्ट्रीकृत है” िब्ि अंत:स्ट्थाजपत दकए िाएंगे ।
4. उि जनयमों के जनयम 4 में, - (क) उपजनयम (1) के स्ट्थान पर, जनम्नजलजखत उपजनयम रखा िाएगा, अथागत् :- “(1) जनयम 3 के अधीन आवेिन की प्राजि पर पररवहन प्राजधकारी यह सुजनजश्चत करने के जलए इलैक्ट्राजनक रुप से िस्ट्तावेिों का जनरीिण कर सकेगा दक – (i.) यान के आवश्यक जवजधमान्य िस्ट्तावेि िैसे बीमा प्रमाणपत्र, योग्यता प्रमाणपत्र, प्रिूषण जनयंत्रणाधीन प्रमाणपत्र है और उस राज्य या संघ राज्यिेत्र में िहां यान रजिस्ट्रीकृत है द्वारा जवजहत कर संित्त कर दिया गया है और कोई उपयोिा फीस असंित्त् नहीं है; और (ii.) यथाजस्ट्थजत,पयगटक यान प्रचालक या उसके जनिेिक या भागीिार के पास आवश्यक जवजधमान्य िस्ट्तावेि िैसे आधार, या जनगजमत पहचान संखयांक या माल और सेवा कर रजिस्ट्रीकरण पहचान संखयांक हैं, जिससे यह सत्याजपत दकया िा सके दक ऐसे पयगटक यान प्रचालक का जनवास या कारबार का स्ट्थान उस राज्य में है िहां पयगटक यान रजिस्ट्रीकृत है ।”। (ख) उपजनयम (5) में, “बारह” िब्ि के स्ट्थान पर, “पंद्रह” िब्ि रखा िाएगा ।
5. उि जनयमों के जनयम 4 के पश्चात्, जनम्नजलजखत जनयम अंत:स्ट्थाजपत दकया िाएगा, अथागत, - “4क. अजखल भारतीय पयगटक परजमट से संलग्न साधारण ितें :-अजखल भारतीय पयगटक परजमट के जलए पयगटक यान हेतु जनम्नजलजखत िते होंगी दक पयगटक यान: (क) . गृह राज्य में या तो अपनी यात्रा आरंभ करेगा या अपनी यात्रा चक्कर लगाते हुए या अन्यथा समाि करेगा, ऐसी ितों के अध्यधीन रहते हुए दक यान गृह राज्य के बाहर साि दिन से अजधक की अवजध के जलए नहीं रहेगा और राज्य सरकार द्वारा कमांड और जनयंत्रण केंद्रों या राज्य द्वारा स्ट्थाजपत ऐसे अन्य केंद्रों या यान की अवजस्ट्थजत का पता लगाने वाली युजि जवजनमागताओं या राज्य सरकार द्वारा प्राजधकृत कोई अन्य अजभकरण के माध्यम से मॉनीटरी की िाएगी;

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ख) .स्ट्टेि कैररि के रूप में प्रचाजलत नहीं दकया िाएगा; (ग) . जनयम 10 के अधीन तैयार की गई पयगटकों की सूची में सजम्मजलत नहीं दकए गए याजत्रयों को ना तो सवार करेगा ना ही िहराएगा ; (घ) .केंद्रीय मोटरयान जनयम 1989 के जनयम 125 ि के उपजनयम (1) में जनर्िगष्ट यान की अवजस्ट्थजत का पता लगाने वाली युजि और आपात बटन से सजित दकया िाएगा; और (ङ) . केंद्रीय मोटर यान जनयम 1989 के जनयम 167 के उपजनयम 5 में यथाजवजनर्िगष्ट पैंतालीस दिन की समयावजध के परे अजधजनयम के अधीन अपराधों और उल्लंघनों से संबंजधत कोई चालान, चालान िारी होने की तारीख से नहीं होना चाजहए, जसवाय उस ििा में जिसमें राज्य सरकार द्वारा जवजनर्िगष्ट प्राजधकरण के समि पोटगल पर जिकायतों के जलए प्रजतवाि दकया गया हो । स्ट्पष्टीकरण :- इस जनयम के प्रयोिनों के जलए “गृह राज्य” से वह राज्य अजभप्रेत है जिसने अजखल भारतीय पयगटक परजमट अनुित्त दकया है ।”। 6. उि जनयमों के जनयम 10 में, - (क) पार्श्ग िीषगक में “पयगटकों” िब्ि के पश्चात् “और मागग की जवजिजष्टयां” िब्ि अंत:स्ट्थाजपत दकए िाएंगे; (ख) उपजनयम (1) के पश्चात, जनम्नजलजखत उपजनयम अतःस्ट्थाजपत दकया िाएगा, अथागत् :- “ (1क) अजखल भारतीय पयगटक परजमट के अधीन पयगटक यान चलाने वाला पयगटक यान प्रचालक ऐसे पयगटक यान के प्रस्ट्ताजवत मागग पर जस्ट्थत मूल स्ट्थान, गंतव्य स्ट्थान और राज्यों की जवजिजष्टयां, इलैक्ट्राजनक या भौजतक प्ररूप में सभी समय पर अपने पास रखेगा । यात्रा आरंभ होने से पहले दकसी समय गंतव्य स्ट्थान और मागग में उपांतररत दकया िा सकता है ।”। 7. उि जनयमों के प्ररूप 1 की सारणी में, - (i)“आवेिक का नाम” पंजि के पश्चात, जनम्नजलजखत पंजि अंत:स्ट्थाजपत की िाएगी अथागत, - “आवेिक का पता : (आधार यदि आवेिक व्यजष्ट है या जनगजमत पहचान संखयांक यदि आवेिक कंपनी है या दकसी अन्य ििा में माल और सेवा कर रजिस्ट्रीकरण पहचान संखयांक )।”।

(ii) स्ट्तंभ (6) में, “बैिने की िमता” िब्िों के स्ट्थान पर “बैिने या ियन की िमता, या इनका संयोिन” िब्ि रखे िाएंगे । 8. उि जनयमों के प्ररुप 2 के क्रम संखयांक 3 में, सारणी और उससे संबंजधत प्रजवजष्टयों के स्ट्थान पर, जनम्नजलजखत सारणी और प्रजवजष्टयां रखी िाएंगी, अथागत् :- “क्र. सं. यान का मेक रजिस्ट्रीकरण सं. योग्यता प्रमाणपत्र की तारीख अैर जवजधमान्यता बीमा की तारीख और जवजधमान्यता अब तक संित्त सड़क कर पहले रजिस्ट्रीकरण की तारीख बैिने या ियन की िमता या इनका संयोिन (1) (2) (3) (4) (5) (6) (7) (8)” ।

MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 13th February, 2026 G.S.R. 131(E).—Whereas, the draft rules to amend the All India Tourist Vehicles (Permit) Rules, 2023 were published as, required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways, vide number G.S.R. 630 (E), dated the 12th September, 2025 in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which copies of the Gazette of India containing the said notification was made available to the public; And, whereas, copy of the said Gazette notification was made available to the public on 15th September, 2025; And, whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of powers conferred by sub-section (14) read with sub-section (9) of section 88 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules to amend the All India Tourist Vehicles (Permit) Rules, 2023, namely:-

1. Short title and commencement —These rules may be called as the All India Tourist Vehicles (Permit) Amendment Rules, 2026. (2) They shall come into force with effect from 1st day of April, 2026.
2. In the All India Tourist Vehicles (Permit) Rules, 2023 (hereinafter referred to as the said rules), in rule 2, in sub-rule (1),— (a) in clause (b), for the word and figure “rule 5”, the word and figure “rule 3” shall be substituted; (b) in clause (f), for the words “the Act.”, the words “the Act;” shall be substituted; (c) after clause (f), the following clause shall be inserted, namely:- ‘(g) "unpaid user fee" means the user fee payable by a motor vehicle for use of a section of a National Highway, where the Electronic Toll Collection Infrastructure has recorded the passage of such vehicle but has not received the applicable user fee levied under the provisions of section 7 of the National Highways Act, 1956 (48 of 1956) and rules made thereunder.’.
3. In the said rules, in rule 3, in sub-rule (2), after the words “Transport Authority”, the words “of the State where the tourist vehicle to which the application relates is registered” shall be inserted.
4. In the said rules, in rule 4,— (a) for sub-rule (1), the following sub-rule shall be substituted, namely:— “(1) On receipt of an application under rule 3, the Transport Authority may inspect the documents electronically to ensure that— (i.) the vehicle has necessary valid documents such as certificate of insurance, certificate of fitness, Pollution Under Control Certificate and has paid the tax prescribed by the State or Union territory where the vehicle is registered and there is no unpaid user fee; and (ii.) the tourist vehicle operator or its director or a partner, as the case may be, has necessary valid documents such as Aadhaar or Corporate Identification Number or Goods and Service Tax Registration Identification number, to verify that such tourist vehicle operator has the residence or place of business in the State where the tourist vehicle is registered.”. (b) in sub-rule (5), for the word "twelve", the word "fifteen" shall be substituted.
5. In the said rules, after rule 4, the following rule shall be inserted, namely,— “4A. General conditions attached to All India Tourist Permits.— The following shall be the conditions for the tourist vehicle for All India Tourist Permit, that the tourist vehicle shall:

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (a). either commence its journey, or end its journey, circular or otherwise, in the home State, subject to the condition that the vehicle shall not remain outside the home State for a period of more than sixty days to be monitored by the State Government through the Command and Control Centres or such other centre setup by the State or vehicle location tracking device manufacturers or any other agency authorised by the State Government; (b). not be operated as a stage carriage; (c). not pick up or set down passengers not included in the list of tourists prepared under rule 10; (d). be fitted with a vehicle location tracking device and emergency button referred to in sub-rule (1) of rule 125H of the Central Motor Vehicles Rules, 1989; and (e). not have any challans related to offences and contraventions under the Act due beyond the time period of forty five days as specified in sub-rule (5) of rule 167 of the Central Motor Vehicles Rules, 1989 from the date of issuance of the challan, except in cases contested for redressal on the portal before the authority specified by the State Government. Explanation.— For the purposes of this rule, “home State” means the State which has granted the All India Tourist Permit.”. 6. In the said rules, in rule 10,— (a) in the marginal heading, after the word “tourists”, the words “and particulars of the route” shall be inserted; (b) after sub-rule (1), the following sub-rule shall be inserted, namely:— “(1A) A tourist vehicle operator plying a tourist vehicle under the All India Tourist Permit, shall at all times carry in electronic or physical form, the particulars of the point of origin, the destination and the States lying on the proposed route of such tourist vehicle. The destination and the route may be modified at any stage, before commencement of journey.”. 7. In the said rules, in Form 1, in the table,— (i) after the row “Name of the applicant”, the following row shall be inserted, namely,— “Address of the applicant: (Aadhaar in case the applicant is an individual or Corporate Identification Number in case the applicant is a company or Goods and Service Tax Registration Identification Number in any other case).”.

” (ii) in column (6) for the words "Seating capacity", the words "Seating or sleeper capacity, or combination thereof" shall be substituted. 8. In the said rules, in Form 2, in serial no. 3 for the table and entries thereto, the following table and entries shall be substituted, namely:-
