सा.का.जन. 474(अ).— चूूँदक केंद्र सरकार को आवश्यक वस्ट्तु अजधजनयम, 1955 (1955 का 10) की धारा 3 के तहत आवश्यक वस्ट्तुओं के उत्पािन, प्रिाय और जवतरण तथा उनके व्यापार और वाजणज्य को जवजनयजमत या प्रजतबंजधत करने का अजधकार है, जिससे उनकी प्रिाय बनाए रखी िा सके या बढाई िा सके और उजचत कीमतों पर उनका समान जवतरण और उपलब्धता सुजनजित की िा सके; और चूूँदक केंद्र सरकार ने आवश्यक वस्ट्तु अजधजनयम, 1955 की धारा 3 द्वारा प्रित्त िजियों का प्रयोग करते हुए,सावविजनक िीवन, अथव्य वस्ट्था तथा उपभोिाओं के जहतों के संरक्षण के जलए पेरोजलयम पिाथों के उत्पािन, भंडारण और प्रिाय को जवजनयजमत करने के उद्देश्य से पेरोजलयम उत्पाि (उत्पािन, भंडारण और प्रिाय का रखरखाव) आिेि, 1999 िारी दकया था; और चूूँदक केंद्र सरकार ने आवश्यक वस्ट्तु अजधजनयम, 1955 की धारा 3 द्वारा प्रित्त िजियों का प्रयोग करते हुए, मोटर जस्ट्पररट (एमएस) और उच वेग डीिल (एचएसडी) की प्रिाय और जवतरण को जवजनयजमत करने और उनसे संबंजधत अनाचारों को रोकने के जलए मोटर जस्ट्पररट और उच वेग डीिल (प्रिाय और जवतरण का जवजनयमन और अनाचार जनवारण) आिेि, 2005 िारी दकया था; सं. 424] नई दिल्ली, बृहस्ट् पजतवार, िून 11, 2026/ज् येष् ठ 21, 1948

और चूूँदक मोटर जस्ट्पररट और उच वेग डीिल आवश्यक वस्ट्तुएं हैं और माल और याजत्रयों के पररवहन, कृजि संबंधी कायों, आपातकालीन सेवाओं, राष्ट्रीय सुरक्षा और सावविजनक िीवन तथा अथव्य वस्ट्था के जलए िरूरी अन्य महत्वपूणव गजतजवजधयों के जलए उजचत कीमतों पर इनकी जनबावध उपलब्धता अत्यंत आवश्यक है; और चूूँदक िुजनया के कुछ क्षेत्रों को प्रभाजवत करने वाली वतवमान भू-रािनीजतक जस्ट्थजत अंतरराष्ट्रीय पेरोजलयम प्रिाय श्ृंखलाओं, जिपपंग लॉजिजस्ट्टक्स और पेरोजलयम उत्पािों की उपलब्धता पर प्रजतकूल प्रभाव डाल रही है, जिससे उपलब्ध प्रिाय के जववेकपूणव प्रबंधन और संरक्षण की आवश्यकता है और ऐसी अप्रत्याजित जस्ट्थजतयों से औपचाररक तरीके से जनपटने की आवश्यकता उत्पन्न हुई है; और चूूँदक वतवमान जस्ट्थजत में यह िेखा गया है दक औद्योजगक, वाजणजज्यक और संस्ट्थागत उपभोिाओं का खुिरा और थोक जबक्री कीमतों के बीच अंतर के कारण खुिरा जबक्री केंद्रों की ओर रुख करने के कारण िेि के कुछ जहस्ट्सों में खुिरा जबक्री केंद्रों के माध्यम से मोटर जस्ट्पररट और उच वेग डीिल की जबक्री में असामान्य वृजि हुई है, जिसके पररणामस्ट्वरूप खुिरा उपभोिाओं के जलए लजक्षत प्रिाय का जवपथन हो रहा है और स्ट्थानीय स्ट्तर पर कमी तथा िनसामान्य के जलए आवश्यक सेवाओं में व्यवधान की संभावना पैिा हो रही है; और चूूँदक खुिरा जबक्री केन्द्रों के माध्यम से इस तरह की भारी मात्रा में अजधप्राजि से असली खुिरा ग्राहकों के जलए मोटर जस्ट्पररट और उच वेग डीिल की उपलब्धता पर प्रजतकूल प्रभाव पड़ सकता है और इससे िमाखोरी, जवपथन और अनाचार हो सकता है; और चूूँदक केंद्र सरकार इस बात से संतुष्ट है दक िनजहत में मोटर जस्ट्पररट और उच वेग डीिल की प्रिाय , जवतरण और जबक्री को उजचत कीमतों पर जवजनयजमत करना आवश्यक है तादक उनकी न्यायोजचत उपलब्धता सुजनजित की िा सके, उन्हें िूसरी िगह ले िाने और िमाखोरी से रोका िा सके और पूरे िेि में प्रिाय जनबावध बनी रहे; अतएव, आवश्यक वस्ट्तु अजधजनयम, 1955 (1955 का 10) की धारा 3 द्वारा प्रित्त िजियों का प्रयोग करते हुए, मोटर जस्ट्पररट और उच वेग डीिल (प्रिाय और जवतरण का जवजनयमन और अनाचार जनवारण) आिेि, 2005 के खंड 9 के साथ परठत एवं पेरोजलयम उत्पाि (उत्पािन, भंडारण और प्रिाय का रखरखाव) आिेि, 1999 के के उद्देश्यों की पूर्तव में, केंद्र सरकार एतद्द्वारा जनम्नजलजखत आिेि िारी करती है, नामत:—

1. संजक्षि िीिवक और प्रारंभ (1) इस आिेि का नाम मोटर जस्ट्पररट और उच वेग डीिल (खुिरा जवक्रय केंद्रों के माध्यम से प्रिाय का अस्ट्थायी जवजनयमन) आिेि, 2026 होगा। (2) यह रािपत्र में इसके प्रकािन की जतजथ से प्रवृत्त होगा।
2. पररभािा इस आिेि में उल्लेजखत िब्ि और वाक्यांि जिन्हें यहाूँ पररभाजित नहीं दकया गया है, लेदकन िो 'मोटर जस्ट्पररट और उच वेग डीिल (प्रिाय और जवतरण का जवजनयमन और अनाचार जनवारण) आिेि, 2005' में पररभाजित दकया गया हैं, उनका अथव क्रमिः वही होगा िो उस आिेि में उल्लेख दकया गया है।
3. खुिरा जबक्री केंद्र के माध्यम से एमएस/ एचएसडी की अजधप्राजि की मात्रा पर प्रजतबंध चूंदक केंद्र सरकार इस बात से संतुष्ट है दक मोटर जस्ट्पररट और उच वेग डीिल की प्रिाय बनाए रखने और उजचत मूल्यो पर इनके न्यायोजचत जवतरण और उपलब्धता को सुजनजित करना िनजहत में आवश्यक और उजचत है, इसजलए सावविजनक क्षेत्र की तेल जवपणन कंपजनयों (ओएमसी) अथवा पेरोजलयम और प्राकृजतक गैस मंत्रालय द्वारा िारी संकल्प सं पी- 23015/1/2001- जवपणन दिनाक 8 माचव, 2002 और पी-12029(11)/2/2018- ओएमसी-पीएनिी दिनाक 8 नवंबर,

2019 के तहत पररवहन ईंधन के जवपणन के जलए प्राजधकृत कंपजनयों अथवा िोनों को वह सामान्य अथवा जविेि आिेि के माध्यम से जनम्नजलजखत जनिेि िारी कर सकती है:

1. संस्ट्थागत और प्रत्यक्ष अथवा औद्योजगक और व्यावसाजयक ग्राहक, खुिरा जबक्री केंद्र से एमएस और/या एचएसडी नहीं खरीिेंगे या नहीं मंगवाएंगे और अपनी एमएस / एचएसडी की आवश्यकताओ को केवल अपने उपभोिा पंप से ही पूरी करेंगे।
2. खुिरा जबक्री केंद्र एचएसडी केवल वाहनों के टैंक अथवा पेसो (PESO) से अनुमोदित कंटेनर में ही जबक्री करेंगे और एक दिन में एक ग्राहक/वाहन को 200 लीटर से ज़्यािा एचएसडी जबक्री नहीं करेंगे । ऐसे ग्राहक इस एचएसडी की पुनः जबक्री नहीं कर सकते हैं।
3. तेल जवपणन कंपजनयाूँ तथा खुिरा जवक्रय केंद्र डीलर धारा 3 के अधीन लगाए गए प्रजतबंधों का अनुपालन सुजनजित करेंगे तथा उनके उल्लंघन को रोकेंगे।
4. इस प्रावधान के तहत कोई भी आिेि िारी होने की जतजथ से अजधकतम 90 दिनों की प्रारंजभक वैधता के जलए या दकसी अन्य आिेि द्वारा रद्द दकए िाने तक, िो भी पहले हो, िारी दकया िा सकता है। इसके अजतररि, यदि आिेि अपनी समाजि से पहले रद्द नहीं दकया िाता है, तो उसे लागू रखने के जलए दकसी अन्य आिेि द्वारा उसका जवस्ट्तार करना होगा और वह जवस्ट्तार आिेि में जनधावररत अवजध तक वैध रहेगा।

4. छूट सरकार जविेि आिेि द्वारा दकसी भी उपभोिा, उपभोिा वगव, क्षेत्र, लेनिेन या लेनिेन की श्ेणी को इस आिेि के सभी या दकसी भी प्रावधान से छूट िे सकती है।
5. तलािी और अजधग्रहण की िजि यथाजस्ट्थजत, केंद्र सरकार अथवा राज्य सरकार द्वारा साधारण या जविेि आिेि द्वारा सम्यक रूप से प्राजधकृत केंद्र सरकार या राज्य सरकार का कोई रािपत्रत अजधकारी या पुजलस अजधकारी िो पुजलस उप-अधीक्षक के पि से नीचे का न हो या तेल कंपनी का कोई अजधकारी िो सेल्स ऑदिसर के पि से नीचे का न हो, इस आिेि के प्रावधानों का अनुपालन सुजनजित करने के जलए मोटर जस्ट्पररट और उच वेग डीिल (प्रिाय और जवतरण का जवजनयमन और अनाचार जनवारण) आिेि, 2005 में उसे सौंपे गए तलािी और अजधग्रहण संबंजधत अजधकार प्राि होंगे।
6. राज्य सरकारों और केंद्र िाजसत प्रिेिों के प्रिासनों को जनिेि राज्य सरकारें और केंद्र िाजसत प्रिेि प्रिासन इस आिेि को लागू करने के जलए आवश्यक वस्ट्तु अजधजनयम, 1955, मोटर जस्ट्पररट और उच वेग डीिल (प्रिाय और जवतरण का जवजनयमन और अनाचार जनवारण) आिेि, 2005 और अन्य लागू कानूनों के तहत मोटर जस्ट्पररट और उच वेग डीिल से संबंजधत िमाखोरी, कालाबािारी, अनजधकृत अजधप्राजि, जवपथन और अन्य अनाचारों के जवरुि कारवाई सजहत सभी आवश्यक उपाय करेंगे l
7. िुमावना इस आिेि के प्रावधानों अथवा इसके तहत िारी जनिेिों का कोई भी उल्लंघन आवश्यक वस्ट्तु अजधजनयम, 1955 और अन्य लागू कानूनों के प्रावधानों के अनुसार िंडनीय होगा।

MINISTRY OF PETROLEUM AND NATURAL GAS NOTIFICATION New Delhi, the 11th June, 2026

G.S.R. 474(E).— Whereas the Central Government is empowered under Section 3 of the Essential Commodities Act, 1955 (10 of 1955), to regulate or prohibit the production, supply and distribution of essential commodities and trade and commerce therein for maintaining or increasing supplies thereof and for securing their equitable distribution and availability at fair prices; And whereas the Central Government, in exercise of the powers conferred by Section 3 of the Essential Commodities Act, 1955, issued the Petroleum Products (Maintenance of Production, Storage and Supply) Order, 1999 to regulate the production, storage and supply of petroleum products in the interest of sustaining public life, economy and protecting consumer interest; And whereas the Central Government, in exercise of the powers conferred by Section 3 of the Essential Commodities Act, 1955, issued the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Order, 2005 to regulate the supply and distribution of Motor Spirit (MS) and High Speed Diesel (HSD) and prevent malpractices relating thereto; And whereas Motor Spirit and High Speed Diesel are essential commodities and uninterrupted availability thereof at fair prices is critical for transportation of goods and passengers, agricultural operations, emergency services, national security and other activities vital to public life and the economy; And whereas the current prevailing geopolitical situation affecting certain regions of the world has adversely affecting international petroleum supply chains, shipping logistics and availability of petroleum products necessitates prudent management and conservation of available supplies and raises the need to deal with such unpredictable situations in a formal manner; And whereas it has been observed in current situation that abnormal increases in sales of Motor Spirit and High Speed Diesel through Retail Outlets in certain parts of the country are driven by shifting of industrial, commercial and institutional consumers to Retail Outlets owing to the price difference between retail and bulk sale prices, resulting in diversion of supplies intended for retail consumers and creating the potential for localised shortages and disruption of essential services to common man; And whereas such bulk procurement through Retail Outlets has the potential to adversely affect the availability of Motor Spirit and High-Speed Diesel for bona fide retail consumers and may lead to hoarding, diversion and other malpractices; And whereas the Central Government is satisfied that it is necessary in the public interest to regulate the supply, distribution and sale of Motor Spirit and High-Speed Diesel at fair prices so as to ensure their equitable availability, prevent diversion and hoarding and maintain uninterrupted supplies across the country; Now, therefore, in exercise of the powers conferred by Section 3 of the Essential Commodities Act, 1955 (10 of 1955), read with clause 9 of the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Order, 2005 and in furtherance of the Petroleum Products (Maintenance of Production, Storage and Supply) Order, 1999, the Central Government hereby makes the following Order, namely:—

1. Short title and commencement (1) This order may be called the Motor Spirit and High Speed Diesel (Temporary Regulation of Supply through Retail Outlets) Order, 2026. (2) It shall come into force on the date of its publication in the Official Gazette.
2. Definitions In this order words and expressions used herein and not defined but defined in the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Order, 2005 shall have the meanings respectively assigned to them in that Order.
3. Restriction on the quantity of procurement of MS/HSD through Retail Outlets Whereas the Central Government is satisfied that it is necessary and expedient in the public interest for maintaining supplies of Motor Spirit and High Speed Diesel and securing their equitable distribution and availability at fair prices, it may, by general or special order, issue the following directions to Public sector Undertaking Oil Marketing Companies (OMCs) or any other entity authorised under Resolutions Number P-23015/1/2001-Mkt. dated 8th March, 2002 and P- 12029(11)/2/2018-OMC-PNG dated 8th November, 2019, issued by the Ministry of Petroleum and Natural Gas to market transportation fuels or to both :

1. Institutional & Direct or Industrial & Commercial customers shall not procure or cause to be procured MS and/or HSD from Retail Outlets and shall only source their MS/HSD requirements from their own consumer pumps.
2. Retail Outlet dealers shall dispense HSD only in a vehicle tank, or PESO-approved containers, and not exceeding 200 litres in a day to a customer/vehicle and this HSD cannot be resold.
3. Oil Marketing Companies and Retail Outlet Dealers shall ensure compliance with the restrictions imposed under section 3 and prevent its circumvention.
4. Any order issued under this provision can be issued only for an initial validity period not exceeding 90 days from the date of issue or till revoked by another order, whichever is earlier. Further, if the order is not revoked prior to its expiry, then for it to remain in force beyond the initial period, it shall have to be extended by another order, and it shall remain valid for a period as may be prescribed in the extension order.
5. Exemptions The Government may by a special order exempt any consumer, class of consumers, area, transaction, or category of transactions from all or any of the provisions of this Order.
6. Power of Search and Seizure Any Gazetted officer of the Central Government or a State Government or any police officer not below the rank of Deputy Superintendent of Police duly authorised, by general or special order of the Central Government or a State Government, as the case may be, or any officer of the oil company, not below the rank of sales officer, may, with a view to securing compliance with the provisions of this Order, shall have the powers of search and seizure assigned to it in the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Order,
7. 6. Directions to State Governments and Union Territory Administrations The State Governments and Union Territory Administrations shall take all necessary measures to implement this order, including action against hoarding, black marketing, unauthorised procurement, diversion and other malpractices relating to Motor Spirit and High-Speed Diesel under the Essential Commodities Act, 1955, the Motor Spirit and High Speed Diesel (Regulation of Supply, Distribution and Prevention of Malpractices) Order, 2005 and other applicable laws.
8. Penalty Any contravention of the provisions of this Order or directions issued thereunder shall be punishable in accordance with the provisions of the Essential Commodities Act, 1955 and other applicable laws.
