सा.का.नि. 146(अ).— गैस सिलेंडर नियम, 2016 का संशोधन करने के लिए निम्नलिखित नियमों का प्रारूप, जिसे केन्द्रीय सरकार, विस्फोटक अधिनियम, 1884 (1884 का 4) की धारा 5 और 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती है, ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है, उक्त अधिनियम की धारा 18 की उप-धारा (1) की अपेक्षानुसार प्रकाशित किया जाता है; और यह सूचना भी दी जाती है कि उक्त प्रारूप नियम पर, उस तारीख से जिसको राजपत्र में प्रकाशित अधिसूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, तीस (30) दिन के पश्चात् विचार किया जाएगा;

इन प्रारूप नियमों पर आपत्तियां अथवा सुझाव, यदि कोई हों, निर्दिष्ट अवधि के भीतर निदेशक (विस्फोटक), उद्योग संवर्धन और आंतरिक व्यापार विभाग, वाणिज्य और उद्योग मंत्रालय को कक्ष संख्या 252-ए, उद्योग भवन, नई दिल्ली-110001 अथवा ई-मेल: expl-dipp@nic.in; पर भेजे जा सकते हैं;
उक्त प्रारूप नियमों के संबंध में किसी भी व्यक्ति से निर्दिष्ट अवधि के भीतर प्राप्त होने वाली आपत्तियों या सुझावों पर केंद्र सरकार द्वारा विचार किया जाएगा।
प्रारूप नियम
संक्षिप्त नाम और प्रारम्भ- (1) इन नियमों को गैस सिलेंडर (संशोधन) नियम, 2026 कहा जाएगा। (2) ये राजपत्र में इनके अंतिम रूप से प्रकाशन की तारीख को प्रवृत्त होंगे।
गैस सिलेंडर नियम, 2016 (जिसे इसमें इसके पश्चात उक्त नियम कहा जाएगा) के नियम 48 को हटा दिया जाएगा;
उक्त नियमों के प्रपत्र-ग में, प्रपत्र 'ङ', 'च' और 'छ' में लाइसेंस के लिए इस आवेदन के साथ जमा किए जाने वाले आवश्यक दस्तावेज शीर्षक के तहत आने वाले खंड (vi) को हटा दिया जाएगा;
उक्त नियमों के प्रपत्र-च के, शर्त 8 में, खंड (iv) के बाद, निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्:-
"बशर्ते कि औद्योगिक गैस सिलेंडरों के लिए लाइसेंससंग प्राधिकार द्वारा उच्च स्टैकिंग और कम गैंगवे की अनुमति दी जा सकती है, यदि सिलेंडरों को पर्याप्त स्ट्रैप, क्लिप या इंटरलॉक के साथ प्रमाणित संरचनाबद्ध पैकंग (रैक, केज) में पैक किया जाता है ताकि सिलेंडर, की सुरक्षा (इंटीग्रिटी) सुनिश्चित हो सके, इसकी फिटिंग और सिलेंडरों की उचित गतिशीलता इन प्रमाणित संरचनाबद्ध पैकंग से सुनिश्चित होती है। लोडिंग अनलोडिंग की प्रक्रिया राष्ट्रीय या अंतरराष्ट्रीय संहिता के अनुरूप होगी।" [फा. सं. पी-13033/32/2021-विस्फोटक-भाग(1)] जय प्रकाश शिवहरे, संयुक्त सचिव

G.S.R. 146(E).— The draft of the following rules to amend the Gas Cylinders Rules, 2016 which the Central Government proposes to make, in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884), is hereby published as required by sub-section (1) of section 18 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft shall be taken into consideration after Thirty (30) days from the date on which the copies of this notification as published in the Official Gazette are made available to the public;
Objections or suggestions, if any, to these draft rules may be sent to the Director (Explosives), Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Room No. 252 ‘A’, Udyog Bhavan, New Delhi – 110001 or Email: expl-dipp@nic.in; within the period specified above.
