xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY वाजणज्य और उद्योग मंत्रालय (वाजणज्य जवभाग) अजधसूचना नई दिल्ली, 20 िुलाई, 2026 सा.का.जन. 669(अ).— केंद्रीय सरकार, चाय अजधजनयम, 1953 (1953 का 29) की धारा 49 की उप-धारा (2) के खंड (xक) द्वारा प्रित्त िजियों का प्रयोग करते हुए, चाय (िांच करना और अपील) जनयम, 2024 में संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, अर्ाात्: — 1. संजिप्त नाम और प्रारंभ -(1) इन जनयमों का संजिप्त नाम चाय (िांच करना और अपील) संिोधन जनयम, 2026 है। (2) ये जनयम रािपत्र में उनके प्रकािन की तारीख से प्रवृत्त होंगे। 2. चाय (िांच करना और अपील) जनयम, 2024 (जिसे इसमें इसके पश्चात उि जनयम कहा गया है) में, जनयम 3 में— (i) उप-जनयम (1) में, "न्यायजनणायन के प्रयोिन" िब्िों के स्ट्र्ान पर, "चेतावनी पत्र िारी करने या न्यायजनणायन के प्रयोिनों" िब्ि रखे िाएंगे; (ii) उप-जनयम (8) के पश्चात, जनम्नजलजखत उप-जनयम अंत:स्ट्र्ाजपत दकया िाएगा, अर्ाात्: - “(8क) उप-जनयम 8 में अंतर्वाष्ट दकसी बात के होते हुए भी, यदि दकसी व्यजि ने अजधजनयम की धारा 37 के अंतगात उपबंधों का उल्लंघन दकया है, तो न्यायजनणाय अजधकारी प्रर्म घटना पर चेतावनी पत्र िारी करेगा, और पुनरावती उल्लंघन की जस्ट्र्जत में, वह िाजस्ट्त अजधरोजपत कर सकता है जिसे एक लाख रुपये तक बढाया िा सकता है ।” (iii) उप-जनयम (9) के स्ट्र्ान पर जनम्नजलजखत उप-जनयम रखा िाएगा, अर्ाात्:- सं. 607] नई दिल्ली, सोमवार, िुलाई 27, 2026/श्रावण 5, 1948

MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) NOTIFICATION New Delhi, the 20th July, 2026 G.S.R. 669 (E).— In exercise of the powers conferred by clause (xa) of sub-section (2) of section 49 of the Tea Act, 1953 (29 of 1953), the Central Government hereby makes the following rules to amend the Tea (Holding Inquiry and Appeal) Rules, 2024, namely: —
- Short title and commencement. -(1) These rules may be called the Tea (Holding Inquiry and Appeal) Amendment Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette.
- In the Tea (Holding Inquiry and Appeal) Rules, 2024 (hereinafter referred to as the said rules), in rule 3— (i) in sub-rule (1), for the words "purpose of adjudication", the words "purposes of issuing a warning letter or adjudication" shall be substituted; (ii) after sub-rule (8), the following sub-rule shall be inserted, namely: - "(8A) Notwithstanding anything contained in sub-rule 8, if the person has committed a contravention of provisions under section 37 of the Act, the adjudicating officer shall issue a warning letter at the first instance, and in case of subsequent contravention, he may impose a penalty which may extend to one lakh rupees."; (iii) for sub-rule (9), the following sub-rule shall be substituted, namely:- “(9) Every order made under sub-rules (8) or (8A), as the case may be, shall specify the provision of the Act in respect of which contravention has been committed and shall contain the reasons for issuing the warning letter or imposing the penalty.”.
- In the said rules, in Form-I, in paragraph 2, for the words "imposition of penalty", the words "issuing a warning letter or imposition of penalty" shall be substituted.
