L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY वाजणज्य और उद्योग मंत्रालय (उद्योग संवधधन और आंतररक व्यापार जवभाग) अजधसूचना नई दिल्ली, 19 फरवरी, 2026 सा.का.जन. 143(अ).––जवस्ट्फोटक जनयम, 2008 का संिोधन करने के जलए जनम्नजलजखत जनयमों का प्रारूप, जिसे केन्द्रीय सरकार, जवस्ट्फोटक अजधजनयम, 1884 (1884 का 4) की धारा 5 और 7 द्वारा प्रित्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताव करती है, ऐसे सभी व्यजियों की िानकारी के जलए, जिनके उससे प्रभाजवत होने की संभावना है, उि अजधजनयम की धारा 18 की उप-धारा (1) की अपेक्षानुसार प्रकाजित दकया िाता है; और यह सूचना िी िाती है दक उि प्रारूप जनयम पर, उस तारीख से जिसको रािपत्र में प्रकाजित अजधसूचना की प्रजतयां िनता को उपलब्ध करा िी िाती हैं, तीस (30) दिन के पश्चात् जवचार दकया िाएगा; इन प्रारूप जनयमों पर आपजत्तयां अथवा सुझाव, यदि कोई हों, जनर्िधष्ट अवजध के भीतर जनिेिक (जवस्ट्फोटक), उद्योग संवधधन और आंतररक व्यापार जवभाग, वाजणज्य और उद्योग मंत्रालय को कक्ष संख्या 252-ए, उद्योग भवन, नई दिल्ली-110001 अथवा ई-मेल: expl-dipp@nic.in; पर भेिे िा सकते हैं; उि प्रारूप जनयमों के संबंध में दकसी भी व्यजि से जनर्िधष्ट अवजध के भीतर प्राप्त होने वाली आपजत्तयों या सुझावों पर केंर सरकार द्वारा जवचार दकया िाएगा। 1. (1) इन जनयमों को जवस्ट्फोटक (संिोधन) जनयम, 2026 कहा िाएगा। (2) ये रािपत्र में इनके अंजतम रूप से प्रकािन की तारीख को प्रवृत्त होंगे। सं. 137] नई दिल्ली, बुधवार, फरवरी 25, 2026/फाल् गुन 6, 1947 No. 137] NEW DELHI, WEDNESDAY, FEBRUARY 25, 2026/PHALGUNA 6, 1947 सी.जी.-डी.एल.-अ.-26022026-270494 CG-DL-E-26022026-270494 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. जवस्ट्फोटक जनयम, 2008 (जिसे इसमें इसके पश्चात उि जनयम कहा िाएगा) के जनयम 2 में: (क) खंड (15) के पश्चात, जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथाधत:– ‘(15क)“रक्षा जवस्ट्फोटक” का आिय ऐसे जवस्ट्फोटक से है िो रक्षा क्षेत्र के जलए है और जिसका जवजनमाधण जनिी जवजनमाधता द्वारा दकया िाता है’; (ख) खंड (35क) के पश्चात, जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथाधत:– ‘(35ख)“सूक्ष्म और लघु उद्यमों” का आिय सूक्ष्म, लघु और मध्यम उद्यम जवकास अजधजनयम, 2006 की धारा 2 के खंड (ि) और खंड (ड) में पररभाजित उद्यम से है’; (ग) खंड (54) के पश्चात, जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथाधत:– ‘(54क) "स्ट्टाटधअप" का आिय वाजणज्य और उद्योग मंत्रालय के उद्योग संवधधन और आंतररक व्यापार जवभाग के साथ पंिीकृत कंपनी से है, िैसा दक समय-समय पर यथासंिोजधत 19 फरवरी, 2019 की अजधसूचना संख्या सा.का.जन. 127 (अ) के पैराग्राफ 1 के खंड (क) में पररभाजित दकया गया है।" (घ) खंड (61) के पश्चात, जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथाधत्— ‘(61क) “मजहला उद्यमी” का आिय ऐसे उद्यम से है, िो दकसी मजहला के स्ट्वाजमत्व एवं जनयंत्रण में हो तथा उस उद्यम की पूंिी में न्द्यूनतम 26 प्रजतित की जवत्तीय जहस्ट्सेिारी हो;’ 3. उि जनयमों के जनयम 5 में, उप-जनयम 3 के पश्चात जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथाधत्— “(4) रक्षा जवस्ट्फोटकों के जलए, संबंजधत एसटीईसी पैम्फलेट में वर्णधत सुरक्षा िूरी लागू होगी।’ 4. उि जनयमों में जनयम 9 के उप-जनयम 1 में, “संस्ट्थाजपत” िब्ि के पश्चात “या प्रस्ट्ताजवत नया” िब्ि अंतःस्ट्थाजपत दकए िाएंगे। 5. उि जनयमों के जनयम 113 में, ताजलका में, क्रम संख्या 26 तथा उससे संबंजधत प्रजवजष्टयों के पश्चात, जनम्नजलजखत क्रम संख्या और प्रजवजष्टयां अंतःस्ट्थाजपत की िाएंगी, अथाधत्— 1 2 3 4 5 6 “27 अनुसंधान एवं जवकास (आर एंड डी) के प्रयोिन हेतु 5 दकलोग्राम से अनजधक मात्रा में जवस्ट्फोटकों के जवजनमाधण, भंडारण एवं उपयोग की अनुमजत {अनुमजत (अनुसंधान एवं जवकास)} 13 एई-13 i. कवररंग लेटर ii. प्ररुप एई-13 iii. जवस्ट्तृत पररयोिना ररपोटध। iv. पोटेबल मैगिीन में संग्रहीत मात्रा में जवस्ट्फोटकों का भंडारण। v. सुरक्षा प्रबंधन योिना। vi. अनुसंधान एवं जवकास प्रयोगिाला में उपलब्ध अवसंरचना। अनुसंधान एवं जवकास के उद्देश्य हेतु। vii. जवस्ट्फोटकों को संभालने में अनुभव रखने वाला कायधबल। viii. टोपो, साइट और लेआउट ड्राइंग। ix. आवेिक / फमध के नाम पर i. कवररंग लेटर ii. प्ररुप एई-13 iii. जवस्ट्तृत पररयोिना ररपोटध। iv. पोटेबल मैगिीन में संग्रहीत मात्रा में जवस्ट्फोटकों का भंडारण। v. सुरक्षा प्रबंधन योिना। vi. अनुसंधान एवं जवकास प्रयोगिाला में उपलब्ध अवसंरचना। अनुसंधान एवं जवकास के उद्देश्य हेतु। vii. जवस्ट्फोटकों को संभालने में अनुभव रखने वाला कायधबल। viii. टोपो, साइट और लेआउट ड्राइंग। ix. आवेिक / फमध के नाम [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 6. उि जनयमों की अनुसूची IV में, भाग-I केअनुच्छेि संख्या 12 के बाि, ताजलका में और उससे संबंजधत प्रजवजष्टयों में, जनम्नजलजखत अनुच्छेि और प्रजवजष्टयों को अंतःस्ट्थाजपत दकया िाएगा, अथाधत:– 1 2 3 4 “13 अनुसंधान एवं जवकास के प्रयोिन हेतु5 दकलोग्राम से अनजधक मात्रा के जवस्ट्फोटकों के जवजनमाधण, भंडारण और उपयोग की अनुमजत {अनुमजत (अनुसंधान और जवकास)} एई-13 मुख्य जवस्ट्फोटक जनयंत्रक 7. उि जनयमों की अनुसूची V में, भाग 1 के, प्रपत्र एई-12 के पश्चात, जनम्नजलजखत प्ररुप को अंतःस्ट्थाजपत दकया िाएगा, अथाधत:– “प्ररुप एई-13 (जवस्ट्फोटक जनयम, 2008 का जनयम 113 िेखें) अनुसंधान एवं जवकास प्रयोिन हेतु 5 दकलोग्राम से अनजधक मात्रा में जवस्ट्फोटकों के जवजनमाधण, भंडारण एवं उपयोग की अनुमजत के जलए आवेिन पत्र। 1. आवेिक का प्रकार: व्यजिगत कंपनी भागीिारी फमध सोसाइटी स्ट्वाजमत्व वाली फमध भूजम का जवजधक कब्जा। x. अजधभोगी द्वारा स्ट्व- घोिणा जिसमें यह उल्लेख होगा दक सुजवधा के जवजनमाधण में एसटीईसी पैम्फलेट का अनुपालन दकया गया है। xi. एमएसएमई के मामले में, सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय द्वारा िारी प्रमाण पत्र या स्ट्टाटधअप के मामले में, वाजणज्य और उद्योग मंत्रालय के उद्योग संवधधन और आंतररक व्यापार जवभाग के साथ पंिीकरण के िस्ट्तावेिी साक्ष्य, या मजहला उद्यमी के मामले में, फमध या कंपनी के स्ट्वामी या जनिेिक के संबंध में िस्ट्तावेिी साक्ष्य। पर भूजम का जवजधक कब्जा। x. अजधभोगी द्वारा स्ट्व- घोिणा जिसमें यह उल्लेख होगा दक सुजवधा के जवजनमाधण में एसटीईसी पैम्फलेट का अनुपालन दकया गया है। xi. एमएसएमई के मामले में, सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय द्वारा िारी प्रमाण पत्र या स्ट्टाटधअप के मामले में, वाजणज्य और उद्योग मंत्रालय के उद्योग संवधधन और आंतररक व्यापार जवभाग के साथ पंिीकरण के िस्ट्तावेिी साक्ष्य, या मजहला उद्यमी के मामले में, फमध या कंपनी के स्ट्वामी या जनिेिक के संबंध में िस्ट्तावेिी साक्ष्य। कृपया अधिभोगी का हाल ही का पासपोर्ट आकार का रंगीन फोर्ोग्राफ सामने हस्ताक्षर हुए धचपकाएं। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. आवेिक का जववरण : (क) जिस नाम से अनुमजत अपेजक्षत है (नीचे दिए गए रटप्पण को िेखें) ----------------------------------------------------- ----------------------------------------------------- (ख) आधार नं. / सीआईएन नं. / फमध की पंिीकरण सं. The objections or suggestions which may be received from any person with respect to the said draft rules, within the period so specified will be considered by the Central Government. 1. (1) These rules may be called the Explosives (Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Explosives Rules, 2008 (hereinafter referred to as the said rules),in rule 2: - 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (a) after clause (15), the following clause shall be inserted, namely: - ‘(15A) “Defense Explosives” means explosives which is meant for defense sector and manufactured by private manufacturers’; (b) after clause (35A), the following clause shall be inserted, namely: - ‘(35B) “Micro and Small Enterprises” means an enterprise defined in clause (h) and clause(m) of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006’; (c) after clause (54), the following clause shall be inserted, namely: - ‘(54A) “startup” means an entity registered with the Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry and as defined in clause (a) of Paragraph 1 of the Notification number G.S.R. 127(E), dated the 19th February, 2019, and as amended from time to time’; (d) after clause (61), the following clause shall be inserted, namely: - ‘(61A) “women entrepreneur” means an enterprise owned and controlled by a woman having a minimum financial interest of 26 percent of the capital’; 3. In rule 5 of the said rules, after sub-rule 3, the following clause shall be inserted, namely: - ‘(4) for defense explosives safety distances mentioned in the relevant STEC pamphlets shall be applicable.’ 4. In rule 9, in sub-rule 1 of the said rules, after the word “established” the words “or proposed new” shall be inserted. 5. In rule 113 of the said rules, in the Table, after serial number 26 and the entries relating thereto, the following serial number and entries shall be inserted, namely: - 1 2 3 4 5 6 “27 Permission to manufacture, storage and use of explosives not exceeding 5 Kg. for R&D purpose {Permission (R&D)} 13 AE-13 i. Covering letter. ii. Form AE-13 iii. Detailed project report iv. Storage of explosives in quantity stored in a portable magazine. v. Safety management plan. vi. Infrastructure available in the R&D Lab. For R&D purpose. vii. Manpower having experience in handling of explosives. viii. Topo, site and layout drawing. ix. Legal possession of the land in the name of applicant/firm. x. A self declaration by the occupier stating that construction of the facility is in compliance with STEC pamphlets. xi. In case of MSME,certificate issued by the Ministry of Micro, Small and Medium Enterprises or in case of Startup, documentary evidence towards registration with the Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry or in case of Women Entrepreneur, documentary evidence towards Proprietor or Director of the firm or company. i. Covering letter. ii. Form AE-13 iii. Detailed project report iv. Storage of explosives in quantity stored in a portable magazine. v. Safety management plan. vi.
