xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY वाजणज् य और उद्योग मंत्रालय (उद्योग संवधधन और आंतररक व् यापार जवभाग) अजधसूचना नई दिल् ली, 2 माचध, 2026 सा.का.जन. 154(अ) – जवस्ट्फोटक जनयम, 2008 का और संिोधन करने हेतु कजतपय जनयमों के मसौिे को, जवस्ट्फोटक अजधजनयम, 1884 (1884 का 4) की धारा 18 की उप-धारा (1) के अनुसार अपेजित रूप से, भारत सरकार, वाजणज्य और उद्योग मंत्रालय की अजधसूचना संख्या सा.का.जन. 369 (अ), तारीख 5 िून, 2025 द्वारा, भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उप-खंड (i) में प्रकाजित दकया गया था, जिसमें ऐसे सभी व् यजियों से, जिनके उससे प्रभाजवत होने की संभावना है, उि अजधसूचना वाले रािपत्र की प्रजतयां िनता को उपलब् ध कराए िाने की तारीख से तीस दिन की अवजध के समाप् त होने से पूवध आपजियां और सुझाव आमंजत्रत दकए गए थे; और उक् त अजधसूचनाओं की प्रजतयां 5 िून, 2025 को िनता को उपलब् ध करा िी गई थी; और उि मसौिा जनयमों के संबंध में िनता से प्राप् त आपजियों और सुझावों पर केंद्रीय सरकार द्वारा सम्यक रूप से जवचार दकया गया; अतः अब, केन्‍द द्रीय सरकार जवस्ट् फोटक अजधजनयम 1884 (1884 का 4) की धारा 5 और 7 द्वारा प्रित् त िजियों का प्रयोग करते हुए, जवस्ट्फोटक जनयम, 2008 में और संिोधन करने के जलए जनम् नजलजखत जनयम बनाती है, अथाधत ः-

1. संजिप्त नाम और प्रारंभ:- (1) इन जनयमों का संजिप्त नाम जवस्ट्फोटक (संिोधन) जनयम, 2026 है। सं. 148] नई दिल्ली, मंगलवार, माचध 3, 2026/फाल् गुन 12, 1947

2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) ये रािपत्र में इनके प्रकािन की तारीख से प्रवृत होंगे। 2. जवस्ट्फोटक जनयम, 2008 (जिसे इसमें इसके पश् चात मूल जनयम कहा गया है) में, जनयम 83 के, उप जनयम (4) में:- (i) खंड (क) के स्ट्थान पर, जनम्नजलजखत खंड रखा िाएगा:- “(क) एक मंजिला इमारत के भूतल पर जस्ट्थत हो, जिसमें स्ट्वतंत्र या एकमात्र दियाकलाप हो, जिसमें स्ट्वतंत्र प्रवेि और खुली हवा में आपातकालीन जनकास हो और बाहर की ओर खुलने वाले िरवािे हों;” (ii) खंड (च) के पश्चात जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथाधत — “(छ) रणनीजतक स्ट्थानों पर ड्राई केजमकल पाउडर (डीसीपी) प्रकार तथा काबधन डाइऑक्साइड (CO₂) प्रकार के कम से कम िो या अजधक अजििामक यंत्र स्ट्थाजपत दकए गए हों।”

3. मूल जनयमों में, जनयम 86 के उप जनयम (3) के पश्चात जनम्नजलजखत उप-जनयम अंतस्ट्थाजपत दकए िाएंगे:- “(4) स्ट्वतंत्र आजतिबाजी — स्ट्वतंत्र आजतिबािी की िुकान को दकसी भी समीपवती संरचना या भवन से न्‍दयूनतम 3 मीटर की पूरी तरह खुली िूरी बनाए रखनी होगी। (5) आजतिबाजी की िुकान— आजतिबािी की िुकान दकसी भी िैिजणक संस्ट्था, अस्ट्पताल, जचदकत्सा नैिाजनक केंद्र तथा धार्मधक स्ट्थल से न्‍दयूनतम पचास मीटर की स्ट्पष्ट िूरी बनाए रखनी होगी। (6) अपवाि — उप-जनयम (4) और (5) के उपबंध, प्ररूप एलई-5 अनुज्ञजप्त के अंतगधत आने वाली आजतिबािी की जवद्यमान िुकानों पर लागू नहीं होंगे। (7) सुरिा अपेिाएं— जनयम 112 के उपबंधों के अधीन, आजतिबाजी की जवद्यमान िुकानें जनम्नजलजखत सुरिा अपेिाओं का पालन करेंगी, अथाधत - i. िुकान में धुएं और ताप के संयोिन वाले पारंपररक डुअल टाइप वाले जडटेक्टरों का उपयोग करते हुए िो स्ट्वचाजलत अजि जडटेक् िन और अलामध प्रणाली, ऑटो-डायलर के साथ इस प्रकार संस्ट्थाजपत होने चाजहए जिससे आग लगने की जस्ट्थजत में िुकान के स्ट्वामी और जनकटतम अजििमन केंद्र को सूजचत दकया िा सके; ii. जवद्यमान आजतिबाजी िुकान में अजि िमन के जलए स्ट्वतंत्र स्ट्वचाजलत पोटेबल अथवा गुरुत्वाकर्धण-आधाररत िल स्पस्ट्प्रंकलर प्रणाली स्ट्थाजपत की िाएगी, जिसमें न्‍दयूनतम 300 लीटर िल भंडारण िमता हो तथा िो न्‍दयूनतम 2 हॉसधपावर (एचपी) िमता के पंप से संयोजित हो; iii. स्ट्टैंडअलोन जसस्ट्टम के जलए वैकजल्पक जबिली आपूर्तध या बैटरी बैकअप उपलब्ध कराया िाएगा और पहले से स्ट्थाजपत जस्ट्थर हाइड्रेंट प्रणाली के मामले में, प्रणाली से एक टैस्पपंग या एक्सटेंिन जलया िा सकता है; iv. बडे आकार के केंद्रीकृत इलेजक्रक पैनल को गैस आधाररत क्लीन एिेंट के साथ इसे सुरजित रखने के जलए एक स्ट्वचाजलत ट्यूस्पबंग जसस्ट्टम के साथ संरजित दकया िाएगा, जिसमें जिसमें 80–90 जडग्री सेजल्सयस पर तेिी से सेंस्पसंग तथा त्वररत गजत से सदिय होने में सिम जडटेक्िन ट्यूब हो; v. िुकान की िीवारों, छत और िरवािों पर अजिरोधी पेंट या अजिरोधी सामग्री की कोटटंग होनी चाजहए तादक कम से कम तीस जमनट की अजि रेटटंग जमल सके। vi. िुकान में कन्‍द सील जवद्युत वायटरंग, स्ट्पाकध या फ्लेम प्रूफ का उपयोग करते हुए अजि सुरजित केबल या अजिरोधी न्‍द यून स्ट् मोक प्रकार की होनी चाजहए। vii. पटाखों की िुकानों का वार्र्धक जवद्युत लेखा परीिा होना चाजहए, िो संबंजधत राज्य के ऊिाध या जवद्युत बोडध द्वारा मान्‍दयताप्राप्त प्रमाजणत योग्य व्यजि या जवद्युत जनरीिक द्वारा कराया िाएगा; viii. खंड (i) से (vii) में जनर्िधष्ट सभी उपकरण भारतीय मानक ब्यूरो के संबंजधत मानकों के अनुरूप होंगे।”
4. मूल जनयमों में, जनयम 112 के उप जनयम (3) में, िूसरे परंतुक के पश्चात जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथाधत :-

[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 “परंतु दक अनुज्ञजप्त प्राजधकारी, अनुज्ञजप्त के नवीनीकरण से पूवध, अनुज्ञजप्तधारक को जलजखत सूचना द्वारा जनयम 86 के उप-जनयम (7) में जवजनर्िधष्ट अजतररि सुरिा उपायों की अनुपालना हेतु एक वचनबद्धता (अंडरटेककंग) प्रस्ट्तुत करने के जलए कहेगा, और अनुज्ञजप्तधारक ऐसी सूचना की प्राजप्त की तारीख से तीन माह की अवजध के भीतर अथवा उसमें जवजनर्िधष्ट अवजध के भीतर, िो भी पूवध हो, उि वचनबद्धता प्रस्ट्तुत करेगा।” [फा. सं. 2(3)/2019-जवस्ट्फोटक-भाग (1)] िय प्रकाि जिवहरे, संयुि सजचव रटप्पण: मूल जनयम भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उप खंड (i) में अजधसूचना संख्या सा.का.जन. 907 (अ) तारीख 29 दिसंबर, 2008 द्वारा प्रकाजित दकए गए और अंजतम संिोधन सा.का.जन. 284(अ) तारीख 24 अप्रैल, 2025 द्वारा दकया गया।

MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 2nd March, 2026

G.S.R. 154(E).—WHEREAS the draft of certain rules further to amend the Explosives Rules, 2008 was published as required by sub-section (1) of section 18 of the Explosives Act, 1884 (4 of 1884), vide notification of the Government of India in the Ministry of Commerce and Industry number G.S.R. 369 (E), dated the 5th June, 2025 in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

AND WHEREAS, the copies of the said notification were made available to the public on 5th June, 2025;

AND WHEREAS, objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;

NOW, THEREFORE, in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884), the Central Government hereby makes the following rules further to amend the Explosives Rules, 2008, namely:—

1. Short title and commencement.- (1) These rules may be called the Explosives (Amendment) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Explosives Rules, 2008 (hereinafter referred to as the principal rules), in rule 83, in sub- rule (4),-

(i) for clause (a), the following clause shall be substituted, namely:-

“(a) be located on the ground floor of a single-storeyed building with independent or standalone activity, having an independent entrance and emergency exit opening directly to open space and having doors opening outwards;”;

(ii) after clause (f), the following clause shall be inserted, namely:-

"(g) have not less than two or more fire extinguishers of Dry Chemical Powder (DCP) type and Carbon dioxide (CO2) type be placed at strategic points.".

3. In the principal rules, in rule 86, after sub-rule (3), the following sub-rules shall be inserted, namely: -

“(4) Independent fireworks.— The independent fireworks shop shall maintain a minimum clearance of three meters to open sky from any adjacent structure or building.

(5) Fireworks shop.— The fireworks shop shall maintain a minimum clear distance of fifty meters from educational institution, hospital, medical diagnostic centre and religious place.

(6) Exceptions.— The provisions of sub-rules (4) and (5) shall not apply to existing fireworks shops covered under licensed FORM LE-5.

(7) Safety requirements.— Subject to the provisions of rule 112, the existing fireworks shops shall comply with the following safety requirements, namely:-

i. the shop shall be equipped with two automatic fire detection and alarm system using conventional dual type detectors having combination of smoke and heat with an auto-dialler facility to alert the shop owner and to the nearest fire station, in the event of fire;

ii. the existing fireworks shop shall install a standalone automatic portable or gravity fed water sprinkler system for fire suppression, with minimum water storage capacity of 300 liters connected to a pump of minimum rating 2 Horsepower (HP);

iii. an alternate power supply or battery backup shall be provided for the standalone systems and in the case of existing fixed hydrant system, one tapping or extension shall be taken from such system;

iv. the centralised large electric panel shall be protected by an automatic tubing system used with gas- based clean agent, with a detection tube capable of fast sensing at 80-90 degree Celsius and instant activation;

v. the walls, ceiling and doors of the shop shall be coated with fire-retardant paint or flameproofing material to achieve a fire rating of thirty minutes;

vi. the shop shall have concealed electrical wiring using spark-or-flame proof either fire survival cables or fire retardant low smoke type;

vii. the fireworks shop shall undergo an electrical audit annually, to be conducted by a certified qualified person or electrical inspector recognised by the Energy or Electrical Department of the concerned State;

viii. all the equipments referred to in clauses (i) to (vii) shall conform to the relevant standards of the Bureau of Indian Standard.”.

4. In the principal rules, in rule 112, in sub-rule (3), after the second proviso, the following proviso shall be inserted, namely:-

“Provided also that the licencing authority, before renewing the licence, shall call upon the licence holder by notice in writing to furnish an undertaking for compliance of additional safety measures specified in sub-rule (7) of rule 86 and the licence holder shall furnish such undertaking within a three months of the date of receipt of the notice or as may be specified therein, whichever is earlier.".
