xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY वाजणज् य और उद्योग मंत्रालय (उद्योग संवधधन और आंतररक व् यापार जवभाग) अजधसूचना नई दिल्ली, 3 फरवरी, 2026 सा.का.जन. 104(अ).—जवस्ट् फोटक अजधजनयम,1884 (1884 का 4) की धारा 5 तथा 7 द्वारा प्रित्त िजियों का प्रयोग करते हुए अमोजनयम नाइरेट जनयम, 2012में संिोधन करने हेतु केन्द्र सरकार द्वारा प्रस्ट्ताजवत जनम् नजलजखत जनयमों के प्रारूप, उक् त अजधजनयम की धारा 18 की उप-धारा (1) के प्रावधानों के अनुसार, एतिद्वारा उन सभी व्यजियों की सूचना के जलए प्रकाजित दकया िाता है जिनके इन जनयमों से प्रभाजवत होने की संभावना है और यह नोरटस दिया िाता है दक उक् त प्रारूप पर, उस तारीख से जिसको इस अजधसूचना वाले रािपत्र की प्रजतयां िनता को उपलब् ध करा िी िाती हैं, तीस (30) दिनों के पश् चात जवचार दकया िाएगा। इन प्रारूप जनयमों के बारे में, यदि कोई आपजत्तयां या सुझाव हों तो, जनिेिक (जवस्ट् फोटक), उद्योग संवधधन और आंतररक व् यापार जवभाग, वाजणज् य और उद्योग मंत्रालय, कमरा नं. 252ए, उद्योग भवन, नई दिल् ली– 110011 को या ईमेल expl-dipp@nic.in द्वारा ऊपर उजल्लजखत अवजध के भीतर भेिे िा सकते हैं।

उक् त प्रारूप जनयमों के बारे में, उपयुधक् त जवजनर्िधष् ट अवजध के भीतर दकसी व् यजि से प्राप् त आपजत्तयों या सुझावों पर केन्द्र सरकार द्वारा जवचार दकया िाएगा। प्रारूप जनयम

1. (1) इन जनयमों को अमोजनयम नाइरेट (संिोधन) जनयम, 2026 कहािाएगा। (2) ये रािपत्र में इनके अंजतम रूप से प्रकािन की तारीख से प्रवृत् त होंगे।
2. अमोजनयम नाइरेट जनयम, 2012 (जिन्द्हें इसके पश्चात् उि जनयम कहा गया है), के जनयम 21 में:- (क)उप-जनयम (1) में, “प्रेषक” िब्ि के बाि “या परेजषती” िब्ि अंतःस्ट्थाजपत दकए िाएंगे। (ख)उप-जनयम (1) में, “प्ररूप त-4 में जवजधमान्द्य अनुज्ञजि के धारक” िब्िों के बाि जनम्नजलजखत खंड अंत: स्ट्थाजपत दकए िाएंगे, अथाधत्— “इस ितध के अध्यधीन दक— (क)यदि पररवहन वाहन परेजषती द्वारा उपलब्ध कराया िाता है, तो अमोजनयम नाइरेट का पररवहन, परेजषती की पररवहन अनुज्ञजि के आधार पर दकया िाएगा। (ख)यदि पररवहन वाहन प्रेषक द्वारा उपलब्ध कराया िाता है, तो अमोजनयम नाइरेट का पररवहन प्रेषक की पररवहन अनुज्ञजि के आधार पर दकया िाएगा।” (ग) उप-जनयम (6) में, “प्रेषक” िब्ि के बाि तथा “सुपुिधगी सुजनजश्चत करेगा” िब्िों से पूवध, “या परेजषती” िब्ि अंतःस्ट्थाजपत दकए िाएंगे।
3. उि जनयमों के जनयम 38 के उप-जनयम (ङ) में, “पिाजधकारी” िब्ि के बाि “या अजधभोगी” िब्ि अंतःस्ट्थाजपत दकए िाएंगे। [फा. सं. पी-13012/2/2021-जवस्ट्फोटक] िय प्रकाि जिवहरे, संयुक् त सजचव नोट-मूल जनयम भारत के रािपत्र, असाधारणमें अजधसूचना संख्या सा.का.जन. 553 (अ), तारीख 11 िुलाई, 2012 में प्रकाजित दकए गए थे और बाि में अजधसूचना संख्या सा.का.जन. 469(अ) तारीख 9 िुलाई, 2013, सा.का.जन. 938(अ) तारीख 27 जसतंबर, 2018,सा.का.जन. 608(अ) तारीख 31 अगस्ट् त, 2021,सा.का.जन.239 (अ) तारीख 17 अप्रैल, 2025 और सा.का.जन. 377 (अ) तारीख 9 िून, 2025 द्वारा इनमें पश्चात्वती संिोधन दकया गया।

MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 3rd February, 2026 G.S.R. 104(E).—The draft of the following rules to amend the Ammonium Nitrate Rules 2012, which Central Government proposes to make in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884) is hereby published as required by sub-section (1) of section 18 of the said Act for information of all persons likely to be affected thereby, and notice is hereby given that the said draft shall be taken into consideration after the expiry of a period of thirty (30s) days from the date on which the copies of the Gazette of India containing this notification are made available to the public. Objections or suggestions if any, to these draft rules may be sent to Director (Explosives), Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Room No. 252 A, Udyog Bhawan, New Delhi –110011 or Email: expl-dipp@nic.in; within the period specified above;

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 The objections or suggestions which may be received from any person with respect to the said draft rules within the period above so specified will be taken into consideration by the Central Government. Draft Rules

1. (1) These rules may be called the Ammonium Nitrate (Amendment) Rules, 2026. (2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Ammonium Nitrate Rules, 2012 (hereinafter referred to as the said rules), in rule 21: - (A) in sub-rule (1), after word "Consignors", the words “or Consignee” shall be inserted. (B) in sub-rule (1), after words “holding valid licence in Form P-4” the following clauses shall be inserted, namely: - “subject to (a) if transport vehicle is provided by the consignee, the Ammonium Nitrate should be transported on the strength of transport licence of consignee. (b) if transport vehicle is provided by the consignor, the Ammonium Nitrate should be transported on the strength of transport licence of consignor.” (C) in sub-rule (6) after word "Consignor" and before the words "shall ensure delivery", the words "or Consignee", shall be Inserted.
3. In the said rules, in rule 38, in sub-rule (e) after word "office-bearers", the words “or occupier” shall be inserted. [F. No. P-13012/2/2021-EXPLOSIVE] JAI PRAKASH SHIVAHARE, Jt. Secy. Note : The principle rules were published in Gazette of India, Extraordinary vide notification number G.S.R. 553(E) dated the 11th July, 2012 and subsequently amended vide notification number G.S.R 469(E) dated 9th July 2013, G.S.R. 938(E) dated 27th September, 2018, G.S.R. 608(E), dated 31stAugust, 2021, G.S.R. 239(E) dated 17th April, 2025 and G.S.R. 377(E) dated 9th June, 2025.
