सा.का.नि. 315(अ).— गैस सिलेंडर नियम, 2016 में और संशोधन करने के लिए कतपय नियमों का प्रारूप, विस्फोटक अधिनियम, 1884 (1884 का 4) की धारा 18 की अपेक्षा के अनुसार, भारत सरकार, वाणिज्य और उद्योग मंत्रालय, उद्योग संवर्धन और आंतरिक व्यापार विभाग की अधिसूचना सं. सा.का.नि. 103 (अ), तारीख 3 फरवरी, 2026 द्वारा भारत के राजपत्र, असाधारण, भाग II, खण्ड- 3, उपखण्ड (i) में प्रकाशित किया गया था, जिसमें उक्त अधिसूचना वाले राजपत्र की प्रतियां जनता को उपलब्ध कराए जाने की तारीख से तीस दिन की अवधि के समाप्त होने से पूर्व ऐसे सभी व्यक्तियों से, जिनके उससे प्रभावित होने की संभावना है, आक्षेप या सुझाव आमंत्रित किए गए थे; और उक्त राजपत्र अधिसूचनाओं की प्रतियां 4 फरवरी, 2026 को जनता को उपलब्ध करा दी गई थीं; और उक्त अवधि के दौरान जनता से कोई आक्षेप या सुझाव प्राप्त नहीं हुए; सं. 291] नई दिल्ली, मंगलवार, अप्रैल 28, 2026/वैशाख 8, 1948

अतः अब, केन्द्रीय सरकार, विस्फोटक अधिनियम 1884 की धारा 5 और धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, गैस सिलेंडर नियम, 2016 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारंभ - (1) इन नियमों का संक्षिप्त नाम गैस सिलेंडर (संशोधन) नियम, 2026 है। (2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. गैस सिलेंडर नियम, 2016 (जिसे इसमें इसके पश्चात “मूल नियम” कहा गया है) के नियम 3 के उपनियम (5) में, “भारतीय पत्तन से होकर” शब्दों के पश्चात, “या रक्षा मंत्रालय के स्थापनों, अंतरिक्ष विभाग तथा उसके पब्लिक सेक्टर उपक्रमों द्वारा अपने स्वयं के उपयोग के लिए आयात किए गए सिलेंडर और वाल्व,” शब्द अंतःस्थापित किए जाएंगे।
3. मूल नियमों के, नियम 32 में, उपनियम (1) में, निम्नलिखित परन्तुक अंतःस्थापित किया जाएगा, अर्थात्‌ —“परंतु यह कि निम्नलिखित के संबंध में अनुज्ञा अपेक्षित नहीं होगी- (क) बिना वाल्व वाले खाली सिलेंडर; (ख) मुख्य नियंत्रक द्वारा अनुमोदित विदेशी विनिर्माण संयंत्रों से आयात किए गए और प्ररूप-घ में विधिमान्य आयात अनुज्ञप्ति वाले वाल्व और एलपीई रेगुलेटर।”
4. मूल नियमों के, नियम 48 में, उपनियम (3) के खंड (ख) में,“तरलीकृत पेट्रोलियम गैस” शब्दों के पश्चात या अन्य ज्वलनशील गैसें” शब्द अंतःस्थापित किए जाएंगे।

MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 27th April, 2026

G.S.R. 315(E).— WHEREAS the draft of certain rules further to amend the Gas Cylinders Rules, 2016, were published as required under section 18 of the Explosives Act, 1884 (4 of 1884) vide notification of the Government of India in the Ministry of Commerce and Industry, Department for Promotion of Industry and Internal Trade, vide number, G.S.R. 103 (E), dated the 3rd February, 2026, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub section (i), inviting objections or suggestions from all persons likely to be affected thereby before the expiry of a period of thirty days from the date on which the copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, the copies of the said notification were made available to the public on the 4th February, 2026;

AND WHEREAS, no objections or suggestions were received from the public within the said period;

NOW, THEREFORE, in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884, the Central Government hereby makes the following rules further to amend the Gas Cylinders Rules, 2016, namely:

1. Short title and commencement.—(1) These rules may be called the Gas Cylinders (Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Gas Cylinders Rules, 2016 (hereinafter referred to as the principal rules), in rule 3, in sub-rule (5), after the words, "touching Indian port" the words, "or cylinders and valves imported by establishments of the Ministry of Defence, Department of Space and its Public Sector Undertakings for their own use" shall be inserted.
3. In the principal rules, in rule 32, to sub-rule (1), the following proviso shall be inserted, namely:- "Provided that the permission shall not be required in respect of,- (a) empty cylinders without valves; (b) valves and LPG regulators, imported from the foreign manufacturing plants approved by the Chief Controller and having valid import licence in Form-D.".
4. In the principal rules, in rule 48, in sub-rule (3), in clause (b), after the words, "Liquified Petroleum Gas", the words, "or other flammable gases" shall be inserted.
