और उि प्रारूप जनयमों के संबंध में प्राप्त आपजत्तयों या सुझािों पर केंद्रीय सरकार द्वारा सम्यक रूप से जिचार कर जलया गया है;

अब, अतः, केंद्रीय सरकार, जिकजसत भारत—रोिगार और आिीजिका के जलए गारन् टी जमिन (ग्रामीण): िीबी— िी राम िी (जिकजसत भारत - िी राम िी) अजधजनयम, 2025 की धारा 33 की उप-धारा (1) तथा उपधारा (2) के खंड (त) और धारा 37 की उपधारा (5) के अधीन प्रित्त िजियों का प्रयोग करते हुए, जनम्नजलजखत जनयम बनाती है, अथावत्:—

1. संजक्षप्त िीषवक और प्रारंभ– (1) इस जनयम का संजक्षप्त नाम “जिकजसत भारत—रोिगार और आिीजिका के जलए गारन् टी जमिन (ग्रामीण): िीबी–िी राम िी (जिकजसत भारत - िी राम िी) संक्रमणकालीन उपबंध जनयम, 2026” है ।

(2) ये रािपत्र में उनके प्रकािन की तारीख को प्रिृत्त होंगे | 2. पररभाषाएाँ – इन जनयमों में, िब तक दक संिभव से अन्यथा अपेजक्षत न हो, — (क.) "अजधजनयम" से जिकजसत भारत—रोिगार और आिीजिका के जलए गारन् टी जमिन (ग्रामीण): िीबी–िी राम िी (जिकजसत भारत - िी राम िी) अजधजनयम, 2025 अजभप्रेत है; (ख). "संक्रमण तारीख" से अजधजनयम की धारा 3 के उपबंधों के अनुसार राज्य सरकार द्वारा स्ट्कीम की अजधसूचना की तारीख या राज्य सरकार द्वारा िारी आिेि के माध् यम से अंतररम व्यिस्ट्था के प्रारंभ की तारीख, िो भी पूिवतर हो; अजभप्रेत है:

परन्तु यह दक ऐसी तारीख अजधजनयम के प्रारंभ की तारीख से छह मास के पश्चात की नहीं होगी; (ग) "उपयोजगता प्रमाण-पत्र" से साधारण जित्तीय जनयम, 2017 के अधीन जिजहत प्ररूप में राज्य सरकार अथिा संघ राज्य क्षेत्र प्रिासन द्वारा प्रस्ट्तुत िह प्रमाण-पत्र अजभप्रेत है, जिसमें यह प्रमाजणत दकया गया हो दक स्ट्कीम के अधीन िारी की गई जनजधयों का उपयोग उसी प्रयोिन के जलए दकया गया है, जिसके जलए िे स्ट्िीकृत की गई थीं। (घ) इसमें प्रयुि अन्य सभी िब्ि और अजभव्यजियां तथा िो पररभाजषत नहीं हैं, दकन्तु अजधजनयम में पररभाजषत हैं, के िही अथव होंगे, िो अजधजनयम में क्रमिः उन्हें दिए गए हैं। 3. जित्तीय िाजयत्िों का जनपटान – (1) महात्मा गांधी राष्ट्रीय ग्रामीण रोिगार गारंटी अजधजनयम, 2005 (2005 का 42) के अधीन स्ट्िीकृत महात्मा गांधी राष्ट्रीय ग्रामीण रोिगार गारंटी स्ट्कीम के अधीन सभी िाजयत्िों का राज्य सरकार द्वारा इस प्रकार से सत्यापन दकया िाएगा दक िे 30 िून, 2026 तक जिद्यमान थीं।

(2) राज्य सरकार यह सुजनजश्चत करेगी दक इस संबंध में स्ट्थाजपत तंत्र के अनुसार, सम्यक सत्यापन के पश्चात् अनुज्ञेय िाजयत्िों के जनपटान हेतु सभी आिश्यक कारविाई की िाएं।

(3) राज्य सरकार, महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी अजधजनयम, 2005 (2005 का 42) के अधीन अजधिेजित लेखा-परीजक्षत उपयोग प्रमाण-पत्र, व्यय और िाजयत्िों के सत्यापन, पुनर्मवलान, लेखा-परीक्षा तथा ररपोर्टिंग से संबंजधत सभी सम्यक कायवप्रणाजलयों और प्रदक्रयाजिजधयों को पूणव करने के द्वारा, इन जनयमों के प्रारम्भ होने की तारीख से एक सौ अस्ट्सी दिनों की अिजध के भीतर प्रस्ट्तुत करेगी:

परन्तु यह दक केंद्रीय सरकार, कारणों को लेखबद्ध करते हुए तथा पयावप्त कारणों के जिद्यमान होने से उनका समाधान होने पर, उि अिजध को अजतररि नब्बे दिन की अिजध तक बढा सकेगी।

(4) केंद्रीय सरकार, इस संबंध में, स्ट्थाजपत जनयमों और कायवप्रणाजलयों के अनुसार, केंद्रीय सरकार अनुज्ञेय िाजयत्िों के जलए अपने जनजध के अंि िारी करेगी।

4. जनजधयााँ – (1) केंद्रीय सरकार इन जनयमों के उपबंधों के अधीन रहते हुए, 30 िून, 2026 तक जिद्यमान िाजयत्िों की पूर्तव सजहत, राज्यों में महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारन् टी स्ट्कीम के प्रचालन के जलए जनजध सहायता सुजनजश्चत करेगी।

(2) अव्यजयत अजतिेष राजि के केंद्रीय जहस्ट् से को राज्य सरकार द्वारा इस संबंध में लागू जित्तीय जनयमों और कायवप्रणाजलयों के अनुसार केंद्रीय सरकार को िापस प्रेजषत दकया िाएगा।

(3) अजधजनयम के प्रारंभ होने पर, अजधजनयम के अधीन मानक आिंटन हेतु िस्ट्तुजनष्ठ मापिंडों से संबंजधत जनयमों के अंजतम रूप से बनाए िाने तक, केंद्रीय सरकार स्ट्कीम के कायावन्ियन के जलए राज्यों को अंतररम आिंटन उपबंध कर सकेगी, िो ऐसे जनयमों के अनुसार अिधाररत अंजतम मानक आिंटन की सीमा के भीतर होंगे। 5. महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारन् टी स्ट्कीम के अधीन कायव – संक्रमण तारीख पर महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारन् टी स्ट्कीम के अधीन िारी सभी कायों को अजधजनयम के अधीन आगे बढाया िा सकेगा और उन्हें अजधजनयम के उपबंधों के अनुसार, जिसमें अजधजनयम की धारा 22 में जिजनर्िवष्ट जनजध-साझाकरण पद्धजत सजम्मजलत है, िारी रखा िाएगा। 6. कमवकार पहचान, अजभलेख और ग्रामीण रोज़गार गारन् टी काडव – (1) महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारन् टी स्ट्कीम के अधीन कमवकारों के िॉब काडव, जिन्हें ई-केिाईसी के माध्यम से निीकृत और सत्याजपत दकया िा चुका है, अजधजनयम के अधीन रोज़गार प्राप्त करने के जलए जिजधमान्य माने िाएाँगे:

परन्तु यह दक िहााँ केंद्रीय सरकार, इस बात पर समाधान हो िाने पर दक ई-केिाईसी (e-KYC) कमवकार के जनयंत्रण से परे कारणों से पूणव नहीं की िा सकी है, िह लोकजहत में ऐसा करना आिश्यक समझती है, िहााँ ऐसे मामलों में ऐसी रीजत से प्रसंस्ट्कृत की िाएगी, िो केंद्रीय सरकार द्वारा जिजनजश्चत की िाय ।

(2) उप जनयम (1) में िर्णवत व्यिस्ट्था तब तक िारी रहेगी िब तक दक राज्य सरकार द्वारा अजधजनयम और उस सरकार द्वारा अजधसूजचत स्ट्कीम के उपबंधों के अनुसार ग्रामीण रोज़गार गारन् टी काडव िारी नहीं दकए िाते।

(3) महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारन् टी स्ट्कीम के अधीन रोज़गार मााँग को पूरा करने के जलए आिश्यक सत्याजपत िस्ट्तािेज़ या अजभलेख तब तक जिजधमान्य बने रहेंगे िब तक दक ऐसे िस्ट्तािेज़ राज्य सरकार द्वारा अजधजनयम और उस राज्य द्वारा अजधसूजचत स्ट्कीम के उपबंधों के अनुसार िारी नहीं दकए िाते। 7. कानूनी गारन् टी – (1) संक्रमण तारीख के पश्चात् महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारन् टी स्ट्कीम के अधीन रजिस्ट्रीकृत रोज़गार की दकसी भी मााँग पर अजधजनयम के उपबंधों के अनुसार जिचार दकया िाएगा।

(2) िहााँ दकसी पररिार ने दकसी जित्तीय िषव में महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारन् टी स्ट्कीम के अधीन दकतनी भी संख्या के दिनों के जलए पहले से रोज़गार का उपभोग दकया हो, ऐसा पररिार उस जित्तीय िषव में अजधजनयम के उपबंधों के अनुसार गारन् टीकृत रोज़गार के दिनों के अजतिेष के जलए पात्र बना रहेगा।

(3) कायवक्रम अजधकारी ऐसे रोज़गार के उजचत समायोिन, समाधान और लेखांकन को सुजनजश्चत करेगा। 8. िंगम और स्ट्थािर आजस्ट्तयों का अंतरण – (1) महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारन् टी अजधजनयम, 2005 (2005 का 42) के अधीन सृजित, उपाप्त या अनुरजक्षत सभी िंगम और स्ट्थािर आजस्ट्तयां अजधजनयम के अधीन प्राजधकरणों को अंतररत हो िाएाँगी।

(2) राज्य सरकार, स्ट्कीम से संबंजधत सभी िंगम और स्ट्थािर आजस्ट्तयों की एक सूची तैयार करेगी तथा उसका अनुरक्षण करेगी, जिसमें ऐसी आजस्ट्तयों का जिजिजष्टयााँ तथा िह प्राजधकारी, जिसमें ऐसी आजस्ट्तयां, लागू जिजधयों, जनयमों एिं उस सरकार की प्रदक्रयाओं के अनुसार, अंतररत् या जनजहत हैं, का उल्लेख होगा।

(3) राज्य सरकार, इन जनयमों के प्रारम्भ होने की तारीख से छह मास की अिजध के भीतर उि सूची केन्द्रीय सरकार को प्रस्ट्तुत करेगी:

परन्तु यह दक केंद्रीय सरकार, जलजखत रूप में कारणों को लेखबद्ध करते हुए तथा पयावप्त कारणों के जिद्यमान होने से समाधान होने पर, उि अिजध को 90 दिन से अनजधक ऐसी अजतररि अिजध तक, जिसे िह उजचत समझे, बढा सकेगी |

परन्तु यह और दक ऐसी कोई भी व्यिस्ट्था, साधारण जित्तीय जनयम, 2017 के उपबंधों तथा केंद्रीय सरकार द्वारा िारी दकए िाने िाले अन्य जित्तीय अनुिेिों या मागवििवक जसद्धांतों के अनुरूप होगी। 9. अजभलेख, डाटा और िस्ट्तािेज़ – (1) मस्ट्टर रोल, स्ट्िीकृजत आिेि, जबल, िाउचर, रजिस्ट्टर, लेखा-परीक्षा फाइलें और कायविाजहयााँ सजहत सभी भौजतक अजभलेखों को संरजक्षत दकया िाएगा और अजधजनयम के अधीन प्राजधकरणों को अंतररत दकया िाएगा।

(2) प्रबंधन सूचना सेिा डेटा, भू-टैग दकए गए फोटोग्राफ, बायोमीररक डाटा, संिाय अजभलेख आदि सजहत सभी जडजिटल अजभलेखों को स्ट् थाजपत प्रदक्रयाओं और कायवप्रणाजलयों के अनुसार प्रजतधाररत और प्रबंजधत दकया िाएगा।

(3) संक्रमण के िौरान सरकार द्वारा िारी अजभलेख प्रजतधारण नीजत के जसिाय दकसी भी अजभलेख को नष्ट नहीं दकया िाएगा।

G.S.R. 547(E).— Whereas the draft of certain rules to be called the Transitional Provisions under Viksit Bharat — Guarantee for Rozgar and Ajeevika Mission (Gramin): VB – G RAM G (जिकजसत भारत - िी राम िी) Rules, 2026 were published, in exercise of the powers conferred by sub-section (1) and clause (p) of sub-section (2) of section 33 and sub-section (5) of section 37 of the Viksit Bharat – Guarantee for Rozgar and Ajeevika Mission (Gramin): VB–G RAM G (जिकजसत भारत - िी राम िी) Act, 2025 (36 of 2025) vide notification of the Government of India in the Ministry of Rural Development (Department of Rural Development) number G.S.R. 397 (E) dated the 22nd May, 2026 in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i), inviting objections and suggestions from persons likely to be affected thereby before the expiry of a period of thirty days from the date of publication of the said notification in the Official Gazette;

And whereas the copies of the Gazette containing the said notification were made available to the public on the 22nd May, 2026;

And whereas objections or suggestions received on the said draft rules have been duly considered by the Central Government.

Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (p) of sub-section (2) of section 33 and sub-section (5) of section 37 of the Viksit Bharat – Guarantee for Rozgar and Ajeevika Mission (Gramin): VB–G RAM G (जिकजसत भारत - िी राम िी) Act, 2025, the Central Government hereby makes the following rules, namely:–

1. Short title and commencement. – (1) These rules may be called the Transitional Provisions under Viksit Bharat — Guarantee for Rozgar and Ajeevika Mission (Gramin): VB – G RAM G (जिकजसत भारत - िी राम िी) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. - In these rules, unless the context otherwise requires, –– (a) “Act” means the Viksit Bharat – Guarantee for Rozgar and Ajeevika Mission (Gramin): VB-G RAM G (जिकजसत भारत - िी राम िी) Act, 2025(36 of 2025); (b) “transition date” means the date of notification of the Scheme by the State Government in accordance with the provisions of section 3 of the Act, or the date of initiation of the interim arrangement by an order issued by the State Government, whichever is earlier:

Provided that such date shall not be beyond the six months from the date of commencement of the Act; (c) “utilisation certificate” means the certificate, in the form prescribed under the General Financial Rules, 2017, furnished by the State Government or Union territory Administration certifying the utilisation of funds released under the Scheme for the purpose for which they were sanctioned; (d) All other words and expressions used herein and not defined, but defined in the Act, shall have the meanings respectively assigned to them in the Act. 3. Settlement of financial liabilities.–– (1) All liabilities under the Mahatma Gandhi National Rural Employment Guarantee Scheme sanctioned under the Mahatma Gandhi National Rural Employment Guarantee Act, 2005 (42 of 2005), shall be verified by the State Government, as having existing up to the 30th June, 2026 .

(2) The State Government shall ensure that all necessary action is taken to settle the admissible liabilities, after due verification, in accordance with the established mechanism in this regard.

(3) The State Government shall submit audited utilisation certificate as mandated under the Mahatma Gandhi National Rural Employment Guarantee Act of 2005 (42 of 2005), by completing all due processes and procedures relating to verification, reconciliation, audit, and reporting of expenditure and liabilities, within a period of one hundred and eighty days from the date of commencement of these rules:

Provided that the Central Government may, for reasons to be recorded in writing and on being satisfied that sufficient cause exists, extend the said period by a further period of ninety days.

(4) The Central Government shall release its share of funds towards the admissible liabilities as per the established rules and procedures of the Central Government in this regard. 4. Funds. - (1) The Central Government shall, subject to the provisions of these rules, ensure fund support for the operation of the Mahatma Gandhi National Rural Employment Guarantee Scheme in the States, including for meeting liabilities existing up to the 30th June, 2026.

(2) The Central share of unspent balances shall be remitted back by the State Government to the Central Government in accordance with the applicable financial rules and procedures in this regard.

(3) Upon commencement of the Act, pending finalisation of the rules relating to objective parameters for normative allocation under the Act, the Central Government may provide interim allocations to the States for implementation of the Scheme, which shall be within the final normative allocation determined in accordance with such rules. 5. Works under the Mahatma Gandhi National Rural Employment Guarantee Scheme. - All ongoing works under the Mahatma Gandhi National Rural Employment Guarantee Scheme as on the transition date may be carried forward under the Act and shall be continued in accordance with the provisions of the Act, including the fund-sharing pattern specified in section 22 of the Act. 6. Worker identity, records and Gramin Rozgar Guarantee Cards. - (1) The Job cards of workers under the Mahatma Gandhi National Rural Employment Guarantee Scheme, which have been renewed and verified through the e-KYC, shall be considered valid to avail employment under the Act:

Provided that where the Central Government, upon being satisfied that e-KYC could not be completed for reasons beyond the control of the worker, considers it necessary to do so in the public interest, such cases may be processed in such manner may be decided by the Central Government.

(2) The arrangement mentioned in sub-rule (1) shall continue till the Gramin Rozgar Guarantee Cards, are issued by the State Government as per the provisions of the Act and the Scheme notified by that Government.

(3) The verified documents or records necessary to fulfil the employment demand under the Mahatma Gandhi National Rural Employment Guarantee Scheme shall continue to be valid till such documents are issued by the State Government as per the provisions in the Act and the Scheme notified by that Government. 7. Statutory guarantee. - (1) Any demand for employment registered under the Mahatma Gandhi National Rural Employment Guarantee Scheme after the transition date shall be considered in accordance with the provisions of the Act.

(2) Where a household has already availed employment for any number of days during the given financial year under the Mahatma Gandhi National Rural Employment Guarantee Scheme, such a household shall remain eligible for the balance of the guaranteed days of employment in that financial year, in accordance with the provisions of the Act. (3) The Programme Officer shall ensure proper adjustment, reconciliation and accounting of such employment. 8. Transfer of movable and immovable assets. – (1) All movable and immovable assets created, procured or maintained under the Mahatma Gandhi National Rural Employment Guarantee Act, 2005 (42 of 2005), shall stand transferred to the authorities under the Act.

(2) The State Government shall prepare and maintain an inventory of all movable and immovable assets pertaining to the Scheme, containing the particulars of such assets and the authority in whom such assets stand transferred or vested, in accordance with the applicable laws, rules and procedures of that Government.

(3) The State Government shall furnish such inventory to the Central Government within a period of six months from the date of commencement of these rules:

Provided that the Central Government may, for reasons to be recorded in writing and on being satisfied that sufficient cause exists, extend the said period by such further period as it may deem fit, not exceeding ninety days:

Provided further that any such arrangement shall be in conformity with the provisions of the General Financial Rules, 2017 and such other financial instructions or guidelines as may be issued by the Central Government. 9. Records, data and documents. - (1) All physical records, including muster rolls, sanction orders, bills, vouchers, registers, audit files and proceedings shall be preserved and transferred to authorities under the Act.

(2) All digital records, including Management Information Service data, geo-tagged photographs, biometric data, payment records, etc., shall be retained and managed as per the established processes and procedures.

(3) No record shall be destroyed during transition except in accordance with the record retention policy issued by the Government.
