OFFICE MEMORANDUM

Subject: Revised Draft Seniority List of Assistant Provident Fund Commissioners Level 10 post in Pay Matrix [Pre-revised Pay Band 3 (15600-39100) with grade pay of Rs. 5400/-] as on 01.01.2023 in EPFO - reg.

Reference is invited to Head Office O.M. No. HRM-II/S-1(1)2023/16143 dated 09.02.2023, whereby a draft seniority list in the cadre of Assistant Provident Fund Commissioner (APFC) as on 01.01.2023 was circulated.

2. In response to the above-mentioned draft seniority list of APFCs as on 01.01.2023, certain representations/objections were received from individual officers. All such representations have been duly examined and suitably replied to.

3. Owing to the induction of some officers in the erstwhile draft seniority list of APFCs as on 01.01.2023, a fresh revised draft seniority list of APFCs as on 01.01.2023 is hereby issued for information of all concerned. However, this revised seniority list will remain subject to the outcome of the following cases pending before the Hon'ble CAT:

• OA No. 1504/2016 titled A.N. Tiwari & Others vs. UOI & Anr. along with MA No. 100/407/2017 and MA No. 100/408/2017 filed by Sh. Ranjan Khare and Sh. Ishwar Dayal Sharma,
• OA No. 435/2021 filed by Sh. Avinash Kumar Sinha before Hon'ble CAT, Patna, and
• OA No. 1327/2021 filed by Sh. Roshan Lal before Hon'ble CAT, Delhi.

4. As stated earlier, replies to all representations submitted against the draft seniority list issued on 09.02.2023 have already been communicated to the concerned officers. Therefore, no fresh grievances on the same grounds for which replies have already been issued may be submitted. However, objections based on new facts or new circumstances, if any, may be sent to HRM through HR Soft in respect of the revised draft seniority list of APFCs as on 01.01.2023 within 10 days from the date of issue of this Office Memorandum.
