L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और रािमागग मंत्रालय अजधसूचना नई दिल्ली, 2 माचग, 2026 सा.का.जन. 153(अ).—केन्‍द रीय मोटरयान अजधजनयम 1988 (1988 का 59) की धारा 212 की उपधारा 1 द्वारा यथाअपेजित टक् कर मारकर भागना मोटरयान िुर्गटना पीजड़त प्रजतकर स्ट् कीम, 2022 का प्रारूप, भारत के रािपत्र असाधारण, भाग II, खंड 3, उपधारा (1) में भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना संख्या सा.का.जन. 755(अ), तारीख 14 अक्टूबर, 2025 द्वारा उन सभी व्यजियों से जिनकी उससे प्रभाजवत होने की संभावना है, ऐसी तारीख से जिसको उि अजधसूचना अंतवर्लगत करने वाली रािपत्र की प्रजतयां िनता को उपलब्ध करवाईं गई थीं, तीस दिन की अवजध समाप्त होने से पूवग, आिेप और सुझाव आमंजत्रत दकए गए थे; और, उि रािपत्र अजधसूचना की प्रजतयां 16 अक्टूबर, 2025 को िनता के जलए उपलब्ध कराई गई थीं; और, उि प्रारूप स्ट्कीम के संबंध में िनता से प्राप्त आिपों और सुझावों पर केन्‍दरीय सरकार द्वारा जवचार दकया िा चुका है; अतः, इसजलए, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 161 और धारा 215 की उपधारा (4) द्वारा प्रित्त िजियों का प्रयोग करते हुए, केन्‍दरीय सरकार टक्कर मारकर भागना मोटर यान िुर्गटना पीजड़त प्रजतकर स्ट्कीम, 2022 में संिोधन करने हेतु जनम्नजलजखत स्ट्कीम बनाती है, अथागत्:- 1. संजिप्त नाम और प्रारंभ.- (1) इस स्ट्कीम का संजिप्त नाम टक्कर मारकर भागना मोटर यान िुर्गटना पीजड़त प्रजतकर (संिोधन) स्ट्कीम, 2026 है। सं. 147] नई दिल्ली, सोमवार, माचग 2, 2026/फाल् गुन 11, 1947 No. 147] NEW DELHI, MONDAY, MARCH 2, 2026/PHALGUNA 11, 1947 सी.जी.-डी.एल.-अ.-05032026-270658 CG-DL-E-05032026-270658 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) ये रािपत्र में उसके प्रकािन की तारीख को लागू होगा। 2. टक् कर मानकर भागना मोटर यान िुर्गटना पीजड़त प्रजतकर स्ट्कीम, 2022 (जिसे इसमें इसके पश्चात् उि स्ट्कीम कहा गया है) के पैरा 2 में,- (क) पैरा 2 को उप-पैरा (1) के रूप में पुनः संख्यांदकत दकया िाएगा; (ख) उप-पैरा (1) के खंड (ख), (ग) और (र्) जिन्‍दहें इस प्रकार पुनः संख्यांदकत दकया गया है, का लोप दकया िाएगा; (ग) उप-पैरा (1) के खंड (छ) के स्ट्थान पर, िैसा दक पुनः संख्यांदकत दकया गया है, जनम्नजलजखत खंड रखा िाएगा, अथागत्:- ‘(छ) "जिला सड़क सुरिा सजमजत" से अजधजनयम की धारा 215 की उपधारा (3) के अधीन गरित सजमजत अभप्रेत है;’; (र्) उप-पैरा (1) के खंड (ि) के पश्चात्, िैसा दक पुनःसंख्यांदकत दकया गया है, जनम्नजलजखत खंड अंत:स्ट्थाजपत दकए िाएंगे, अथागत्:- ‘(छक) "जनजध" से केंरीय मोटर यान (मोटर यान िुर्गटना जनजध) जनयम, 2022 के जनयम 2 के उप-जनयम (ख) में यथापररभाजित मोटर यान िुर्गटना जनजध अजभप्रेत है;’ ‘(छख) "िीआई पररिि" से बीमा अजधजनयम, 1938 (1938 का 4) की धारा 64ग के अधीन गरित साधारण बीमा पररिि अजभप्रेत है;’ (ङ) उप-पैरा (1) के खंड (ञ) को इस प्रकार पुनःसंख्यांदकत दकया िाएगा; (च) उप-पैरा (1) के खंड (ञ) के पश्चात्, िैसा दक पुनःसंख्यांदकत दकया गया है, जनम्नजलजखत खंड अंत:स्ट्थाजपत दकया िाएगा, अथागत्: - ‘(ञक) "पोटगल" से इस स्ट्कीम के प्रयोिन के जलए साधारण बीमा पररिि द्वारा जवकजसत और प्रबंजधत वेब या इलेक्रॉजनक आधाररत प्रणाली अजभप्रेत है;' (छ) इस प्रकार पुनः संख्यांदकत उप-पैरा (1) के खंड (1) के पश्चात् जनम्नजलजखत खंड अंत:स्ट्थाजपत दकया िाएगा, अथागत्,- ‘(ड) "राज्य सड़क सुरिा पररिि" से यथाजस्ट्थजत, दकसी राज्य या संर् राज्यिेत्र के जलए अजधजनयम की धारा 215 की उपधारा (2) के अधीन गरित पररिि अजभप्रेत है।’; (ि) इस प्रकार पुनःसंख्यांदकत खंड (1) के पश्चात् जनम्नजलजखत खंड अंत:स्ट्थाजपत दकया िाएगा, अथागत्:- "(2) इस स्ट्कीम में प्रयुि िब्ि और अजभव्यजियााँ, िो इसमें पररभाजित नहीं हैं, तथा अजधजनयम में पररभाजित हैं, उनका वही अथग होगा िो अजधजनयम में उन्‍दहें क्रमिः दिया गया है।" 3. उि स्ट्कीम में, पैरा 3 के, उप-पैरा (1) में, - (क) खंड (र्) में, "साधारण बीमा" िब्ि के स्ट्थान पर "िीआई" िब्ि रखे िाएंगे; (ख) खंड (i) में, "साधारण बीमा" िब्ि के स्ट्थान पर "िीआई" िब्ि रखे िाएंगे; (ग) खंड (ि) में, "जनिेिक" िब्ि के स्ट्थान पर "उप सजचव की पंजि से नीचे का अजधकारी न हो" िब्ि रखे िाएंगे। 4. उि स्ट्कीम में, पैरा 5 में, (क) खंड (क) में, "साधारण बीमा" िब्िों के स्ट्थान पर "िीआई" िब्ि रखे िाएंगे; (ख) खंड (ख) के स्ट्थान पर जनम्नजलजखत खंड रखा िाएगा, अथागत्:-- “(ख) पैरा 13क के अधीन जवजनर्िगष्ट प्राजधकरण द्वारा उिाए गए मुद्दों पर जवचार करना और स्ट्कीम के कायागन्‍दवयन के जलए जिम्मेिार संबंद्ध अजधकाररयों को मागगििगन या जनिेि प्रिान करना, जिसमें धोखाधड़ी की रोकथाम भी िाजमल है, िहां भी आवश्यक हो;’’; (ग) खंड (र्) का लोप दकया िाएगा; (र्) खंड (र्) के पश्चात् जनम्नजलजखत खंड अंत:स्ट्थाजपत दकया िाएगा, अथागत्: - [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 "(ङ) मामले की पररजस्ट्थजतयों को ध्यान में रखते हुए, यदि समुजचत समझा िाए, तो इस स्ट्कीम के उपबंधों के उल्लंर्न के जलए अजधजनयम की धारा 161 की उपधारा (4) के खंड (ख) के अधीन समुजचत कारगवाई करने हेतु केन्‍दरीय सरकार या राज्य सरकार को जसफाररिें करना।"। 5. उि स्ट्कीम में पैरा 11 और 12 का लोप दकया िाएगा। 6. उि स्ट्कीम में पैरा 13 के स्ट्थान पर जनम्नजलजखत पैरा रखे िाएंगे, अथागत्: “13. जिला सड़क सुरिा सजमजत की िजियां और कृत्य.- (1) जिला सड़क सुरिा सजमजत जिला स्ट्तर पर इस स्ट्कीम के कायागन्‍दवयन से संबंजधत जनम्नजलजखत कृत्य करेगी, अथागत्: - (क) संबंद्ध जिले में इस स्ट्कीम के कायागन्‍दवयन का मूल्यांकन करना और िहां आवश्यक हो, सुधारात्मक किम उिाना: (ख) संबंद्ध जिले में प्राप्त, अजधजनर्णगत या लंजबत िावा आवेिनों और लंबन के कारणों के बारे में मास-वार आंकड़े, इलेक्रॉजनक प्ररूप सजहत, अनुरजित करना; (ग) जिले के अन्‍दय प्राजधकाररयों के साथ र्जनष्ठ संपकग बनाए रखना तादक यह सुजनजश्चत दकया िा सके दक इस स्ट्कीम का पयागप्त प्रचार हो सके; (र्) िहां भी आवश्यक हो, िावेिारों को मागगििगन प्रिान करना; (ङ) िावेिारों को उपलब्ध अजधकारों और इस स्ट्कीम के अधीन प्रजतकर के उपबंध के बारे में िागरूकता बढाना; और (च) पैरा 13क के अधीन जवजनर्िगष्ट अजभकरण या प्राजधकरण को इस स्ट्कीम के संबंध में िानकारी प्रिान करना। (2) संबद्ध िावा िांच अजधकारी और इस स्ट्कीम के पैरा 19 के अधीन नामजनर्िगष्ट अजधकारी को जिला सड़क सुरिा सजमजत की बैिकों में आमंजत्रत दकया िा सकता है िब भी उप-पैरा (1) में दिए गए कृत्य दकए िाते हैं। 13क. राज्य सड़क सुरिा पररिि की िजियां और कृत्य.- (1) राज्य सड़क सुरिा पररिि या राज्य सरकार द्वारा अजभजहत प्राजधकरण यथाजस्ट्थजत, संबद्ध राज्य या संर् राज्यिेत्र में इस स्ट्कीम के कायागन्‍दवयन से संबंजधत जनम्नजलजखत कृत्य कर सकता है, अथागत्, - (क) इस स्ट्कीम के कायागन्‍दवयन की प्रगजत का मूल्यांकन करना और िहां आवश्यक हो, सुधारात्मक किम उिाना; (ख) प्राप्त, अजधजनर्णगत, लंजबत और लंबन के कारणों से संबंजधत िावा आवेिनों के बारे में इलेक्रॉजनक प्ररूप में मास-वार आंकड़ों की समीिा करना; (ग) इस स्ट्कीम के कायागन्‍दवयन में सुधार के जलए संबद्ध जिला अजधकाररयों को जनिेि िारी करना; (र्) इस स्ट्कीम के संबंध में केंरीय सरकार या स्ट्थायी सजमजत को सूचना प्रस्ट्तुत करना या कायागन्‍दवयन संबंधी मुद्दे उिाना।”। 7. उि स्ट्कीम में पैरा 14, 15, 16, 17 और 18 का लोप दकया िाएगा। 8. उि स्ट्कीम में, पैरा 19 में, "साधारण बीमा" िब्िों के स्ट्थान पर "िीआई" िब्ि रखे िाएंगे । 9. उि स्ट्कीम में, पैरा 20 में, उप-पैरा (1) के स्ट्थान पर जनम्नजलजखत उप-पैरा रखा िाएगा, अथागत्: - "(1) आवेिक इस स्ट्कीम के अधीन प्रजतकर की मांग करते हुए प्ररूप-1 में एक आवेिन, प्ररूप-4 में एक वचन पत्र और प्ररूप-1 में उजल्लजखत अन्‍दय िस्ट्तावेिों के साथ, इलेक्रॉजनक माध्यमों सजहत, उस उपमंडल या तालुका के िावा िांच अजधकारी को प्रस्ट्तुत करेगा जिसमें िुर्गटना हुई थी।"। 10. उि स्ट्कीम में, पैरा 21 में, - (क) उप-पैरा (2) में, खंड (ख) में, "िावा जनपटान आयुि" िब्िों के पश्चात्, "पोटगल पर" िब्ि अंत:स्ट्थाजपत दकए िाएंगे; (ख) उप-पैरा (3) में, "ररपोटग 15 दिन के भीतर" िब्िों के पश्चात्, "पोटगल पर" िब्ि अंत:स्ट्थाजपत दकए िाएंगे। 11. उि स्ट्कीम में, पैरा 22 में, - (क) उप-पैरा (1) के स्ट्थान पर जनम्नजलजखत उप-पैरा रखा िाएगा, अथागत्: "(1) िावा िांच अजधकारी की ररपोटग प्राप्त होने पर, िावा जनपटान आयुि यथासंभव, ऐसी ररपोटग प्राप्त होने की तारीख से पंरह दिनों से अजधक की अवजध के भीतर िावे को स्ट्वीकृत करेगा और स्ट्वीकृजत आिेि प्ररूप-3 में, केंरीय मोटर यान (मोटर यान िुर्गटना जनजध) जनयम, 2022 के जनयम 4 के अधीन गरित न्‍दयास द्वारा प्रिाजसत जनजध के टककर मारकर 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] भागना प्रजतकर खाते से संिाय हेतु, पोटगल के माध्यम से भी, िीआई पररिि को सूजचत करेगा, जिसकी एक प्रजत जनम्नजलजखत को भी भेिी िाएगी: - (क) िावा िांच अजधकारी; (ख) िावेिार; (ग) संबद्ध मोटर यान िुर्गटना िावा अजधकरण; (र्) संबद्ध पररवहन आयुि; (ङ) जिला सड़क सुरिा सजमजत के सिस्ट्य-सजचव।" (ख) उप-पैरा (2) और उसके परंतुकों का लोप दकया िाएगा । 12. उि स्ट्कीम में, पैरा 23 में, - (क) उप-पैरा (2) में, "उपजहत व्यजि" िब्िों के स्ट्थान पर, "यथाजस्ट्थजत र्ायल व्यजि या मृतक के जवजधक प्रजतजनजधयों को, यदि ऐसे व्यजि की मृत्यु िुर्गटना से असंबंजधत कारणों से होती है, िावा िांच अजधकारी द्वारा तय दकया गया हो" िब्ि रखे िाएंगे। (ख) उप-पैरा (3) में,- (i) "साधारण बीमा पररिि् (िीआईसी)" िब्िों और कोष्ठकों के स्ट्थान पर "िीआईसी पररिि्" िब्ि रखे िाएंगे; (ii) िब्ि "और िावाकताग के प्ररूपों और िस्ट्तावेिों," का लोप दकया िाएगा। (iii) उप-पैरा (4) में परंतुक के पश्चात्, जनम्नजलजखत परंतुक अंत:स्ट्थाजपत दकया िाएगा, अथागत्:-- “परंतु और यह दक, यदि उप-पैरा (3) के अधीन संिाय करने के जलए िावेिार द्वारा िी गई िानकारी में कोई कमी पाई िाती है, जिसमें बैंक खाता जववरण भी िाजमल है, लेदकन इन्‍दहीं तक सीजमत नहीं है, तो िी.आई. पररिि, संबंजधत िावा जनपटान आयुि के समन्‍दवय से, इस उप-पैरा में जवजनर्िगष्ट अवजध के भीतर िावेिार से आवश्यक िानकारी प्राप्त कर सकती है।” 13. उि स्ट्कीम में, पैरा 24 में, "साधारण बीमा" िब्िों के स्ट्थान पर "िीआई" िब्ि रखे िाएंगे। 14. उि स्ट्कीम में, "प्ररूप 1" के स्ट्थान पर जनम्नजलजखत प्ररूप रखा िाएगा, अथागत्: - "प्ररूप 1 [पैरा 20 (1)] टक् कर मारकर भागना मोटर यान िुर्गटना पीजड़त प्रजतकर स्ट्कीम, 2022 आवेिन प्ररूप गंभीर चोट के मामले में: 1.मैं,...............................पुत्र/पुत्री/पजत/पत्नी..............................जनवासी...................................तारीख.......... को.................. पर हुई िुर्गटना में गंभीर रूप से र्ायल होने पर, केंरीय सरकार के मोटर यान िुर्गटना जनजध से प्रजतकर की मांग करते हुए आवेिन करता हं। मेरी चोट से संबंजधत आवश्यक जववरण नीचे दिए गए हैं:- गंभीर चोट के मामले में (जवजधक प्रजतजनजध के माध्यम से): मैं,...........................................पुत्र/पुत्री/पजत/पत्नी,.........................................जनवासी................................. , का कानूनी प्रजतजनजध……………. पुत्र/पुत्री/पजत/पत्नी........... होने के नाते तारीख……………. को…………………. पर हुई टक्कर मारकर भागना मोटर वाहन िुर्गटना में, िहााँ मैं रहता/रहती हाँ, िो गंभीर रूप से [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 र्ायल हो गया/गई और िुर्गटना से असंबंजधत दकसी अन्‍दय कारण से मृत्यु हो गई, और मैं केन्‍दरीय सरकार के मोटर यान िुर्गटना जनजध से प्रजतकर के जलए आवेिन करता/करती हाँ। मुझे लगी चोटों से संबंजधत आवश्यक जववरण नीचे दिए गए हैं: मौत के मामले के जलए 1.मैं.........................................पुत्र/पुत्री/पजत/पत्नी....................................जनवासी..................................., .............................. पुत्री/पजत/पत्नी के कानूनी प्रजतजनजध के रूप में, ............ पर जस्ट्थत अपने जनवास स्ट्थान पर हुई टक्कर मारकर भागना मोटर यान िुर्गटना में मृतक/मृतक को हुई चोटों के जलए मोटर वाहन िुर्गटना कोि से प्रजतकर की प्राजप्त हेतु आवेिन करता/करती हाँ। िुर्गटना से संबंजधत आवश्यक जववरण और अन्‍दय िानकारी नीचे िी गई है:- 1. र्ायल/मृत व्यजि का नाम और जपता का नाम (जववाजहत मजहला या जवधवा के मामले में पजत का नाम)... (ii) खाता संख्या.... 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) आईएफएससी... तारीख................... िावा जनपटान आयुि के हस्ट्तािर एवं मुहर प्रजत : 1. िावेिार 2. िावा िांच अजधकारी 3. संबद्ध मोटर िुर्गटना िावा अजधकरण 4. जिला सड़क सुरिा सजमजत के सिस्ट्य-सजचव। [फा.सं. आरटी-11014/37/2025-एमवीएल] महमूि अहमि, अपर सजचव रटप्पण: मूल जनयम, भारत के रािपत्र, असाधारण, भाग-II, खंड 3, उप-खंड (i) में अजधसूचना संख्या सा.का.जन. 163(अ), तारीख 25 फरवरी, 2022 द्वारा प्रकाजित दकए गए थे। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 2nd March, 2026 G.S.R. 153(E).—Whereas, the draft Scheme to amend the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022, were published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways, vide number G.S.R 755(E), dated the 14th October , 2025, in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to public; And, whereas, copies of the said Gazette notification, was made available to the public on 16th October, 2025; And, whereas, the objections and suggestions received from the public in respect of the said draft Scheme have been considered by Central Government; Now, therefore, in exercise of the powers conferred by section 161 and sub-section (4) of section 215 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following Scheme, to amend the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022, namely:- 1. Short title and commencement. - (1) This Scheme may be called as the Compensation to Victims of Hit and Run Motor Accidents (Amendment) Scheme, 2026. (2) It shall come into force on the date of its publication in the Official Gazette. 2. In the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022 (hereinafter referred to as the said Scheme), in paragraph 2,— (a) the paragraph 2 shall be renumbered as sub-paragraph (1); (b) clauses (b), (c) and (d) of sub-paragraph (1) as so renumbered shall be omitted; (c) for clause (g) of sub-paragraph (1) as so renumbered, the following clause shall be substituted, namely:— [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 ‘(g) “District Road Safety Committee” means a Committee set up under sub-section (3) of section 215 of the Act;’; (d) after clause (h) of sub-paragraph (1) as so renumbered, the following clauses shall be inserted, namely:— ‘(ha) “Fund” means the Motor Vehicle Accident Fund as defined in sub-rule (b) of rule 2 of the Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022; ‘(hb) “GI Council” means the General Insurance Council constituted under section 64C of the Insurance Act, 1938 (4 of 1938);’ (e) clauses (j) of sub-paragraph (1) as so renumbered shall be omitted; (f) after clause (j) of sub-paragraph (1) as so renumbered, the following clause shall be inserted, namely: — ‘(ja) “portal” means a web or electronic based system developed and managed by the General Insurance Council for the purpose of this scheme;’; (g) after clause (l) of sub-paragraph (1) as so renumbered, the following clause shall be inserted, namely, — ‘(m) “State Road Safety Council” means the Council for a State or Union territory, as the case may be, constituted under sub-section (2) of section 215 of the Act.’; (h) After clause (1) as so renumbered, following clause shall be inserted, namely, — “(2) Words and expressions used in this Scheme but not defined herein, and defined in the Act, shall have the same meanings respectively assigned to them in the Act.” 3. In the said Scheme, in paragraph 3, in sub-paragraph (1), — (a) in clause (d), for the word “General Insurance”, the word “GI” shall be substituted; (b) in clause (i), for the word “General Insurance”, the word “GI” shall be substituted; (c) in clause (h), for the word “Director”, the words “an officer not below the rank of Deputy Secretary” shall be substituted. 4. In the said Scheme, in paragraph 5, — (a) in clause (a), for the words “General Insurance”, the word “GI” shall be substituted; (b) for clause (b), the following clause shall be substituted, namely, — “(b) consider the issues raised by the authority specified under paragraph 13A and provide guidance or directions to concerned officials responsible for implementation of the scheme, including on prevention of fraud, wherever called for;”; (c) clause (d) shall be omitted; (d) after clause (d), the following clause shall be inserted, namely: — “(e) having regards to the circumstances of the case, if deemed appropriate, make recommendations to the Central Government or State Government for taking appropriate action under clause (b) of sub-section (4) of section 161 of the Act for contravention of provisions of this scheme.”. 5. In the said Scheme, paragraphs 11 and 12 shall be omitted. 6. In the said Scheme, for paragraph 13, the following paragraphs shall be substituted, namely: — “13. Powers and functions of the District Road Safety Committee.—(1) The District Road Safety Committee shall undertake following functions connected with the implementation of this scheme at the District Level, namely: — (a) evaluate the implementation of this scheme in the concerned District and take corrective steps, wherever necessary; (b) maintain month-wise statistics, including in electronic form, about the claim applications received, awarded or pending and reasons for pendency in the concerned District; (c) keep close liaison with other authorities in the district so as to ensure that this scheme gets adequate publicity; (d) provide guidance to claimants, wherever called for; (e) raise awareness about the rights available to claimants and the provision of compensation under this scheme; and (f) furnish information in respect of this scheme to the agency or authority specified under paragraph 13A. 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) The concerned Claims Enquiry Officer and the officer nominated under paragraph 19 of this scheme may be invited in the meetings of the District Road Safety Committee whenever the functions provided in sub-paragraph (1) are undertaken. 13A. Powers and Functions of the State Road Safety Council.- (1) The State Road Safety Council or authority as may be designated by the State Government may undertake following functions connected with the implementation of this scheme in the concerned State or Union territory, as the case may be, namely, — (a) evaluate the progress of implementation of this scheme and take corrective steps, wherever necessary; (b) review month-wise statistics, including in electronic form, about the claim applications received, awarded, pending and reasons for pendency; (c) issue directions to concerned district authorities for improving the implementation of this scheme; (d) furnish information or raise implementation related issue to the Central Government or Standing Committee in respect of this scheme.”. 7. In the said Scheme, paragraphs 14, 15, 16, 17 and 18 shall be omitted. 8. In the said Scheme, in paragraph 19, for the words “General Insurance”, the word “GI” shall be substituted. 9. In the said Scheme, in paragraph 20, for sub-paragraph (1), the following sub-paragraph shall be substituted, namely: — “(1) The applicant shall submit an application seeking compensation under this scheme in Form I, along with an undertaking in Form IV, and such other documents mentioned in Form I, including through electronic means, to the Claims Enquiry Officer of the Sub-Division or Taluka in which the accident took place.”. 10. In the said Scheme, in paragraph 21, — (a) in sub-paragraph (2), in clause (b), after the words “Claims Settlement Commissioner”, the words “on the portal” shall be inserted; (b) in sub-paragraph (3), after the words “report to the Claims Enquiry Officer”, the words “on the portal” shall be inserted. 11. In the said Scheme, in paragraph 22, — (a) for sub-paragraph (1), the following sub-paragraph shall be substituted, namely: — “(1) On receipt of report of the Claims Enquiry Officer, the Claims Settlement Commissioner shall sanction the claim, as far as possible, within a period not exceeding fifteen days from the date of receipt of such report and communicate the sanction order in Form III, to the GI Council, including through the portal, for payment from the Hit and Run Compensation Account of the Fund administered by the Trust constituted under rule 4 of the Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022, with a copy to the following: — (a) the Claims Enquiry Officer; (b) the claimant; (c) the concerned Motor Accident Claim Tribunal; (d) the concerned Transport Commissioner; (e) Member-Secretary, District Road Safety Committee.”. (b) sub-paragraph (2) and the provisos thereto shall be omitted. 12. In the said Scheme, in paragraph 23, — (a) in sub-paragraph (2), after the words “person injured”, the words “or to the legal representatives of the deceased decided by the Claims Enquiry Officer in case such person dies due to causes unrelated to the accident, as the case may be” shall inserted. (b) in sub-paragraph (3), — (i) for the words and brackets “General Insurance Council (GIC)”, the words “GI Council” shall be substituted; (ii) words “and the Forms and documents from claimant,” shall be omitted. (iii) in sub-paragraph (4), after the proviso, following proviso shall be inserted, namely, — [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 "Provided further that in case of any deficiency in the particulars furnished by the claimant necessary for making the payment under sub-paragraph (3), including but not limited to bank account details, the GI Council, in coordination with the concerned Claim Settlement Commissioner, may, within the period specified in this sub-paragraph, seek the necessary information from the claimant." 13. In the said Scheme, in paragraph 24, for the words “General Insurance”, the word “GI” shall be substituted. 14. In the said Scheme, for “Form I”, the following Form shall be substituted, namely: — “FORM I [Paragraph 20 (1)] COMPENSATION TO VICTIMS OF HIT AND RUN MOTOR ACCIDENTS SCHEME, 2022 Application Form For grievous hurt case:* I, ....................................son / daughter / spouse of ........................... residing at ........................................... having been grievously injured in hit and run motor vehicle accident on .................. at .................................hereby apply for grant of compensation for the grievous injuries sustained from the Central Government’s Motor Vehicle Accident Fund.
