पत्तन, पोत पररवहन और िलमागग मंत्रालय अजधसूचना नई दिल्ली, 12 मई, 2026 सा.का.जन. 354(अ).––केन्द्रीय सरकार वाजणज्य पोत पररवहन अजधजनयम, 2025 (2025 का 24)धारा 228 की उपधारा (4) के साथ परित धारा 230 के द्वारा प्रित्त िजियों का प्रयोग करते हुए जनम्नजलजखत जनयम बनाती है, अथागत्: -

1. संजिप्त नाम और प्रारंभ (1) इन जनयमों का संजिप्त नाम वाजणज्य पोत पररवहन (समुरी घटना और आपातकालीन प्रजतदिया) जनयम, 2026 है। (2) ये रािपत्र में इनके प्रकािन की तारीख को प्रवृत होंगे ।
2. पररभाषाएँ -(1) इन जनयमों में, िब तक दक संिभग से अन्द्यथा अपेजित न हो, - (क) "अजधजनयम" से वाजणज्य पोत पररवहन अजधजनयम, 2025, (2025 का 24) अजभप्रेत है। (ख) "पोत पररवहन महाजनिेिालय संचार केंर" से समुरी सुरिा, संरिा और आपातकालीन प्रजतदिया के जलए भारतीय प्रचालन केंर अजभप्रेत है िो अपघटन और आपातकालीन ररपोर्टिंग के जलए दकसी एकल बबंिु के रूप में समुरी प्रिासन महाजनिेिालय के अधीन कायग करता है; (ग) "समुरी अपघटन" से एक घटना, या घटनाओं का कोई िम, िो जनम्नजलजखत के पररणामस्ट्वरूप हुआ है और जिसका सीधा संबंध पोत के प्रचालन से है, - i. दकसी व्यजि की मृत्यु, या उसे गंभीर िजत; सं. 320] नई दिल्ली, मंगलवार, मई 12, 2026/वैिाख 22, 1948

2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ii. दकसी पोत से दकसी व्यजि की हाजन; iii. दकसी पोत की हाजन, अनुमाजनत हाजन या पररत्याग ; iv. दकसी पोत को भौजतक िजत; v. दकसी पोत का तट पर फंस िाना या अकायगिील हो िाना, या दकसी टक्कर में पोत का िाजमल होना; vi. समुरी बुजनयािी ढांचे की भौजतक िजत िो दकसी पोत के बाहर है, िो पोत, दकसी अन्द्य पोत या दकसी व्यजि की सुरिा को गंभीर रूप से खतरे में डाल सकती है; या vii. पयागवरण की गंभीर िजत, या दकसी पोत या पोतों से होने वाली दकसी िजत से पयागवरण को गंभीर िजत होने की संभावना; (घ) "समुरी बचाव समन्द्वय केंर" से भारतीय तटरिक बल की एक जविेष इकाई अजभप्रेत है, िो एक अजभजहत खोि और बचाव िेत्र के भीतर समुरी खोि और बचाव सेवाओं के आयोिन और समन्द्वय के जलए उत्तरिायी है, िो जवपजत्त चेतावनी का प्रबंधन करने, संसाधनों (पोतों, जवमानों) को तैनात करने और समुरीय जवपजत्त में लोगों या िलयानों के जलए बचाव कायो का जनिेि करने हेतु मुख्य केंर के रूप में कायग करता है। (ङ) "समुरी बचाव उप-केंर" से मुख्य समुरी बचाव समन्द्वय केंर के अजधनस्ट्थ भारतीय तटरिक बल की कोई िेत्रीय प्रचालन इकाई अजभप्रेत है, िो अपने अजभजहत िेत्र के भीतर छोटे पैमाने पर खोि और बचाव गजतजवजधयों का प्रबंधन और समन्द्वय करती है; (च) "नोडल प्राजधकारी" से अजधजनयम की धारा 225 के अधीन केन्द्रीय सरकार द्वारा जनयुि प्राजधकारी अजभप्रेत है; (छ) ''अध्यापेिा'' से आपातकालीन प्रजतदिया के जलए कर्मगयों, उपकरणों, िलयानों या सुजवधाओं के उपयोग की अपेिा करने वाले नोडल प्राजधकारी द्वारा कोई जवजधपूणग आिेि। (2) ऐसे िब्ि और जिन्द्हें इन जनयमों में प्रयुि दकया गया है दकन्द्तु अजधजनयम में पररभाजषत नहीं है, के िमिः वही अथग होंगे िो अजधजनयम में उनके हैं। 3. नोडल प्राजधकारी के कतगव्य और िजियां- (1) नोडल प्राजधकारी समुरी घटनाओं की प्रजतदिया का समन्द्वय और पयगवेिण करती है , जिससे िलयानों, व्यजियों, संपजत्त, िहािी माल और समुरी पयागवरण को न्द्यूनतम िजत पहुँचें। (2) नोडल प्राजधकारी समुरी घटनाओं और आपात जस्ट्थजतयों को प्रभावी ढंग से कम करने और प्रबंजधत करने के जलए जनिेि िारी करने, संसाधन िुटाने और अंतर-अजभकरण सहयोग का समन्द्वय करने सजहत सभी आवश्यक और समीचीन उपाय करेगा। (3) नोडल प्राजधकारी, अजधजनयम के उपबंधों और इन जनयमों के अधीन, जनम्नजलजखत उद्देश्यों में से दकसी के जलए दकसी व्यजि, स्ट्वामी, चालक िल, पोत स्ट्वामी, पोत प्रबंधकों, पोत प्रचालकों, पत्तन प्राजधकारी, ध्वि राष्ट्र प्राजधकारी, बचावकताग, बीमाकतागओं या समुरी घटना में िाजमल या प्रभाजवत दकसी अन्द्य इकाई को सुरिा जनिेि या जनिेिात्मक जसद्ांत िारी कर सकेगा, अथागत्: - (क) पोत या अन्द्य पोतों की सुरिा सुजनजित करने के जलए; (ख) व्यजियों की सुरिा सुजनजित करने के जलए; (ग) संपजत्त की सुरिा सुजनजित करने के जलए; (घ) समुर में और तट रेखा पर बहकर आने वाले खतरनाक और हाजनकारक पिाथग सजहत समुरी खतरों को हटाने या संरोधन की अपेिा करने के जलए; (ङ) बचाव, अजििमन, प्रिूषण जनयंत्रण और जवसंिूषण सजहत आपातकालीन प्रजतदिया उपायों को आज्ञापक बनाने के जलए; (च) घटना और प्रजतदिया संबंधी कारगवाइयों से संबंजधत आवजधक रूप से ररपोटग करने और िस्ट्तावेजीकरण की अपेिा के जलए; (छ) समुरी घटना के प्रबंधन में अंतवगजलत राष्ट्रीय और पयागप्त रूप से जहतबद्ध अंतरागष्ट्रीय अजभकरणों और

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 प्राजधकरणों के साथ समन्द्वय और सहयोग करना, जिसमें भारतीय नौसेना, तटीय राज्य प्राजधकरणों, ध्वि राष्ट्र प्राजधकरणों, पत्तन राष्ट्र प्राजधकरणों, भारतीय तटरिक बल और कोई अन्द्य सुसंगत जनकाय िाजमल हैं, दकन्द्तु इन्द्हीं तक सीजमत नहीं हैं; और (ज) दकसी समुरी घटना के प्रजतकूल प्रभावों को कम करने के जलए आवश्यक कोई अन्द्य कायग करना। (4) यदि नोडल प्राजधकारी द्वारा िारी जनिेि का पयागप्त पररणाम प्राप्त नहीं हुआ है या होने की संभावना नहीं है, तो नोडल प्राजधकारी ऐसी कारगवाई कर सकेगा या उसे प्राजधकृत कर सकेगा िो वह उजचत समझे, जिसमें जनम्नजलजखत सजममजलत हैं,- (क) दकसी भूजम या पररसर में प्रवेि करना, या ऐसा करने के जलए व्यजियों को प्राजधकृत करना; (ख) घटना सुसंगत दकसी पोत या संपजत्त का जनयंत्रण रखना; (ग) प्रिूषण जनवारण, खतरों को हटाने और बचाव कायो सजहत आपातकालीन प्रजतदिया सेवाओं को कायागजन्द्वत करना या व्यवजस्ट्थत करना; (घ) आपातकालीन प्रजतदिया और उपचार से संबंजधत सभी गजतजवजधयों का समन्द्वय और पयगवेिण करना। (5) नोडल प्राजधकारी िारी दकए गए जनिेिों का सभी पिों द्वारा अनुपालन दकए िाने की जनगरानी करेगा। ऐसी पररजस्ट्थजतयों में िहां जनिेिों का कोई उल्लंघन हो सकता है, अजधजनयम की धारा 11 की उप-धारा (2) के अधीन जनयुि प्रधान अजधकारी, अजधजनयम की धारा 281 की उप-धारा (2) के अधीन यथाजवजनर्िगष्ट कोई िजि प्रवृत कर सकेगा। (6) महाजनिेिक यह सुजनजित करेगा दक समुरी घटनाओं की प्रजतदिया में िाजमल सभी इकाइयों के बीच नोडल प्राजधकारी द्वारा घटनाओं के जलए त्वररत और प्रभावी प्रजतदिया के जलए समग्र समन्द्वय हो। महाजनिेिक समुरी घटनाओं की प्रजतदिया िेने के जलए प्राथजमक प्रजतदिया िल के संसाधनों को िुटाने के जलए पोत स्ट्वाजमयों, ध्वि राष्ठ्र प्राजधकरणों, पत्तन राज्य प्राजधकरणों और तटीय राज्य प्राजधकरणों के साथ संचार को सुकर बनाएगा। 4. वें पररजस्ट्थजतयाँ जिनके अधीन नोडल प्राजधकारी समुरी आपातकालीन प्रजतदिया करेगा - (1) िब प्राथजमक प्रजतदिया िल की ओर से समय पर संसाधन िुटाने या समय पर आपातकालीन प्रजतदिया िेने में दकसी प्रकार का जवलंब हो और ऐसा करने के युजियुि कारण हों, तब नोडल प्राजधकारी तत्काल प्रजतदिया हेतु कारगवाई िुरू करेगा और कायग का जनष्पािन करेगा। (2) प्राथजमक प्रजतदिया िल के आगमन और प्रचालन तत्परता पर, नोडल प्राजधकारी , , प्राथजमक प्रजतदिया िल को प्रजतदिया उपायों का जनयंत्रण हस्ट्तांतररत कर सकेगा या छोड़ सकेगा िो वह उजचत समझे । 5. लागतों की वसूली- (1) जनयम 3 के उप-जनयम (4) के अधीन नोडल प्राजधकारी द्वारा िारी दकए गए जनिेिों का अनुपालन करने वाला कोई भी व्यजि या इकाई, ऐसे अनुपालन में युजियुि रूप से उधगत की गई पूणग लागत को पोत स्ट्वामी से वसूलने का हकिार होगा। (2) िहां, कारगवाई के िौरान जनयम 3 के उप-जनयम (4) के अधीन नोडल प्राजधकारी द्वारा प्राजधकृत या जनिेजित कारगवाई के िम में ऐसे तटीय भूजम या पररसर का उपयोग दकया िाता है या प्रभाजवत होता है ऐसे भूजम या पररसर का पोत स्ट्वामी से युजियुि रूप से उपगत की गई लागत वसूलने का हकिार होगा। (3) जनयम 4 के अधीन समुरी आपातकालीन प्रजतदिया को जनष्पादित करने में केन्द्रीय सरकार, राज्य सरकार या नोडल प्राजधकारी द्वारा दकए गए दकसी लागत को पोत स्ट्वामी से ऐसे प्रभारो या िरों पर वसूल दकया िाएगा िो संबंजधत सरकार द्वारा समय-समय पर जवजनर्िगष्ट दकया िाएगा। 6. अजभलेख रखना और लेखा परीिा - (1) सभी पत्तन और अपतटीय प्रसुजवधा कम से कम पांच साल की अवजध के जलए भौजतक या इलेक्ट्रॉजनक रूप में घटनाओं का लॉग, जनरीिण अजभलेख और प्रजििण िस्ट्तावेज का अनुरिण करेंगे। (2) नोडल प्राजधकारी ऐसे पत्तनों और अपतटीय प्रसुजवधाओं का वार्षगक लेखा परीिा करा सकेगा, या तैयारी और अनुपालन को सत्याजपत करने के जलए आकजस्ट्मक जनरीिण कर सकेगा। [फा. सं. एसवाई-19014/204/2025-एमिी] मुकेि मंगल, अपर सजचव

G.S.R. 354(E).–– In exercise of the powers conferred by section 230 read with sub-section (4) of section 228 of the Merchant Shipping Act, 2025 (24 of 2025), the Central Government hereby makes the following rules, namely:––

1. Short title and commencement. –– (1) These rules may be called the Merchant Shipping (Marine Incident and Emergency Response) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. –– (1) In these rules, unless the context otherwise requires, – (a) “Act” means the Merchant Shipping Act, 2025, (24 of 2025); (b) “Directorate General of Shipping Communication Centre” means the Indian operational hub for maritime safety, security, and emergency response, functioning under the Directorate General of Maritime Administration as a single point for casualty and emergency reporting; (c) “marine casualty” means an event, or a sequence of events, that has resulted in any of the following which has occurred directly in connection with the operations of a ship, – (i) the death of, or serious injury to, a person; (ii) the loss of a person from a ship; (iii) the loss, presumed loss or abandonment of a ship; (iv) material damage to a ship; (v) the stranding or disabling of a ship, or the involvement of a ship in a collision; (vi) material damage to marine infrastructure external to a ship, that could seriously endanger the safety of the ship, another ship or an individual; or (vii) severe damage to the environment, or the potential for severe damage to the environment, brought about by the damage of a ship or ships; (d) “Maritime Rescue Coordination Centre” means a specialised unit of the Indian Coast Guard, responsible for organizing and coordinating maritime search and rescue services, acting as the central hub to manage distress alerts, deploy resources (ships, aircraft), and direct rescue operations for people or vessels in peril at sea within a designated search and rescue region ; (e) “Maritime Rescue Sub-Centre” means a regional operational unit of the Indian Coast Guard, subordinate to a main Maritime Rescue Coordination Centre, that manages and coordinates smaller-scale search and rescue activities within its designated area; (f) “nodal authority” means an authority appointed by the Central Government under section 225 of the Act; (g) “requisition” means any lawful order by the nodal authority requiring use of personnel, equipment, vessels or facilities for emergency response. (2) Words and expressions used in these rules and not defined but defined in the Act shall have meanings respectively assigned to them in the Act.
3. Duties and powers of the nodal authority.–– (1) The nodal authority shall coordinate and supervise the response to marine incidents to ensure minimum damage to vessels, persons, property, cargo, and the marine environment. (2) The nodal authority shall take all necessary and expedient measures, including issuing directives, mobilising resources, and coordinating inter-agency cooperation to mitigate and manage marine incidents and emergencies effectively. (3) The nodal authority may, subject to the provisions of the Act and these rules, issue safety directions or directives to any person, master, crew, ship owner, ship managers, ship operators, port authority, flag state authority, salvors, insurers or any other entity involved in or affected by the marine incident for any of the following purposes, namely:– (a) to secure the safety of the ship or other ships;

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (b) to secure the safety of persons; (c) to secure the safety of property; (d) to require removal or containment of marine hazards including hazardous and noxious substances spilled at sea and on being washed ashore on coastline; (e) to mandate emergency response measures including salvage, firefighting, pollution control, and decontamination; (f) to require periodic reporting and documentation related to the incident and response actions; (g) to coordinate and cooperate with national and substantially interested international agencies and authorities involved in marine incident management, including but not limited to the Indian Navy, Coastal State Authorities, Flag State Authorities, Port State Authorities, Indian Coast Guard, and any other relevant bodies; and (h) to perform any other acts as may be necessary to mitigate the adverse effects of a marine incident. (4) If a directive issued by the nodal authority is not likely to or has not achieved a sufficient result, the nodal authority may take or authorise such action as deemed necessary, including,— (a) entering any land or premises, or authorising persons to do so; (b) assuming control of any ship or property relevant to the incident; (c) implementing or arranging for emergency response services, including pollution prevention, removal of hazards, and salvage operations; (d) coordinating with and supervising all activities related to emergency response and remediation. (5) The nodal authority shall oversee compliance by all parties with the directions issued. In circumstances where there may be any contravention to the directions, the Principal Officer, appointed under sub-section (2) of section 11 of the Act, may enforce penalties as specified under sub-section (2) of section 281 of the Act. (6) The Director-General shall ensure overall co-ordination among all the entities involved in response to marine incidents for prompt and effective response to the incidents by the nodal authority. The Director-General shall facilitate communication with the ship owners, flag state authorities, port state authorities and coastal state authorities for mobilising the resources of the primary response party for responding to the marine incidents. 4. Circumstances under which the nodal authority shall carry out maritime emergency response. – (1) The nodal authority shall initiate and execute immediate response action, where there are reasonable grounds, including any delay or inability on the part of the primary response party, to mobilise resources in time or undertake timely emergency response. (2) Upon arrival and operational readiness of the primary response party, the nodal authority may, as deemed appropriate, transfer or relinquish control of the response measures to the primary response party. 5. Recovery of costs. – (1) Any person or entity complying with directives issued by the nodal authority, under sub-rule (4) of rule 3, shall be entitled to recover the costs reasonably incurred in such compliance from the ship owner. (2) Where coastal land or premises are used or affected in the course of actions authorised or directed by the nodal authority under sub-rule (4) of rule 3, the owner of such land or premises shall be entitled to recover the costs reasonably incurred, from the ship owner. (3) Any costs incurred by the Central Government, State Government or nodal authority in executing maritime emergency response under rule 4, shall be recoverable from the ship owner, at such charges or rates as may be specified by the concerned government from time to time. 6. Record keeping and audit. – (1) All ports and offshore facilities shall maintain incident logs, inspection records, and training documentation, in physical or electronic form, for a minimum period of five years. (2) The nodal authority may conduct audits of such ports and offshore facilities, annually, or may conduct a surprise inspection to verify preparedness and compliance. [F.
