सा.का.णि. 114(अ).— जविेष आर्थिक क्षेत्र अजधजनयम, 2005 (2005 का 28) की धारा 55 द्वारा प्रदत्त शणियों
का प्रयोग करते हुए, केन्द्र सरकार णवशेष आर्थिक क्षेत्र णियम, 2006 में आगे संिोधन करिे के णिए णिम्नणिणित णियम
बिाती है, अथाित:-
1. संजक्षप्त नाम और प्रारंभ।
(1) इन जनयमों को जविेष आर्थिक क्षेत्र जनयम, 2026 कहा िा सकता है।
(2) ये जनयम रािपत्र में प्रकािन की जतजथ से लागू होंगे।
2. जविेष आर्थिक क्षेत्र जनयम, 2006 (इसके बाि इन्हें मुख्य जनयम कहा िाएगा) के जनयम 19 में उप-जनयम (1) के बाि
जनम्नजलजखत उप-जनयम के अन्तर्निजवष्ट दकया िाएगा, अथाित्: -
“(1क) प्रिासक (आईएफएससीए) अंतरािष्ट्रीय जवत्तीय सेवा केंद्र में यूजनट की स्ट्थापना के जलए प्रपत्र िीए में अनुमोिन पत्र
िारी करेगा।”
(3) मुख्य जनयमों में प्रपत्र िी के बाि जनम्नजलजखत प्रपत्र अन्तर्निजवष्ट दकया िाएगा, अथाित्: -

जवत्तीय सेवा केंद्र इकाई की स्ट्थापना के जलए आपका प्रस्ट्ताव
महोिय/महोिया
उपयुिक्त आवेिन के संिभि में, गुिरात अंतरािष्ट्रीय जवत्त प्रौद्योजगकी बहु सेवा-जविेष आर्थिक क्षेत्र के प्रिासक
(आईएफएससीए) आपको जविेष आर्थिक क्षेत्र अजधजनयम, 2005 और जविेष आर्थिक क्षेत्र जनयम, 2006
तथा उसके अंतगित िारी आिेिों के प्रावधानों के अधीन, जविेष आर्थिक क्षेत्र में एक इकाई को प्राप्त होने वाली
सभी सुजवधाएं और अजधकार प्रिान करती हैं, बिते दक सभी संबंजधत जवजनयामक प्राजधकरणों से सभी
अजनवायि/सांजवजधक अनुमोिन/अनुमजतयां प्राप्त कर ली गई हों, और ______________________ राज्य
में ______________________________ में प्राजधकृत संचालन करने के जलए एक इकाई की स्ट्थापना की
िा सके, अथाित्:-
प्राजधकृत पररचालन
1.
यह अनुमोिन जनम्नजलजखत जनयमों और ितों के अध्यधीन है:
(i) आप प्रजधकृत पररचालन िुरू होने की जतजथ से पांच वषि की अवजध के जलए जविेष आर्थिक क्षेत्र
अजधजनयम, 2005 और उसके अंतगित बनाए गए जविेष आर्थिक क्षेत्र जनयम, 2006 के प्रावधानों के
अनुसार जवत्तीय सेवाओं का जनयाित करेंगे। इस उद्देश्य के जलए, आप जविेष आर्थिक क्षेत्र जनयम, 2006
के अंतगित जनधािररत बांड-सह-कानूनी वचनपत्र को जनष्पादित करेंगे।
(ii) आप प्रिूषण जनयंत्रण प्राजधकाररयों द्वारा जनधािररत प्रिूषण जनयंत्रण आवश्यकताओं का अनुपालन करेंगे।
(iii) आप अनुमोिन के अंतगित अपने अजधकृत कायों के जलए आवश्यक सभी वस्ट्तुओं का आयात या खरीि
घरेलू टैररफ क्षेत्र से कर सकते हैं, जसवाय उन वस्ट्तुओं के िो जनयाित और आयात वस्ट्तुओं के आईटीसी
(एचएस) वगीकरण के तहत जनजषद्ध हैं।
(iv) आप घरेलू टैररफ क्षेत्र में और जनधािररत मानिंडों के अनुसार, जिनमें एसईिेड अजधजनयम, 2005 और
जविेष आर्थिक क्षेत्र जनयम, 2006 तथा उनके अंतगित िारी आिेि िाजमल हैं, आपूर्ति या सेवाएं प्रिान
कर सकते हैं।
(v) यह अनुमोिन पत्र िारी होने की जतजथ से एक वषि की अवजध के जलए वैध है। आपको पररयोिना को
कायािजन्वत करेंगे और एक वषि की अवजध के भीतर या जवस्ट्ताररत की गई अवजध के भीतर सेवाएं िुरू
करनी होंगी।
(vi) व्यवसाय/प्रचालन/सेवाओं के प्रारंभ होने की जतजथ की सूचना प्रिासक (आईएफएससीए) को प्रिान की
िाएगी।
(vii) यह अनुमोिन पत्र व्यवसाय या प्रचालन िुरू होने की तारीख से पांच वषि की अवजध के जलए वैध
रहेगा।
(viii) यह अनुमोिन आपके द्वारा अपने पररयोिना प्रस्ट्ताव/आवेिन में िी गई िानकारी पर आधाररत है।

(ix) आप जविेष आर्थिक क्षेत्र अजधजनयम, 2005 और जविेष आर्थिक क्षेत्र जनयम, 2006 तथा इनके अंतगित
िारी आिेिों का अनुपालन करेंगे। साथ ही, आपको दकसी भी अजधजनयम, जनयम और जवजनयमों की
सभी अजनवायि/सांजवजधक आवश्यकताओं का अनुपालन करना होगा।
(x) आपके पास जविेष आर्थिक क्षेत्र अजधजनयम, 2005 और जविेष आर्थिक क्षेत्र जनयम, 2006 तथा उसके
अंतगित िारी आिेिों के प्रावधानों के अनुसार अनुमोिन का नवीनीकरण करने या क्षेत्र से बाहर जनकलने
का जवकल्प है।
(xi) आप अनुमोिन पत्र के िारी होने के पैंतालीस दिनों के भीतर प्रिासक (आईएफएससीए) को उपरोक्त
या एलओए की ितों और जनयमों की स्ट्वीकृजत की पुजष्ट करेंगे।
(xii) यह अनुमोिन तभी प्रभावी होगा िब इकाई को अंतरािष्ट्रीय जवत्तीय सेवा केंद्र प्राजधकरण या जवजनयामक
प्राजधकरणों से सभी अनुमोिन प्राप्त हो िाएंगे और प्रिासक (आईएफएससीए) के कायािलय को सूजचत
कर दिए िाएंगे।
(xiii) यदि आप उपरोक्त उजल्लजखत और इस अनुमोिन पत्र में जवजनर्ििष्ट ितों का अनुपालन करने में जवफल
रहते हैं, तो जविेष आर्थिक क्षेत्र अजधजनयम, 2005 और जविेष आर्थिक क्षेत्र जनयम, 2006 तथा उनके
अंतगित िारी आिेिों के अनुसार यह अनुमोिन पत्र रद्द कर दिया िाएगा।
(xiv) अनुमोिन पत्र की ितों और जनयमों में संिोधन/पररवतिन या इसकी वैधता बढाने सजहत
सभी भावी पत्राचार प्रिासक (अंतरािष्ट्रीय जवत्तीय सेवा केंद्र) को भेिे िाएंगे।

NOTIFICATION
New Delhi, the 3rd February, 2026
G.S.R. 114(E).— In exercise of the powers conferred by section 55 of the Special Economic Zones Act, 2005
(28 of 2005), the Central Government hereby makes the following rules further to amend the Special Economic Zones
Rules, 2006, namely: -
1. Short title and commencement. -
(1) These rules may be called the Special Economic Zones Rules, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Special Economic Zones Rules, 2006 (hereinafter referred to as the principal rules), in rule 19, after sub-rule
(1), the following sub-rule shall be inserted, namely: -
“(1A) The Administrator (IFSCA) shall issue a Letter of Approval in Form GA, for setting up of the Unit in an
International Financial Services Centre”.
(3) In the principal rules, after Form G, the following form shall be inserted, namely: -

Subject: Your proposal for setting up of new International Financial Services Centre unit in the Gujarat International
Finance Tec-Multi-Services-Special Economic Zone, Gandhinagar
Dear Sir/Madam
With reference to the above-mentioned application, the Administrator (IFSCA), Gujarat International Finance
Tec Multi-Services-Special Economic Zone, is pleased to extend to you all the facilities and entitlements admissible to
a unit in a Special Economic Zone, subject to the provisions of the Special Economic Zones Act, 2005 and the Special
Economic Zone Rules, 2006 and orders made thereunder, subject to obtaining all mandatory/statutory
approvals/permissions from all concerned Regulatory Authority(s) and for the establishment of a unit at
______________________________, in the State of______________________, for undertaking authorized operations,
namely:-
Authorised Operations
1.
This approval is subject to following terms and conditions:
(i)
You shall undertake export of financial services as per provisions of the Special Economic Zones Act,
2005 and the Special Economic Zone Rules, 2006 made thereunder for a period of five years from the
date of commencement of authorised operations. For this purpose, you shall execute the Bond-cum-Legal
Undertaking as prescribed under the Special Economic Zone Rules, 2006.
(ii)
You shall fulfill the pollution control requirements, as may be prescribed by the Pollution Control authorities.
(iii)
You may import or procure from the Domestic Tariff Area all the items required for your authorised operations
under this approval, except those prohibited under the ITC (HS) Classifications of Export and Import items.
(iv)
You may supply or provide services in the Domestic Tariff Area and as per stipulated norms, including those
specified in the SEZ Act, 2005 and the Special Economic Zone Rules, 2006 and orders made thereunder.
(v)
This Letter of Approval is valid for a period of one year from its date of issue. You shall implement the project
and commence services within one-year period or within such period as may be extended.
(vi)
Date of commencement of business/operations/services shall be intimated to the Administrator (IFSCA).
(vii)
This Letter of Approval shall be valid for a period of five years from the date of commencement of business
or operation.
(viii)
The approval is based on the details furnished by you in your project proposal/application.
(ix)
You shall abide by the provisions of Special Economic Zones Act, 2005 and the Special Economic Zone Rules,
2006 and orders made thereunder. You shall also comply with all mandatory/statutory requirements of any
Act, Rules, and Regulations.
(x)
You have the option to renew the approval or exit in terms of the provisions of the Special Economic Zones
Act, 2005, and the Special Economic Zone Rules, 2006 and orders made thereunder.
(xi)
You shall confirm acceptance of the above or LOA terms and conditions to the Administrator (IFSCA) within
forty-five days of issue of this Letter of Approval.
(xii)
This approval will come into effect only after all approvals from International Financial Services Centre
Authority or Regulatory authorities are received by the unit and communicated to the office of the
Administrator (IFSCA).

(xiii)
If you fail to comply with the conditions stipulated above and specified in this Letter Of Approval, this Letter
of Approval shall be cancelled as per the provisions of the Special Economic Zones Act, 2005, and the Special
Economic Zone Rules, 2006 and orders made thereunder.
(xiv)
All future correspondence including for amendments/changes in terms and conditions of the Letter of Approval
or for extension of its validity shall be addressed to the Administrator (International Financial Services Centre).
