भारतीय बीमा विनियामक और विकास प्राधिकरण (बीमा एजेंटों और बीमा मध्यवर्तियों को कमीशन अथवा पारिश्रमिक अथवा प्रतिफल का भुगतान) (पहला संशोधन) विनियमन, 2017

फा. सं. भा.बी.वि.वि.प्रा./विनियम/3/140/2017.– बीमा अधिनियम, 1938 (1938 का 4) की धारा 31बी के साथ पठित धारा 114ए की उपधारा 2 के खंड (आईसी) और (जेडी) तथा बीमा विनियामक और विकास प्राधिकरण अधिनियम, 1999 (1999 का 41) की धारा 14 की उप-धारा (1) और धारा 26 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए प्राधिकरण इसके द्वारा निम्नलिखित विनियमन बनाता है, अर्थात्:-

1. संक्षिप्त नाम और विनियमों का प्रारंभ:

• (क) ये विनियमन भारतीय बीमा विनियामक और विकास प्राधिकरण (बीमा एजेंटों और बीमा मध्यवर्तियों को कमीशन अथवा पारिश्रमिक अथवा प्रतिफल का भुगतान) (पहला संशोधन) विनियमन, 2017 के नाम से जाने जाएँगे।
• (ख) ये विनियमन 1 अप्रैल, 2017 को प्रवृत्त होंगे।

2. भारतीय बीमा विनियामक और विकास प्राधिकरण (बीमा एजेंटों और बीमा मध्यवर्तियों को कमीशन अथवा पारिश्रमिक अथवा प्रतिफल का भुगतान) विनियमन, 2016 में

• (क) विनियमन 5(च) को निम्नलिखित शब्दों से प्रतिस्थापित किया जाएगा "बीमाकर्ता द्वारा देय कमीशन अथवा पारिश्रमिक की अधिकतम दर निम्नलिखित में से किसी से भी अधिक नहीं होगी:-
  • (i) इन विनियमों के द्वारा विनिर्दिष्ट अधिकतम सीमा; अथवा
  • (ii) किसी अन्य विनियमन अथवा दिशानिर्देश के अंतर्गत प्राधिकरण के द्वारा अनुमोदित कमीशन अथवा पारिश्रमिक की कोई अन्य दर जो भी कम हो।"
• (ख) अनुसूची-III में, साधारण बीमा (मोटर को छोड़कर अन्य) - विनियमन 5(घ) और अनुसूची-V, सारणी III – साधारण और स्टैंडअलोन स्वास्थ्य बीमा (जैसा लागू हो) में शब्द "कॉरपोरेट" के स्थान पर "वाणिज्यिक" रखा जाएगा।

Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) (First Amendment) Regulations, 2017

**F. No. IRDAI/Reg/3/140/2017.—**In exercise of the powers conferred by clause (ic) and (jd) of su-bsection 2 of section 114A read with section 31B of the Insurance Act, 1938 (4 of 1938), and read with su-bsection (1) of sections 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority hereby makes the following regulations, namely: -

1. Short Title and Commencement of the Regulations:

• (a) These Regulations may be called the Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) (First Amendment) Regulations, 2017.
• (b) They shall come into force on $1^{\text{st}}$ April, 2017.

2. In Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) Regulations, 2016

• (a) Replace Regulation 5(f) with the following wordings “The maximum rate of commission or remuneration payable by an insurer shall not exceed either: -
  • (i) The maximum specified by these regulations; or
  • (ii) Any other rate of commission or remuneration approved by the Authority under any other Regulations or guidelines whichever is lower.”
• (b) In Schedule – III, General Insurance (Other than motor) – Reg 5(d) and Schedule V, Table III – General and Stand Alone Health Insurance (as applicable) the word “corporate” may be replaced by “commercial”.
