भारतीय बीमा विनियामक और विकास प्राधिकरण (बीमा एजेंटों और बीमा मध्यवर्तियों को कमीशन अथवा पारिश्रमिक अथवा प्रतिफल का भुगतान) (दूसरा संशोधन) विनियम, 2017

फा. सं. भा.बी.वि.वि.प्रा./विनियम/9/146/2017.—बीमा अधिनियम, 1938 (1938 का 4) की धारा 31बी के साथ पठित तथा बीमा विनियामक और विकास प्राधिकरण अधिनियम, 1999 (1999 का 41) की धारा 14 और 26 की उप धारा (1) के साथ पठित बीमा अधिनियम की धारा 114ए की उपधारा (2) के खंड (आईसी) और (जेडी) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए प्राधिकरण इसके द्वारा निम्नलिखित विनियम बनाता है, अर्थात्:—

1. विनियमों का संक्षिप्त नाम और प्रारंभः

• (क) ये विनियम भारतीय बीमा विनियामक और विकास प्राधिकरण (बीमा एजेंटों और बीमा मध्यवर्तियों को कमीशन अथवा पारिश्रमिक अथवा प्रतिफल का भुगतान) (दूसरा संशोधन) विनियम, 2017 कहलाएँगे।
• (ख) ये विनियम 1 नवंबर 2017 को प्रवृत्त होंगे।

2. भारतीय बीमा विनियामक और विकास प्राधिकरण (बीमा एजेंटों और बीमा मध्यवर्तियों को कमीशन अथवा पारिश्रमिक अथवा प्रतिफल का भुगतान) विनियम, 2016 में

• क) विनियम 5 (ग) के अंतर्गत अनुसूची-II की तालिका की पंक्ति 1 और पंक्ति 6 को निम्नलिखित से प्रतिस्थापित करें।

• ख) विनियम 5(ङ) के अंतर्गत अनुसूची-IV को निम्नलिखित से प्रतिस्थापित करें।

"अनुसूची-IV मोटर बीमा – विनियम 5(ङ)

प्रीवियस के प्रतिशत के रूप में अधिकतम कमीशन अथवा पारिश्रमिक जो साधारण बीमा (मोटर) के लिए अनुमत है, निम्नानुसार हैः

Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) (Second Amendment) Regulations, 2017

F. No. IRDAI/Reg/9/146/2017.—In exercise of the powers conferred by clause (ic) and (jd) of sub-section (2) of section 114A read with section 31B of the Insurance Act, 1938 (4 of 1938), and read with sub-section (1) of sections 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority hereby makes the following regulations, namely:—

1. Short Title and Commencement of the Regulations:

• (a) These Regulations may be called the Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) (Second Amendment) Regulations, 2017.
• (b) They shall come into force on $1^{\text{st}}$ November, 2017.

2. In Insurance Regulatory and Development Authority of India (Payment of commission or remuneration or reward to insurance agents and insurance intermediaries) Regulations, 2016

• a) Replace line 1 and line 6 of Table of Schedule – II under Regulation 5(c) with the following

• b) Replace Schedule – IV under Regulation 5(e) with the following

"Schedule – IV Motor Insurance – Reg 5(e)

The maximum commission or remuneration as a percentage of premium that is allowed for general insurance (motor) is as under:
