खान मंत्रालय अजधसूचना नई दिल्ली, 30 िुलाई, 2026 सा.का.जन. 683(अ).— केन्द्रीय सरकार, खान और खजनि (जिकास और जिजनयमन) अजधजनयम, 1957 (1957 का 67) की धारा 18 द्वारा प्रित्त िजियों का प्रयोग करते हुए, खजनि संरक्षण और जिकास जनयम, 2017 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, अर्ाात्:-

1. संजक्षप्त नाम और प्रारंभ.- (1) इन जनयमों का संजक्षप्त नाम खजनि संरक्षण और जिकास (िूसरा संिोधन) जनयम, 2026 है। (2) ये जनयम 1 अगस्ट्त, 2026 को प्रिृत्त होंगे।
2. खजनि संरक्षण और जिकास जनयम, 2017 (इसमें इसके पश्चात उि जनयम कहा िाएगा), जनयम 27 में,— (क) उप-जनयम (2) में, “बैंक गारंटी" िब्िों के पश्चात, "या बीमा प्रजतभू बांड" िब्ि अंतःस्ट्र्ाजपत दकए िाएंगे; (ख) उप-जनयम (6) में, “बैंक गारंटी" िब्िों के पश्चात, "या बीमा प्रजतभू बांड" िब्ि अंतःस्ट्र्ाजपत दकए िाएंगे।

3. उि जनयमों में, जनयम 35 में, - (क) उप-जनयम (4ख) का लोप दकया िाएगा; (ख) उप-जनयम (5), के परंतुक में, कोष्ठक, आंकडा और पत्र "(4ख)" का लोप दकया िाएगा।
4. उि जनयमों में, जनयम 45 में, - (क) उप-जनयम (7) में, खंड (क) में, उप-खंड (ii) के जलए, जनम्नजलजखत उप-खंड रखा िाएगा िाएगा, अर्ाात्: - “(ii) खान और खजनि िाजस्ट्त का न्द्यायजनणायन जनयम, 2026 के अनुसार जनयम के उल्लंघन के जलए िाजस्ट्त के न्द्यायजनणायन की िुरुआत करने के जलए कारािाई करना;” (ख) उप-जनयम (7क) में,— (i) खंड (ii) में, उप-खंड (क) में, “अनुसूची-II में यर्ा जिजनर्िाष्ट ऐसी रकम" िब्िों के जलए, "खान और खजनि िाजस्ट्त का न्द्यायजनणायन जनयम, 2026 के अनुसार िाजस्ट्त" िब्ि रखे िाएंगे; (ii) खंड (iii) में, “अनुसूची-II में यर्ा जिजनर्िाष्ट ऐसी रकम" िब्िों के जलए, "खान और खजनि िाजस्ट्त का न्द्यायजनणायन जनयम, 2026 के अनुसार िाजस्ट्त" िब्ि रखे िाएंगे।
5. उि जनयमों में, जनयम 62 के जलए, जनम्नजलजखत जनयम रखा िाएगा, अर्ाात्: - “62. िाजस्ट्त. – िो कोई भी इन जनयमों के उपबंधों का उल्लंघन करेगा, िह धारा 25क और धारा 25ख और उसके अधीन बनाए गए जनयमों (अर्ाात; खान और खजनि िाजस्ट्त का न्द्यायजनणायन जनयम, 2026) के उपबंधों के अनुसार िाजस्ट्त के जलए उत्तरिायी होगा।
6. उि जनयमों में, “अनुसूची-2” और “अनुसूची-3” का लोप दकया िाएगा।

MINISTRY OF MINES NOTIFICATION New Delhi, the 30th July, 2026 G.S.R. 683(E).— In exercise of the powers conferred by section 18 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules further to amend the Mineral Conservation and Development Rules, 2017, namely: —

1. Short title and commencement: — (1) These rules may be called the Mineral Conservation and Development (Second Amendment) Rules, 2026. (2) They shall come into force on the 1st day of August, 2026.
2. In the Mineral Conservation and Development Rules, 2017 (hereinafter referred to as the said rules), in rule 27, — (a) in sub-rule (2), after the words “bank guarantee”, the words “or insurance surety bond” shall be inserted; (b) in sub-rule (6), after the words “bank guarantee”, the words “or insurance surety bond” shall be inserted.
3. In the said rules, in rule 35, –

(a) sub-rule (4B) shall be omitted; (b) in sub-rule (5), in the proviso, the brackets, figure and letter “(4B)” shall be omitted. 4. In the said rules, in rule 45, – (a) in sub-rule (7), in clause (a), for sub-clause (ii), the following sub-clause shall be substituted, namely: – “(ii) take action to initiate adjudication of penalty for contravention of rules in accordance with the Mines and Minerals Adjudication of Penalties Rules, 2026;”; (b) in sub-rule (7A), – (i) in clause (ii), in sub-clause (a), for the words “such amount as specified in Schedule II”, the words “penalty in accordance with the Mines and Minerals Adjudication of Penalties Rules, 2026 “shall be substituted; (ii) in clause (iii), for the words “such amount as specified in Schedule II”, the words “penalty in accordance with the Mines and Minerals Adjudication of Penalties Rules, 2026” shall be substituted; 5. In the said rules, for rule 62, the following rule shall be substituted, namely: – “62. Penalty. – Whoever contravenes the provisions of these rules shall be liable to penalty in accordance with the provisions of section 25A and 25B and the rules made thereunder (i.e., the Mines and Minerals Adjudication of Penalties Rules, 2026).”. 6. In the said rules, “SCHEDULE – II” and “SCHEDULE – III” shall be omitted.
